14. General Summary of Function/Purpose of Position
This position serves to protect the economic welfare of the people of the State of Michigan, as it pertains to weights and measures Laws and Regulations. This position uses their knowledge of scientific methodology and theory to conduct investigations on all commercial weighing and measuring devices for fraudulent activities. Investigations are conducted in response to consumer complaints of illegal activities, and program statistical and scientific study; program research, professional knowledge and informant. This position conducts field tests of commercial weighing and measuring devices; and collects official investigative samples of products. This position conducts investigations into the net contents of random packaged products both over-the-counter and as part of a focus project; pursues compliance of Laws and Regulations through issuance of administrative fines in the field, civil and criminal court actions, embargo, and removal orders. Investigates consumer complaints regarding electronic scanners, advertising, or other fraudulent misrepresentations.
This is the entry level. As a trainee, the employee carries out a range of professional weights and measures, assignments while learning the methods of work.

Duty 1
General Summary of Duty / 10 % of Time
The entry level position trains on a range of work assignments and acquires knowledge as it pertains to weights and measures, and scanner, advertising, motor oil, laws and regulations.
Individual tasks related to the duty.
  • As a trainee, completes work assignments and/or focus projects as it pertains to the weights & measures program.
  • Acquires knowledge of all Laws and Regulations as it pertains to weights and measures, and scanner, advertising.
  • Acquires a knowledge of NIST Handbook 44, "Specifications and Tolerances for Weighing and Measuring Devices,” NIST Handbook 133, "Checking the Net Contents of Packaged Goods.", and NIST Handbook 130 “Uniform Laws and Regulations in the area of Legal Metrology and Engine Quality.”
  • Assist technical committee members with changes to Handbook 44, Handbook 133, and NIST Handbook 130, "Uniform Laws and Regulations."
  • Perform any other work related task or duty as appropriate to this classification as directed by program administration.

Duty 2
General Summary of Duty / 10 % of Time
As an entry level position, assist in conducting investigations of illegal practices as it pertains to weights and measures, scanners, advertising and motor oil. Assist in investigations as it pertains to consumer and industry complaints or as part of a special assignment.
Individual tasks related to the duty.
  • Assists and obtains proper techniques in conducting investigations of illegal practices as it pertains to weights and measures, scanners, advertising and motor oils Laws and Regulations.
  • Assists and obtains proper techniques in conducting undercover purchases of commodities for compliance with weights and measures Laws and Regulations (i.e. legal method of sale).
  • Assists and obtains proper techniques in conducting undercover purchases of all types of commodities for net content determination (e.g., scrap metals, food products, hardware).
  • Assists and obtains proper techniques in conducting mathematical and market examination of documents such as: invoices, checks, receipts, records, ledgers, corporate charters, deeds and other legal documentation. Be able to test a hypothesis using scientific theory and proof.
  • Assists and obtains proper techniques in conducting examination and evaluation of electronically stored data such as database files, and inventory records systems.
  • Work cooperatively with other governmental agency personnel to achieve common goals (i.e., United States Secret Service, State Police, FBI)
  • Receive and act upon information from informants, consumer complaints and industry.
  • Assists in the investigation of consumer complaints as it relates to various weights & measures investigations.

Duty 3
General Summary of Duty / 10 % of Time
As an entry level position, assists in conducting field enforcement activities to correct non-compliant situations with respect to weights and measures.
Individual tasks related to the duty.
  • Assist journey and senior level staff when conducting field enforcement activities to correct non-compliant situations with respect to weights & measures.
  • Provide verbal and written information and materials to regulated parties to assist with compliance.
  • Issue written corrective orders on-site when appropriate.
  • Assist in obtaining search warrants, administrative inspection warrants, restraining orders and subpoenas from the court.
  • Issue Stop Sale Orders, Embargo and Removal Orders.
  • Provide for removal, storage and/or destruction of seized materials.
  • Perform any other work related task or duty as appropriate to this classification as directed by program administration.

Duty 4

As an entry level position, assists with evidence collection.
Individual tasks related to the duty.
  • Assist journey and senior level staff while learning proper techniques with regard to evidence collection.
  • Assist while learning proper techniques in obtaining physical evidence through the use of photographs, photocopies, video and audio recordings.
  • Assist while learning proper techniques in obtaining original invoices, checks, receipts, records, ledgers, corporate charters, deeds and other legal documentation to support violation charges.
  • Assist while learning proper techniques in obtaining electronically stored data such as database files, inventory records systems to support violation charges.
  • Maintain evidence integrity through incorporation of chain of evidence.
  • Make visual observations for evidence collection through the use of undercover surveillance (i.e., firm=s storage tanks use observations).
  • Assist while learning proper techniques in conducting interviews with potential witnesses with and without communication equipment (phones, recorders, etc.).

Duty 5
General Summary of Duty / 10 % of Time
As an entry level position, works as a team member on focus projects and in conjunction with other local, state and federal agencies with respect to motor fuels quality and weights & measures programs.
Individual tasks related to the duty.
  • As a team member assist on focus projects and in conjunction with other local, state, and federal agencies with respect to and weights and measures programs
  • Assist in working cooperatively with other enforcement staff to complete focus assignments (i.e., fuels quality & weights measure commodity purchases, undercover surveillance of weights & measures operations).
  • Learn to evaluate unusual circumstances and conditions when completing a focus project to make a determination of when to request variance from protocol.

Duty 6
General Summary of Duty / 5 % of Time
As an entry level position, conducts on-site testing and sampling of motor oils.
Individual tasks related to the duty.
  • Assist journey and senior level staff while learning proper techniques with regard to conducting on-site testing and sampling of motor oils (i.e., which sampling method to use for which test).
  • Assist while learning proper techniques the sampling of motor oils from dispensers utilizing scientific method and necessary specialized equipment that provides for bottom container fill.
  • Assist while learning proper techniques the sampling of motor oils from underground storage tanks utilizing specialized equipment.
  • Assist while learning proper techniques the sampling of motor oils from peddle trucks, tankers, barrels or other potential storage and dispensing equipment utilizing personal knowledge of sample integrity and safe sampling methods.
  • Assist while learning the evaluation of motor oil labels for compliance with NIST Handbook 130.

Duty 7
General Summary of Duty / 35 % of Time
As an entry level position, assist in conducting net weight fraud and special project weights and measures examination of commodities where net content is determined at the time of sale or in advance of sale.
Individual tasks related to the duty.
  • Assist journey and senior level staff while learning proper techniques in regards to conducting net weight fraud and special project weights and measures examination of commodities where net content is determined at the time of sale or in advance of sale.
  • Verify accuracy and correctness of scales used for examination process.
  • Conduct packaging testing, utilizing approved testing procedures and appropriate tare systems.
  • Conduct over-the-counter buys and subsequent net content determinations to determine accurate net content at time of sale.
  • Conduct surveillance on firms suspected of net content fraud.
  • Conduct interviews with appropriate personnel to determine method of sale of commodities and appropriate use of weighing and measuring devices.
  • Perform any other work related task or duty as appropriate to this classification as directed by program administration.

As an entry level position, assist while learning proper techniques in conducting thorough and scientifically repeatable examinations on weights and measures devices as part of weights and measures fraud investigation or a special project to determine if the device meets all of the specifications and tolerances established by the National Conference on Weights and Measures.

  • Inspect, test, and examine scales and all interfaced devices utilizing the device certificate of conformance, appropriate test weights, examination procedures and personal knowledge of scientific principals involved.
  • Inspect, test and examine liquid measuring devices and all interfaced devices utilizing the device certificate of conformance, appropriate test measures, and examination procedures.
  • Acquire knowledge of fraud and fraudulent activities to conduct additional testing and evaluation of scales, liquid measuring devices, and all interfaced devices to ensure the devices cannot be used fraudulently.
  • Assists while learning proper techniques on how to conduct a review of computer audit trails and other similar accountability features required by Handbook 44 to determine if the device under review may have been used to perpetrate fraud.
  • Acquires a working knowledge of the computer components involved in weighing and measuring devices.

Duty 9

As an entry level position, attend training as it pertains to all aspects of weights & measures. The entry level position attends, participates, and successfully passes or completes all training modules and/or conferences as it pertains to weights and measures as program administration deems necessary.

As an entry level position, the trainee while learning the methods of work as it pertains to weights & measures and motor oils defers all decisions to program trainers and/or program administrators.

18. What kind of physical effort do you use to perform your job? What environmental conditions are you physically exposed to on your job? Indicate the amount of time and intensity of each condition. Refer to instructions on page 2.
Undercover and surveillance may be conducted in high crime areas, requiring special equipment and/or safety precautions, involving non-standard work hours (e.g., evenings, week-ends, holidays), and long periods of time sitting in cars, vans or trucks. May require extended travel due to large work area with frequent overnight stays. Investigation of fraudulent activities may expose the specialist to the possibility of verbal and/or physical assault. Some investigations of felony cases may expose the investigator to organized crime situations.
The employee’s responsibilities may necessitate, climbing, bending, stooping, lifting of heavy equipment or packages (50 lbs.), working around heavy equipment that is in operation, and be subjected to extreme temperature variations, handle and transport of toxic substances and exposure to toxic fumes. May be required to drive in extreme weather conditions.

23. WHAT ARE THE ESSENTIAL DUTIES OF THIS POSITION?
This position is a skilled and knowledgeable part of the weights and measures consumer protection program within the Laboratory Division. This position serves primarily as a fraud specialist and field enforcement for violations of the applicable Laws and Regulations. This position serves as statewide technical scientific expert in the field, capable of initiation and completion of any fraud investigation with little or no direct supervision.
24. Indicate specifically how the job's duties and responsibilities have changed since the position was last reviewed.
The function of the Weights and Measures Program, has become more focused, due to a significant amount of industry technological changes requiring the enforcement specialist to constantly upgrade his/her technical expertise in recognition of these changes and how they may be used to commit electronic fraud.
In 2017 the Weights and Measures Program became legally responsible for the compliance of motor oils sold throughout the state. This requires staff maintain up to date on all labeling requirements and other technical materials related to motor oils.

The work area functions as a fraud investigation and field enforcement unit with respect to weights and measures motor oils. This position functions as a statewide specialist in the areas of weights and measures and motor oils.
26. In your opinion, what are the minimum education and experience qualifications needed to perform the essential functions of this position?
EDUCATION:
Possession of a bachelor’s degree in the physical sciences, mathematics, industrial technology, computer science, engineering, or a field related to scientific measurement.
EXPERIENCE:

ALTERNATIVE EDUCATION AND EXPERIENCE
Possession of an associate’s degree in industrial or electronic systems technology, computer technology, industrial engineering technology, metrology, mathematics,physics or a field related to scientific measurement and four years of experience as aWeights and Measures Inspector E10 may be substituted for the education andexperience requirements.
KNOWLEDGE, SKILLS, AND ABILITIES:
Strong verbal and written communication skills. Knowledge of computers, scientific methods and theories and mechanical and electronic devices.
CERTIFICATES, LICENSES, REGISTRATIONS:
  • Ability to complete and pass NIST (National Institute of Standards and Technology) Modules Training, pertaining to motor fuels quality and weights and measures.
