AUTO AVENUE DISPLAY CONDITIONS OF PARTICIPATION:

Auto Avenue is a display of special interest cars to be held at the Formula One event (as defined in the Australian Grands Prix Act 1994 (Vic) (Act)) to be held in 2016 (Event) at Albert Park (being the ‘declared area’ and ‘designated access areas’ as those terms are defined in the Act) (Albert Park). Auto Avenue is organised by the promoter of the Event, the Australian Grand Prix Corporation (AGPC). AGPC may at its discretion accept or reject any entries submitted. Applicants are invited to submit entries for their vehicles (Vehicle/s) in the Auto Avenue. Applicants acknowledge and agree that if their application is successful, they will be deemed to be an entrant in the Auto Avenue (Entrant) and agree to be bound by and comply fully with the following conditions:

  1. Provision of Vehicle and compliance with directions
  1. The Entrant must comply with all directions of AGPC in relation to the time, place and manner of delivery, location, display, movement and removal of the Vehicle and all other aspects (including promotion and advertising) of Auto Avenue and the Event. All such matters will be determined by AGPC at its discretion.
  2. The Entrant represents and warrants that, in respect of any photographs or other material provided to AGPC pursuant to these Conditions in which copyright or any other intellectual property right subsists (Work), the Entrant has the right to authorise, and hereby authorises AGPC to use and copy the Work at its discretion (and to sub-license others to use and copy the Work), and that any copyright and other intellectual property rights, approvals, licences and/or clearances necessary to enable AGPC to exercise these rights have been duly obtained by the Entrant.
  3. AGPC may use an Entrant’s image and name and any image or likeness of the Vehicle at its discretion in the promotion of the Event (including without limitation Auto Avenue) or any other subsequent Formula One events.
  1. Entry and Credentials
  1. The Entrant will receive a Vehicle credential enabling entry for a Vehicle to the Event (Vehicle Credential) and 2 personal credentials (Credentials) (subject to any conditions and restrictions determined by AGPC in its absolute discretion). The Vehicle Credential must be clearly displayed on the Vehicle at all times.
  2. The Entrant acknowledges and agrees that the use of the Credentials and entry to and presence at the Event is subject to:
  1. the published Attendance Conditions displayed at entrances to or within Albert Park and at
  2. the conditions on the reverse of the Credentials and Vehicle Credential,
  3. the conditions on the reverse of the Credential Application Form,
  4. the Act and any applicable regulations made thereunder,
  5. the Parks Victoria Code of Conduct for Contractors Undertaking Works at Albert Park (copy available on request) and
  6. all requirements of any authorities with jurisdiction over the activities of AGPC, Albert Park and any facility therein.
  1. AGPC reserves the right to refuse entry to any Credential holder with reasonable cause.
  2. The Credentials and Vehicle Credential remain the property of AGPC at all times.
  3. If requested by AGPC, Credential holders must surrender the Credential and/or Vehicle Credential and immediately leave Albert Park by the nearest exit.
  4. AGPC may add to, alter or otherwise vary these conditions without notice.
  1. Liability and indemnity
  1. The Entrant acknowledges and accepts that motor racing and activities related to the Event are dangerous and accidents can happen, and that entry to and remaining at the Venue or Event has a degree of danger.
  2. To the extent permitted by law, the Entrant excludes, releases and forever discharges each of the Indemnitees (AGPC, the Crown in right of the State of Victoria, the Minister administering the Act, the Minister administering the Crown Land (Reserves) Act 1978 (Vic), the International Promoters, the Governing Bodies, the Other Event Organisers (Formula One Marketing Limited (FOM), Formula One World Championship Limited (FOWC), Formula One Asset Management Limited, Formula One Hospitality and Event Services Limited (UK), Formula One Licensing B.V., Confederation of Australian Motor Sport Ltd, Allsport Management S.A., Parks Victoria, the State Sport Centres Trust, APP Corporation Pty Limited) and all other persons involved in the conduct, promotion and organisation of the Event including officials, marshalls, rescue and medical staff, the competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors and affiliated companies) and their respective personnel from all liability for claims, loss, damage, costs or expenses suffered by the Entrant or their Credentials users (whether arising under statute, from negligence, personal injury, death, property damage, infringement of third party rights or otherwise) arising from or in connection with the Event or the Auto Avenue.
  3. None of the Indemnitees will be responsible for acts, omissions or defaults of the Entrant or its Credential users, nor, to the extent permitted by law, will any Indemnitee be liable for any claim, loss, damage, cost or expense (whether arising under statute, from negligence, personal injury, death, property damage or infringement of third party rights or otherwise) arising from any act, matter or thing done, or permitted or omitted to be done, by the Entrant or their Credential users pursuant to, in default of or in connection with this Agreement.
  4. Entrants are responsible for their own property (including the Vehicle(s)), and the Indemnitees will not be liable for loss or damage to any property (including the Vehicle(s)) brought to the Auto Avenue.
  5. Each Entrant indemnifies and must keep indemnified each of the Indemnitees and their respective Credential users against all claims, loss, liability, damage, cost or expense which may be incurred or sustained by any of the Indemnitees or their personnel arising from any act, matter or thing done, permitted or omitted to be done by the Entrant or its Credential users pursuant to, in default of or in connection with these Conditions and participation in Auto Avenue.
  6. Nothing in this clause 3 or these Conditions affects your rights under the Competition and Consumer Act2010 (Cth), Australian Consumer Law and Fair Trading Act 2012 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions or warranties cannot be excluded by law.
  1. Licence, registration and insurance
  1. Any person who drives a Vehicle within Albert Park during the Event (Event Period) must hold a current Victorian driver’s licence, other State and Territory applicable driver’s licence. No person may drive a Vehicle within Albert Part during the Event Period if they are disqualified from driving in any state or territory of Australia.
  2. All Vehicles must be registered and insured under the Victorian or other recognised vehicle registration and compulsory insurance scheme throughout the Event Period. Entrants must provide evidence of such registration to the satisfaction of AGPC on request.
  3. Entrants must obtain and maintain for the duration of the Event Period, at their own cost, a comprehensive vehicle insurance policy in respect of the Vehicle/s against any liability or loss incurred by the Indemnitees or any third party in relation to any act or omission by the Entrant or his/her agents or representatives or otherwise occurring in respect of the Vehicle. Entrants must provide evidence of such current rider’s licence, registration and insurance policy to the satisfaction of AGPC on request.
  1. No signage
  1. No signage or advertising is permitted on or in relation to any Vehicle without the prior written consent of AGPC (which may be withheld at AGPC’s absolute discretion).
  2. Entrants must not advertise, promote, distribute, sell or offer for sale any promotional material, merchandise or other goods or services within Albert Park or in relation to the Event.
  3. Without limiting the effect of the foregoing, no signs or other references to tobacco or tobacco-related products may be displayed on or in relation to any Vehicle, facilities or equipment, and Entrants must comply with the Tobacco Advertising Prohibition Act 1992 (Cth) and the Tobacco Act 1987 (Vic) and any other applicable tobacco legislation and regulations, notices and specifications issued thereunder.
  1. Television, Film and Moving Picture Rights

Entrants acknowledge and agree that:

(a) they will have no rights whatsoever in respect of any sound recording, visual footage or audio-visual footage (in any medium whatsoever) (Recording) or any information or other data including official timing, results, performance, telemetry, weather or race control data (Data) of, at, or in relation to the Event, including photographic images and any still pictures derived or capable of being derived from a Recording (Image) and acknowledges that such rights vest with AGPC and/or FOWC and any assignee, nominee or licensee of AGPC and/or FOWC;

(b) where entitled to do so, by law, agreement with third parties or otherwise, AGPC may grant to any other person or corporation any right, title, licence and interest in any of the Image or Recording;

(c) if an Entrant should acquire any right, title or interest at any time in any of the Recording, Data or Image it must not in any way use it and must immediately assign it to AGPC, FOM and/or FOWC and any assignee, nominee or licensee of AGPC and/or FOWC at no charge; and

(d) Entrants must not make, create, store, record, transmit, broadcast, reproduce or use (or authorise the making, creating, storing, recording, transmission, reproduction or use of) any form of Recording or Image, and must not store, record, transmit, reproduce or use any Data, of at or in relation to the Event (including of cars, drivers, teams, persons or activities present or situated within Albert Park) for any form of public advertisement, display, commercial gain or for any other purpose (except for the private enjoyment of the person making the Recording, Data or Image) except with the prior written permission of AGPC and/or FOWC in its (or their) absolute discretion.

IMPORTANT INFORMATION

  • Entries are subject to the Conditions of Participation and any further terms imposed by the Australian Grand Prix Corporation (AGPC) from time to time.
  • Entries must be completed and sent to Adem Agushi (details below) by Friday 12th February 2016.
  • Each eligible Entrant will receive two credentials valid for all four days of the 2016 Formula 1® Australian Grand Prix (Event), subject to any conditions attached to such credentials.
  • Participation in the Auto Avenue display and the presence of the Vehicle at the Event is entirely at each Entrant’s own risk. Entrants are obliged to obtain a comprehensive vehicle insurance policy in respect of their Vehicle.
  • AGPC does their utmost to ensure that the Albert Park Venue is returned in the condition it was received and we expect the Car Clubs to do the same. Therefore, extreme care must be taken on all surfaces of the Albert Park Venue.
  • Each Entrant is to ensure that the utmost care is taken to all surfaces of the Albert Park Venue during ‘bump in’ & ‘bump out’. Any vehicle and entrant seen or found to have caused excessive damage (including but not limited to burnouts) to any surface of the Albert Park Venue (including the Circuit) will be liable for the cost of repairs to the surface.
  • The future involvement of an individual and the representatives’ Car Club will be taken into consideration in future events if any of the Conditions of Participation in AGPC’s opinion are broken or damage is caused to surfaces of the Albert Park Venue.
  • AGPC will have roving security in place for the duration of the Event however makes no guarantee as to the security of the Entrant’s Vehicle.
  • Vehicles must be available for display by AGPC no later than 6:00pm Wednesday, 16th March 2016 and on display for the duration of the Event. AGPC will notify Club Coordinators of suitable times for removal of vehicles on Sunday 20th March 2016.
