I have read the terms, condition and requirements that Premier Auctions Galleries LLC has provided and fully understand as well as agree to them. I am of 18 years of age, of sound mind, owner or have authority by Ohio state law to rightfully consign listed items.

PREMIER AUCTION GALLERIES LLC WILL BE IDENTIFIED AS PAG ON ALL CONTEXT PAGES

1. CONSIGNMENT: Consignor grants Premier Auction Galleries theright to sell his / her or its property at public auction. PAG will decide the auction at which the property will be auctioned. PAG may divide or combine the property into one or more separate lots. PAG will incur no liability for the postponement of any auction for any reason and is not responsible for Any items left with PAG that do not appear on a property receipt and this also applies to item’s that do not sell or passed at any auction. And must removed from the premises within 15 days or the consignor will be charged storage fees of $5.00 per item per day deductible from sales proceeds. PAG does not guarantee the selling price of any items. All estimates are opinions only and shall not be construed as a promise of selling price. Premier Auction Galleries is not liable for errors or omissions in catalogues or descriptive material. Consignor will pay packing and transportation cost as well as well as any rental equipment and cleaning, restoration or outside appraisal cost to authenticity or describe property. Any cost in excess of $35.00 will be approved by consignor in advance. Any special provisions will be stated inwriting on reverse side.

2. COMMISSIONS: Bases on commission rate on consignment have variable rates as applied to Real Estate and chattels. Household goods compared to fine art, antiques, sports memorabilia, books and etc may have different rate as agreed to on front page of form.

3. RESERVES AND WITHDRAWS: Reasonable reserves will be accepted. (The reserve items will be decided solelyby PAG and may refuse any property that we may feel the reserve is too high or not in the best interest of both parties). In some cases there may be areserve fee. No property reserves can be raised after item is consigned... Consignor will be charged 10% of the reserve for lots not reaching reserve price, and a pickup and redelivery charge. IF consignor fails to pay the 10% no sale commission within 15 days after sale date shall allow PAG to have full rights to sell item(s) at whatever the market price will bear at time property is reoffered for sale to recover the no sale commission(s) and any other cost involved, with any if anyremaining proceeds going to consignor. Consignor agrees that neither he/her nor their representatives will bid on items under this agreement. Consignor agrees not to withdraw any property subject to this agreement unless agreed to by PAG and the payment of costs(both the buyer’s premium and commission fees and any other cost) due as if the item had been sold. PAG has the right to pass any property they feel not been adequate on behalf of the consignor and reserve the right to withdraw any property or prior of the hammer falls.)

4. INSURANCE OBLIGATION: The consignor shall bear the risk of loss or damage to consignor’s property, and will be their responsibility to carry liability or other such insurance policy. Unless stated on front side of this form. That insurance liability if agreed and accepted by consignor. And if consignor suffers a loss In no case will the amount of liability to Premier Auction Galleries exceed low estimate reserve or amount of coverage set by PAG .(In case of 3rd party pick up or delivery the responsibility with remain solely with consignor). PAG will not be responsible for any acts of god, fire, flooding or atmospheric changes to consignor’s property.

5 WARRANTIES AND INDEMNIFICATION BY CONSIGNOR: (A) Consignor represents and warrants that he /she or their representatives has the legal right to consign the property for sale; that there is not, nor will there be, any claim, lien or encumbrance against the property for any reason. and that the title passes to the highest bidder acknowledged (B) Consignor agrees to indemnify PAG against all claims and expenses, including reasonable attorney’s fees arising from the actual or claimed breach of any of the Consignor(s) warranties or representations herein, which shall survive the completion of a sale of property.

6 MISCELLANEOUS: This agreement is binding upon the Consignor’s heirs, beneficiaries, and executors, ET. al.; is assignable only with Premier Auction Galleries consent; may be modified only in writing signed by Premier Auction Galleries and their Consignors; shall be governed by the laws of the State Of Ohio or by the laws of the state where Premier Auction Galleries LLC may be conducting a sale of property at. This contract will continue in force until notice to cancel is given by either party. We accept absentee and phone bids. PAG will not be responsible for failing to execute any bids for any reason. .

9. CONSIGNOR AGREES. By signing this contractthey have read and understand all terms and conditions and acknowledge that auction prices are generally lower than price guide indicators. And the market price isregional and constantly changing.

10. PAYMENT: Consignor shall be paid within 30days after the consigned property has been sold and paid in full by the buyer. Commissions and/or any other fees or payment shall be deducted from the proceeds.
