Privacy notice

Under the new GDPR regulations , effective from 25th May 2018, Bagshaws LLP are committed to protecting your personal information. Bagshaws LLP are required to inform you of how the data you have supplied to us will be processed.

Data Protection Principles

We will comply with data protection law. This says that the personal information we hold about you must be:

1. Used lawfully, fairly and in a transparent way.

2. Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.

3. Relevant to the purposes we have told you about and limited only to those purposes.

4. Accurate and kept up to date.

5. Kept only as long as necessary for the purposes we have told you about.

6. Kept securely.

The Information we hold about our Clients/Customers

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). The data we collect from you will be in relation to the business activity you have engaged Bagshaws to conduct. The information we collect will be;

Name

Address

Telephone number

Email address

Bank account details (if necessary)

Confirmation of ID (if necessary)

Any other information relevant to the nature of the business activity

The information you supply may be collected in person, by post, by email, over the telephone, via the Bagshaws website or fax.In relation to the data we hold, Bagshaws are acting as agent.

How we will use your data

GDPR requires the business to have a lawful basis for processing your data, therefore we will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:

  • Where we need to perform the contract we have entered into with you.
  • Where we need to comply with a legal obligation.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

For property clients/contacts – consent will be gained before information is sent to you, if you wish to update your preferences at any time please email . Your contact information will be used for a period of 12 months, however, it will be stored on our Expert Agent database for the periods stated below.

Who will have access to your information

Your data will be stored securely within our IT servers or within hard copy files. The data will not be shared with third parties (unless there is a business need for this. In this case the client will be informedwith whom the information is being shared) nor will it be transferred outside the EU.

How long will we keep your information?

The data you provide to us will be retained for a period of 10 years in line with RICS guidance and to fulfil our duties with regard to conflicts of interest. At the end of this period, the client will be contacted by Bagshaws LLP for you to reclaim the file or to give the authority for it to be destroyed, if we do not receive a response, the data will be destroyed. Any data kept after this period by Bagshaws LLP for business purposes, will be anonymised.

How to keep us updated with any changes to your information

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your working relationship with us. All requests to update your personal information should be made in writing to the Partner at the relevant office.

Your rights

You have the right to;

•Request access to your personal information (commonly known as a "data subject access request"). To request a copy of the personal information we hold about you, please submit the request in writing to the Senior Partner, there is no charge for this and we will respond within one month of receipt of the request. We will require additional ID to fulfil this request.

•Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.

•Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it.

•Object to certain types of processing for example where personal information is used for direct marketing purposes.

•Object to your data be subject to automated decision-making.

•Request the transfer of your personal information to another party.
