implementing Regulation (EC) No 1185/2009 of the European Parliament and of the Council concerning statistics on pesticides, as regards transmission format

(1)  Introduction

Regulation 1185/2009 states that different comitology procedures are to be used for the implementing regulation on transmission formats and on definitions, quality reports and update of Annex III on active substances. This means that two separate regulations will be presented.

(2)  Transmission format

According to regulation 1185/2009, Member States shall transmit the data in electronic form, in conformity with an appropriate technical format to be adopted by the Commission (Eurostat) in accordance with the regulatory procedure.

As there will be two different sets of data, sent at different frequency and with separate reference periods, one set from 2011 onwards and the other one only in 2015, Eurostat considers it premature to define the transmission format for both sets at this stage. In the draft regulation, only the transmission formats for the sales data have therefore been included.

Eurostat also considers that giving too much technical details in a regulation gives too much rigidity to a topic where it can be expected that the technical developments might be rapid. As Annex I to Regulation 1185/2009 clearly indicates what data must be collected and transmitted, Eurostat considers that it is not worthwhile going too far in detail.

The advice of the Task Force is required on this topic.

(3)  Next steps

After the Task Force discussion, the situation will be presented to the SCAS in its meeting 17-18 May, further developed and discussed again in the AEI Working Group in October. The comitology procedure will be handled in the European Statistical System Committee (ESSC), either still end 2010 or early 2011.

It was planned that the two regulations would be discussed in the Expert Group on Pesticides under DG ENV in June, but after a reorganisation, the responsibility was moved to DG SANCO, who at the present doesn't have the resources to organise this meeting. Depending on when this meeting will be organised, the Commission will decide on whether to bring the two regulations to this forum or not.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1185/2009 of the European Parliament and of the Council of 25 November 2009 concerning pesticide statistics[1], and in particular Articles 3(3) and 5(1) thereof,

Whereas:

(1)  Regulation (EC) No 1185/2009 establishes a new framework for the production of comparable Union statistics on pesticide sales and use.

(2)  In accordance with Article 3(3) of Regulation (EC) 1185/2009 Member States shall transmit the statistical data in electronic form, in conformity with an appropriate technical format to be adopted by the Commission.

(3)  The measures provided for in this Regulation are in accordance with the opinion of the European Statistical System Committee,

HAS ADOPTED THIS REGULATION:

Article 1

Member States shall transmit the statistical data on the placing on the market of pesticides as described in Annex I to Regulation (EC) 1185/2009 in using the Statistical Data and Metadata eXchange (SDMX) format. The data shall be transmitted or uploaded by electronic means to the single entry point for data at Eurostat.

Member States shall transmit the required data conforming to the technical specifications provided by the Commission (Eurostat).

Article 2

The technical format for the transmission of data to the Commission (Eurostat) is described in the Annex.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
