AVA MINIMUM WAGE TARIFF CARD

AVA members who are already well established will continue to charge their fees based on their demand, experience & expertise they have acquired in the voicing and the quality of the individual voice. However as an attempt to curb the malpractice and to free the voicing artistes from exploitation, AVA through this tariff card recommends the rate structure for various categories of voicing work.

THE RATES SPECIFIED HEREWITH ARE THE MINIMUM PAYABLE TO A VOICE ARTIST for INDIATERRITORY ONLY.

[I] MANDATORIES:

A. Penalty:

Members who are found guilty of under cutting or charging below the minimum rate as per specified in the Tariff Card of AVA will be penalized as per the provisions of Clause No. 8 & 9 of the Constitution of AVA.

B. End Credits:

Names of all the Voice Artistes should feature in the End Credits of Feature Films(Cinema/TV/VCD/DVD) and TV serials.

C. Conveyance (For Cinema and Serial Dubs):
  1. In addition to the above mentioned remunerations on this tariff card, an amount of Rs. 300/- to be paid as conveyance in cash to the voice artiste on the spot for all kinds of recordings. For late night recordings conveyance of Rs. 500/-to be paid.
  2. For all auditions the Voice Artistes is to be paid a token of Rs. 300/- in cash only to cover conveyance and incidental expense.
D. Scratch Recordings:

For all kinds of scratch recordings 100% will be charged.

E. Correction Jobs / Re Dubbings:

a)If the voice artiste has to visit the studio again, to re-record / re-dub to carry out the corrections alterations, in the case of TV / Radio / Cinema Commercials, then the voice artiste must be paid 100% of the master fee charged.

b)In case of TV serials, voice artiste is to be paid proportionately for the correction jobs.

c)In case of TV serials the voice artiste is to be paid 100% for re-dubbing. In case of technical faults on the part of the studio or loss/corruption of recorded matter, the voice artist has to be paid 100% of his/her charges by the production house/channel for re-dubbing.

d)In the case of feature films for correction and re-recording the voice artiste has to be paid proportionally as per the number of reels he/she has done the correction or re-dubbing. The proportionate payment has to be worked out considering the total payment artiste has received for the original work & the number of reels. This fee must be negotiated BEFORE hiring the voice talent for the original dubbing. If it is not negotiated then the voice talent has to be paid whatever he/she asks for within reasonable limits.

F. Dubbing for censor copy:

There is no differentiation between censor copy and final copy.

G. Cancellations:

FOR ADVERTISING VOICE ARTISTES
Cancellation of the Recording session at the Studio / 100% of the artist Unit rate
Cancellation of Recording 1hr -2hrs prior to booking time / 100% of the artist Unit rate.
Cancellation of Recording 2 hrs prior / Minimum 50% of the artist Unit rate.
Cancellation due to Power Failure/Equipment Failure / No Charge.
FOR SERIALS, DOCUMENTARIES AND FEATURE FILM VOICE ARTISTES
If the intimation of cancellation is given 4 hours prior to the recording / No Charge.
If intimation of cancellation of the Recording 1hr prior to or on the way to the Studio / Adequate compensation as per the amount the artiste has been contracted for. But per day artistes should be paid his per day unit rate.
Cancellation of the Recording session at the Studio / Adequate compensation as per the amount the artiste has been contracted for. But per day artistes should be paid his per day unit rate.
Cancellation due to Power Failure/Equipment Failure / No Charge. But per day artists should be paid conveyance of Rs. 300/-.

H. Rejections:

FOR ALL ARTISTES
Rejection of a voice artist at the studio. / 100% of the Unit rate.
Rejection of a voice artist after he has left the studio having completed the assignment. / 100% of the Unit rate.

I. Multiple Voicing:

If a voice artiste is required to dub / record for more than one character then the artiste has to be paid for each character separately, except ambient voices.

[II] TERMS AND CONDITIONS:

All Voice Artistes should strictly follow theTERMS AND CONDITIONSgiven below wherever applicable:

a)The Client shall pay the ROYALTIES per country for variations of the Original Work in the manner set out as follows:

i. / For the vocal performance in any re-recording or fresh recording of the Original Work / An amount equal to 100% of the Master Fee
ii. / For recording of the vocal performance in the Original Work in any language other than the language of the vocal performance of the Artist specified in the bill. / An amount equal to 100% of the Master Fee
iii. / For using the vocal performance in any Language other than the Original Work / An amount equal to a minimum of 50% of the Master Fee
iv. / For any change in the Length/Edits of the Original Work / An amount equal to a minimum of 50% of the Master Fee per edit
v. / For any change in the Storyboard of the Original Work after release by way of Tag-on offers/ Change of Tel. Nos. / An amount equal to a minimum of 50% of the Master Fee
vi. / For any change in the medium of the Original Work
(Radio, T.V, Cinema, Internet, CDs, DVDs, Promotional Cassettes, POP Display, Malls, Multiplexes, Road Shows) / An amount equal to a minimum of 50% of the Master Fee
vii. / For usage of Original Work as Caller tune, Caller ring-back tune, Epabx, In-flight Entertainment, Channel/ Station IDs. / To be discussed in detail with the ARTIST for Annual Licensing.
viii. / Perpetual Buy-outs across specific or All Media / To be discussed in detail with the ARTIST per / or across media.

b)For any variation of the Original Work set out in clauses (a) (i) to (viii), the Client shall inform the ARTIST in writing at least 24 hours prior to the broadcast, distribution or exploitation of such variation and the Client shall pay the ARTIST additional royalties within 15 days from the broadcast, distribution or exploitation of such variation.

c)If the Client broadcasts, distributes or exploits any variation of the Original Work set out in clauses (a) (iii) to (vi) without prior written notice to the ARTIST as contemplated, the Client shall pay the ARTIST additional royalty of an amount equal to Minimum 100% of the Master Fee within 15 days of such broadcast, distribution or exploitation.

d)In the event the Client fails to pay the ARTIST the Master Fee or additional royalties or any part thereof on the due date of the payment, the Client shall be liable to pay the ARTIST the royalties due and payable with interest @2.00 % per month to be calculated from the due date of the payment till such time the payment is made or realized.

e)The Client shall not reproduce the Original Work in any medium other than the medium specified in this BILL without prior written consent of the ARTIST.

f)In case of cancellation 2 hrs prior to performance then No Charge. But if cancelled at the venue of performance a minimum of 1 (ONE) UNIT FEE will be payable to the ARTIST.

MISCELLANEOUS

a)The Client shall indemnify, defend and hold harmless the ARTIST against all claims, liability, damages, costs and expenses, including the attorney fees incurred or suffered by the ARTIST in connection with any third party claim or action arising out of or relating to any breach by the Client and/or its licensees, distributors, agents or any person acting under its authority.

b)The Client shall allow the ARTIST on receiving 24hours notice to inspect any of its records relating to the Original Work and its Variations thereof at his premises or any mutually agreed upon place.

c)The Client shall not assign any of the rights, benefits and obligations and/or shall not assign, transfer or sell the Original Work or variations thereof including any intellectual property rights therein to any third party without prior written consent of the ARTIST (Release Form Duly Signed and fees being paid).

d)All payments made by the Client to the ARTIST shall be made by way of CHEQUE save; except all payments made from outside of Mumbai shall be made by a demand draft payable at Mumbai or by payable at par cheque.

e)This BILL shall be subject to and governed by the LAWS of India.

f)The Parties confirm that all the terms and conditions set out herein are accepted by and binding on all parties.

g)The CLIENT undertakes and confirms that the ARTIST’S name shall not be used in connection with the products referred to in the Original Work, without prior written consent of the ARTIST.

h)The CLIENT acknowledges and confirms that the engagement of the ARTIST is non-exclusive and the ARTIST shall be free at all times to render vocal performance in respect of the advertising or otherwise of any product or service for any third party.

i)In the event a dispute arises in connection with this BILL, the parties shall attempt in the first instance to resolve such dispute through mutual consultations. If the dispute is not resolved through mutual consultations within Thirty (30) days after commencement of discussions or such longer period as the parties agree to in writing; failing which the dispute shall be referred to the Dispute Committee of AVA for a favorable and amicable solution. In the event the AVA Dispute committee is unable to resolve the dispute then either party may refer the dispute for resolution by arbitration in accordance with the Arbitration and Conciliation Act. 1996 to a Sole Arbitrator in the event the parties agree upon one failing which to three Arbitrators, one to be nominated by each party hereto and the two nominated Arbitrators appoint the a third who shall be the Presiding Arbitrator. All proceeding in any such arbitration shall be conducted in English. The place of the arbitration proceedings shall be Mumbai, India. The arbitration award shall be final and binding on the parties, and the parties agree to be bound thereby and to act accordingly. In the event of either party approaching a Court for interim relief, the application shall be subject to the exclusive jurisdiction of the Mumbai High Court.

j)All approvals, consents and notices required to be given or served hereunder by either party hereto to the other shall be deemed to be given or served if the same shall have been delivered to, left at, sent by air mail, courier, registered post or by facsimile by either party to the other at their respective addresses, given against their respective names on the first page. In case of the CLIENT the approvals, consents and notices shall be marked to the attention of ______

NOTE:

It is mandatory for all voice artistes to maintain a proper “BILL BOOK” and issue bills for every assignment that they do. Also they need to keep a copy of the bills they issue for future reference in case of any dispute. Disputes of members who do not issue bills will not be entertained. Members can collect a standard bill format from the AVA office.
