VALLEY HIGH SCHOOL
ASSOCIATED STUDENT BODY CONSTITUTION
PREAMBLE

We the student body of Valley High School adopts this constitution to promote school spirit, include leadership among students, organize school activities, and establish a bond of cooperation among students and staff. This constitution shall adhere to the restriction among students by the California Education Code, the Sacramento County Board of Education, the Elk Grove Unified School District, and the Valley High School administration.
Article I, Official Student Organization: Section I. NAME

  1. All registered students are members of the Associated Student Body school policies.
  2. Membership is terminated upon graduation or detrimental action toward the school.

Article II, Associated Student Body: Section I. GOVERNMENT

The Associated Student Body of Valley High School shall have a democratic and representative form of government.
Article II, Associated Student Body: Section II. LEADERSHIP

  1. A class emphasizing the values of leadership shall be offered as part of the regular academic curriculum of Valley High School.
  2. Enrollment shall be open to all students interested in displaying campus-wide leadership, with priorities given to Associated Student Body elected and appointed officers and class officers.
  3. Mandatory attendance shall be required of all students in the ASB leadership program.
  4. The Activities Director and the School’s Principal maintain the right to intervene in the decision making process when necessary to act in accordance with what is best for Valley High School and the student body.

Article II, Associated Student Body: Section III. DUTIES

  1. The executive duty of the Associate Student Body belongs with the president and the Activities Director.
  2. The legislative duty of the Associated Student Body belongs with the Cabinet.
  3. The activities duty of the Associated Student Body belongs with the Activities Council, subject to approval of the ASB President and Activities Director.

Article II, Associated Student Body: Section IV. VOTING MEMEBERS

The Cabinet voting members shall be the Vice President, ASB Secretary, ASB Treasurer, ASB Historian, Activities Chairperson, Rally Director(s), Publicity Chairperson, School Board Representatives, and the Class Governors. The ASB President will cast the deciding vote on any issue where the cabinet is tied in their voting.

Article III, Elections; Section I. VOTING

  1. All elections will take place in the following manner:
  2. Each election will take place in the correct season.
  3. ASB elections will take place in the April of the current school year
  4. Homecoming will have nominations and elections in the fall of the current school year
  5. Prom and ball will take place in the spring of the current school year.
  6. All registered non-senior students shall be granted the privilege of voting in the following manner:
  7. The homecoming court will be representative of the Junior and Senior classes.
  8. Students in the Junior class will nominate and vote for a Junior prince and princess.
  9. The students in the Senior class will nominate and vote for Homecoming King and Queen.
  10. The Senior Class will nominate Senior Ball Court and vote for Ball King and Queen.
  11. Each student shall receive one vote in any election they are eligible for.
  12. All voting will take place in the manner prescribed by the Activities Director and during the period prescribed by the Activities Director.
  13. All royalty nominees must be approved by administration prior to the voting process

Article III, Elections; Sections II. QUALFICATIONS

A. All student body and class officers must hold a 2.0 GPA, and no F’s, with the exception of the Student Body President, who must maintain a 3.0.GPA and no F’s.Students must have 2.0 to interview for ASB (when interviewing, grades are based on the previous quarter). These GPAs must be maintained while in office. At no time during an officer’s term may he/she be holding a grade of “F”.

1.Students who are in general ASB must maintain a 2.0 GPA, and have no F’s. During the school year, if students in ASB have any F’s or a GPA that is lower than a 2.0 they will be placed on probation. Students have until the end of the semester to raise their grades. Semester grades are considered to be final and if an ASB student has a GPA lower than a 2.0 or any F’s on their semester report card they will be removed from the ASB program.

2.Students on probation will come to ASB leadership class but not participate in their regular activities. They will also be required to attend after school study hall once per week.

3.Ten unexcused absences from ASB leadership class may result in removal from the ASB program

4.Unsatisfactory citizenship may result in immediate removal from the ASB program at the discretion of the Activities Director.

5.When becoming a member of Valley High School’s Associated Student Body, members will be required to sign a written code of conduct. Any violation of the Valley High ASB Code of Conduct may result in immediate dismal from the ASB program.

B. All ASB officers shall be juniors or seniors with exception of the following:

1. The ASB President shall be a senior.

2. The Secretary shall be a sophomore, junior, or senior

Article III, Elections: Section III. PETITION

All candidates for student body office, class office, or appointed position, must be in good standing according to the regulations set forth by the Constitution. Each candidate is required to attend all informational meetings. In cases where the candidate fails to follow procedures, a warning will be issued. After that, failure to comply may resolve in dismissal. A candidate must have a 2.0 GPA (3.0 GPA for ASB President) in the most recent period in order to be eligible to run for office.
Article III, Elections: Sections IV. ELECTED OFFICERS

The elected officers shall be the Student Body President, Vice President, Secretary, Treasurer, and Class Governors (Senior, Junior, and Sophomore).
Article III, Elections: Section V. APPOINTED OFFICERS

A. The appointed officers shall be the Activity Chairperson, Rally Directors, Secretary, and Publicity Chairperson, and two School Board Representatives.
B. The appointed candidates will follow all procedures the elected officers follow and will be selected by interview, not voted into office.
C. The standing Cabinet, along with the Activities Director,shall interview all appointed candidates and make all selections.
Article III, Elections: Sections VI. NOMINATING CONVENTION

If it is determined by the Activities Director that a nominating convention is in order:

A. The purpose of the Nominating Convention shall be to narrow the candidates to two (2) for each ASB elected Office.
B. The candidate receiving the greatest number of votes shall be placed first on the ballots. The candidate with the second greatest number of votes shall be placed second on the ballot.
C. The Convention shall be chaired by the Publicity and Activities Chairperson, with the ASB President as the Convention President.
D. The Nominating Convention shall be governed by its own law.

Article III, Elections: Sections VII. TENURE OF OFFICE

A. All elected and appointed officers shall hold office for a term of no less than one year -- from June to June.
B. No member of the student body who is graduating at mid-term or plans to transfer at mid-year will be eligible to run for an elected office or hold and appointed office.
C. Vacancy of Office: In the case of vacancy after elections, or after appointed interviews, the position will be filled through appointed interviews with the date to be determined by the Activities Director. In the case of a position becoming available, vacancies will be filled through an appointed process. (This procedure applies to all positions with the exception of the presidency. The Vice President will take over the position of the President, and the appointed process will be held for the Vice Presidential position).

  1. Petitions must be obtained from the Activities Director
  2. Any student in ASB may apply for an open position, including current ASB or Class officers, as long as they meet the qualifications.

Interviews and appointments will be conducted in the same way that a regular appointment would be conducted.

D. The Activities Director and the school’s Principal maintain the right to remove any person or persons for any violation of the constitution, by-laws, or violation of the ASB code of conduct.

Article IV,duties of ASB elected Officer; Section I.PRESIDENT

The ASB President is the Supreme Executive and Commander in Chief of all members. It shall be the duty of the student body President to preside over all meetings of the Cabinet and to assume responsibility for the proper functioning of all student body activities. Should any elected officer leave office within 45 days of the end of the school year, he may be replaced by Presidential appointment. He shall retain invested power to appoint any of the appointed positions with the approval of the Cabinet and Director of Activities. Presidential duties shall include appointing special committees as needed to carry out student body activities and/or business. The president shall have the power to remove any appointee upon the approval of the cabinet. The president shall have veto power which may be overridden by 2/3 majority of the voting members of the cabinet. The ASB President has the power to break a tie as specified in Robert’s Rules of Order.

Article IV, Duties of ASB elected officers; Section II.VICE PRESIDENT

The Vice President shall assume duties of the president in his temporary absence.

Article IV, Duties of ASB Elected officers; Section III.SECRETARY

The Secretary will act as the official secretary at all Cabinet Meetings. The secretary shall take minutes of all ASB Cabinet meetings and disperse to all class council members in a timely manner.

Article IV, Duties of ASB Elected officers; Section IV.TREASURER

The Treasurer shall be the official keeper of the records of finances including bills and expenditures and shall act as controller of all ASB Funds. Treasurer must maintain a budget and work with the school bookkeeper on the proper procedures for handling money, requesting purchase order forms, providing receipts and/or invoices for each purchase in a timely manner. A financial report shall be requiredat each Cabinet meeting.Adequate fiscal control must be maintained for the handling of all student funds at all times as per the California Education Code.

Article V, Duties of ASB Appointed Officers; Section I. ACTIVITIES

The Activities Chairperson shall be the President of clubs and organizations and shall be in charge of activities council meetings. The Activities Chairperson shall request the necessary organizations send a representative to each meeting. The chairperson shall be expected to be acquainted with Robert’s Rules of Order. The Activities Chairperson is directly responsible to the Activities Director, who in turn will render a judgment in case of mishap and disciplinary problems during activity council meetings. Activity council meetings will be open to one representative from each club and all Cabinet members. He shall also be responsible for updating the school’s activities board at regular intervals.

Article V, Duties of ASB Appointed Officers; Section II.RALLY DIRECTOR

The Rally Director(s) shall be in charge of all activities related to school spirit. This officer shall organize all rallies. Anytime during the Rally Director’s term in office, the Activity Director, Principal, Activities Chairperson, or the ASB President may intervene for the best interest of the Valley High School student body. Try-outs for the position of Rally Director(s) must take place prior to the start of the upcoming school year. Rally Director(s) must meet with the administrative team to present the proposed agenda for the rally at least one week prior to the rally taking place.

Article V Duties of ASB appointed Officers; Section III.SCHOOL BOARD REPRESENTATIVE

Each school Board Representative shall be expected to attend all Elk Grove Unified School district Board meetings and report at the discretion of the School Board. They shall also serve as a liaison between Valley High School and Elk Grove School Board. Reports of E.G.U.S.D board meeting items pertinent to Valley H.S. will be made at Cabinet Meetings.The School Board Representatives must meet with the Principal twice prior to the Board Meeting to read and review the content of the Board Report.

Article V, duties of ASB Appointed Officers; Section IV.PUBLICITY CHAIRPERSON

Publication Chair coordinates and oversees all publications including but not limited to posters, signs/banners, social media, and all other publications for ASB

Article V, Duties of ASB Appointed Officers; Section V.HISTORIAN

The Historian is responsible for the documentation of all ASB events which includes taking photos and keeping records of all ASB and class activities, rallies, spirit activities, etc. Additionally, the ASB Historian will work with the Activities Chairperson to regularly update the VHS bulletin board. The Historian will keep a scrapbook of newspaper articles and class accomplishments. Additionally they will contribute to the end of the year video.

Article VI, Classes; Section I. OFFICERS

  1. The elected class officer shall be the Governor. The Lt. Governor, Secretary, and Treasurer will be appointed offices and shall be appointed by the Class Governor and members of the Cabinet.
  2. The Governor shall be the only class officer with full Cabinet voting privileges.

Article VI, Classes Section II. COUNCILS

All classes shall be considered states and be governed by the individual class regulations. Voting members shall all be elected officers. Student of each class or state may attend regular meeting with no voting powers.

Article VI, Classes; SectionIII. MEETINGS

  1. Meeting shall be held at the discretion of the Class Governor subject to the approval of the class Advisor(s)
  2. The Governor shall preside over all meeting unless absent, in which case the, the Lt. Governor assumes gubernatorial duties.
  3. Meetings of the Student Government shall be open to interested students and faculty at all times unless Student Government determines by a majority vote, that a meeting should be closed.

Article VII, Duties of Class Officers; Section I.GOVERNOR

The Governor shall be a voting member of the ASB cabinet and in charge of his class function. He shall be expected to attend all cabinet meetings.

Article VII, Duties of Class Officers; Section II. Lt. GOVERNOR

The Lt. Governor shall take the duties of the Governor in case of illness or absence. The Lt. Governor shall help with committees directly related to his class function and duties.

Article VII, Duties of Class Officers; Section III. SECRETARY

The Secretary shall organize and maintain legible and accurate records of all class meetings.

Article VII, Duties of Class Officers; Section IV. TREASURER

The Treasurer, as class controller, must keep accurate records of all class finances under approval of the Governor and the class council.

Article VIII, Reform; Section I. AMENDMENTS

The amendments to this Constitution shall be introduced by the Cabinet. The bill must have passed by a two-thirds majority of all eligible voters. In the events a bill is passed, it shall become part of this constitution only when ratified by the Cabinet and signed by the ASB President.

Article VIII, Reform; Section II. INITIATVE

Amendments to this constitution must be submitted in writing during a regularly scheduled meeting of Student Government or Cabinet. Each proposal may be accepted or received by a simple majority vote of the Student Government Class or Student Cabinet. Upon fulfillment of these requirements the Cabinet must discuss and act on the initiative within two weeks.
Article VIII, Reform; Section III. REFERENDUM

If the Cabinet is presented with a petition signed by ten percent of the Student Body referendum of any action taken by the Cabinet, the Cabinet must call a special general electionin ASB within two weeks. The election shall be by secret ballot and the balloting will decide the referendum presented by the petition. A majority vote of the Associated Student Body is necessary to remove and approve a referendum action taken by the Cabinet.
Article IX. Activities Council; Section I. MEETINGS

A. Activities Council meetings will be held once a month.
B. Representation is limited to one member of each chartered club or organization, plus any ASB Cabinet member.
C. The Activities Chairperson in conjunction with the Activities Director shall make all decisions concerning scheduling and granting of activities.

Article IX. Activities Council; Section II. Clubs/Organizations

A. A charter containing a list of officers, name of advisors, a list of members, a statement of purpose and goals, and a statement of how the organization will be beneficial to Valley High School must be submitted to the Activities Chairperson who in turn submits the charter to the Cabinet. All clubs/organizations must be approved by the Cabinet. The charter must be approved prior to the second Activities Council meeting.
B. Any club or organization which does not submit a charter for approval will not be a recognized student body affiliate of Valley High School and will forfeit all resulting privileges.
