REGULAR MEETING

MAY 28, 2013

A regular meeting of the Sherrill City Commission was held at 7:00 p.m. on May 28, 2013. Present were Mayor W. Vineall, Commissioners M. Hennessy, P. Hubbard, J. Merrill, J. Gilbert, City Manager B. Comis and City Clerk M. Holmes.

MINUTES

Motion was made by J. Gilbert and seconded by P. Hubbard that the minutes of the previous regular meeting be approved as written.

Motion was made by J. Merrill and seconded by M. Hennessy that the following bills be approved for payment and W. Vineall be authorized to sign the warrant.

PUBLIC COMMENT

Mark Smith, 104 Fairway Lane, was present to inquire why the city has an assessor since the Town of Vernon has 3 already. He felt this was a duplication of efforts and a waste of money. Additionally he inquired why the City Manager held that job and not someone else. The city explained that the city has a separate tax roll and thus needed an assessor to watch over it. Additionally there are differences in the Town’s tax roll and the city’s and it gives the city control over its assessments within the city limits.

Jamie Foster was present again to inquire on the progress of the city on its building code review and the status of his building permit plus asked why a Kinsley Street resident was issued a permit to build a garage on his property when he already had a garage and two assessor buildings.

The commission told Mr. Foster that they are in the beginning stages of the review and that it is a process that will take months to complete. R. Comis indicated that he would be hearing the determination of his building permit within the 10 day period as spelled out in our ordinance. Regarding the Kinsley Street question, the resident’s property is actually 2 parcels and thus the garage is the only building on the parcel and meets all setbacks as required

CITY ASSESSOR – ROBERT COMIS

Motion was made by J. Merrill and seconded by J. Gilbert to re-appoint Robert Comis to City assessor for a six-year term ending September 30, 2019.

SECOND HALF MEETING SCHEDULE

The City commission established their city commission meeting as follows. Motion was made by J. Gilbert and seconded by J. Merrill to adopt the schedule.

The Sherrill City Commission has announced its meeting schedule for the remainder of 2013. All meetings are held in the City Count room at 7:00 p.m.

GAMES OF CHANCE AMENDMENT

M. Holmes reported that the American Legion Post#230 has submitted an application to amend their 2013 Games of Chance license by adding an assistant to members in charge of Games (schedules). Motion was made by J. Merrill and seconded by P. Hubbard to approve the amendment.

BID RESULTS – STREET RESTORATION

R. Comis distributed a copy of the canvass of bid results for the street restoration as follows:

Comis reported that some of the tonnage could vary and the price may fluctuate slightly and he asked that the commission approve +/- 5% contingency for additional tonnage within the scope of the bid project any additions or deleting would need subsequent commission approval. Motion was made by P. Hubbard and seconded by J. Gilbert to approve the low bid from Dolomite Products Co. of $353,800 plus 5% Contingency.

BID RESULTS – MACHINE FORMED CURBING

R. Comis distributed a copy of the canvass of bid results for the machine formed curbing project for 2013 as follows:

R. Comis report that the estimated lineal feet could fluctuate a little in the project and recommended awarding the price per foot for curbing with the approval of a 5% contingency in the estimated lineal foot amount of 11,937ft.

Motion was made by J. Merrill and seconded by P. Hubbard that the low bid per foot form concrete slipform, inc. be approved with a contingency of 5% on the lineal feet estimate for the project of 11,937.
