CONDITIONS OF SALE
1All animals entered must be put up for Auction, and sold in the order in which they appear in the catalogue. Animals to be catalogued in order of age, the oldest animals to be placed first.
2The pedigree, history and description of each animal shall be guaranteed and warranted to be correct in all particulars by the person whose name appears as vendor, but every animal shall be sold subject to all faults. No liability whatever is undertaken by the Auctioneers for the statements appearing in the catalogue. The vendors who supply such statements are alone responsible for any error or mis-statement.
3Vendors must provide competent persons to take charge of their stock up till the close of sale, whether sold or unsold.
4The animals will be sold in guineas, no auction fees charged to purchasers. Commission of five pence from each guinea will be charged on all sales either public or private.
5Should any animal pass out of the sale ring unsold and be subsequently sold privately, the purchaser shall pay the commission on such private sale.
6No money shall be paid to the vendor of any lot sold, unless the lot be cleared to the purchaser, and the Auctioneers will not be answerable for any deficiency that may arise on the re-sale of any unclaimed property, but will give the vendor all reasonable assistance to have the contract enforced.
7The purchasers to give their names and addresses in writing and pay the full purchase money for each lot at the fall of the hammer, (if required), in default of which the lot or lots, so purchased may be put up again immediately and resold.
8No lot, or lots shall be removed from the premises till paid for, but every lot shall immediately at the fall of the hammer, be considered as delivered, and be and remain in every respect at the absolute risk of the respective purchaser or purchasers thereof, and shall be removed from the place at the purchasers expense.
9No undertaking of the Auctioneers or their servants to take charge of the lots or animals after the sale, or to forward them to their destination, shall be held to impose upon the Auctioneers any legal obligation vitiate of the foregoing regulations for conditions of sale.
10SPECIAL UDDER WARRANTY
All udders will be guaranteed correct (unless otherwise stated at time of sale) but no claim under such guarantee can be entertained unless made to Auctioneers before 5 pm on day of sale. If the Auctioneers are satisfied, with or without a Veterinary Inspection, that the udder is not sound in all respect, the sale of the animal will be cancelled unless amicable arrangements are made between the vendor and purchaser with the approval of the Auctioneer.
11Should any question arise, not provided for in the foregoing rules, regulations or conditions, the decision of the auctioneers shall be final, from which there shall be no appeal.
12Heifers must be under 3 years of age on day of sale
13Bulls are guaranteed fruitful under the mart terms and conditions of sale.
