CONDITIONS
This Equivalency Certificate authorizes Orica Canada Inc., to handle, offer for transport or transport, by highway tank on a railway flat car, dangerous goods that are UN0332, EXPLOSIVE, BLASTING, TYPE E, Class 1.5D, Packing Group II, in a manner that does not comply with Section 1.8 of the Transportation of Dangerous Goods Regulations and clause10.10.1 of TP14877E, “Containers for Transport of Dangerous Goods by Rail, a Transport Canada Standard”, December 2013, incorporated by reference in subparagraph5.14(1)(b)(ii) of the Transportation of Dangerous Goods Regulations, if:
(a) the highway tank is selected and used in accordance with the requirements of the standard CGSB-43.151-2012, “Packaging, handling, offering for transport and transport of Explosives (Class 1)”, October 2012;
(b) the highway tank is tied down to the railway flat car in accordance with the requirements of the AAR Open Top Loading Rules Manual, following the rules applicable to “Four or six wheel truck or other motor vehicle” for the tractor and to “Trailer, all types” for the trailer. Further, the front part of the trailer chassis must be tied down to the floor of the flat car, and the bumpers and landing gear must not be used as points of attachment for securing the vehicle;

CONDITIONS
(c) before the person responsible for the road transport of the dangerous goods releases the highway tank to the rail carrier, that person inspects the attachment points of the tank to the truck or trailer frame to detect any condition that may compromise the integrity of the securement of the tank to the frame, to ensure that the highway tank has all valves and closures, at the exclusion of the pressure-relief device, securely closed and capped as applicable, and reports the results of this inspection and this verification to the rail carrier;
(d) the railway vehicle on which the highway tank is transported is separated by at least one railway vehicle from a railway vehicle for which a placard is required to be displayed in accordance with Part 4 of the Transportation of Dangerous Goods Regulations, is separated by at least one railway vehicle from the locomotive and is located at the tail end or as close as possible to the tail end of the train and behind any loaded railway vehicle;
(e) the railway flat car carrying the loaded highway tank is equipped on each of its draft sills with an end of car cushioning device meeting the requirements of the Association of American Railroads (AAR) standards M921B or M921E;
(f) the highway tank used for explosives is licensed as a Mobile Processing Unit (MPU) by the Explosives Regulatory Division (ERD) of Natural Resources Canada;
(g) the railway vehicle and highway tank contain a net explosives quantity of explosives that is less than or equal to 20 000 kg;
(h) the transportation is performed on the railway line running between HavreStPierre and the Lake Tio mining operation;
(i) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

CONDITIONS
(j) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:
“Equivalency Certificate No. SR 11115 (Ren. 2)”
Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note
This Equivalency Certificate authorizes the certificate holder to transport explosives in highway tanks on a railway vehicle. The products transported are essential to the running of the mine located at Lake Tio. The site is only accessible by rail. The railway is not connected to the North American system, but is confined to the Havre-St-Pierre - Lake Tio line, which crosses through a very sparsely populated area. The conditions of this certificate include: the use of modern highway tanks equipped with sturdy valves and closings and flat cars equipped with special devices to reduce the forces resulting from impacts with the car couplings; requirements respecting tiedown of tanks to cars; and some train make-up requirements to limit the risks to which the railway’s employees, the environment and the general public are exposed. This certificate meets a specific transportation need while ensuring an equivalent level of safety.
The Transportation of Dangerous Goods Directorate has revised its policy on the handling, offering for transport and transport of dangerous goods by highway tank on railway flat cars. In the past, Equivalency Certificates have been issued to authorize the use of highway tank on railway flat cars in the event that there were no means of containment specifications available to safely transport the dangerous goods by rail. Over the years, the Transportation of Dangerous Goods Regulations have been updated and now include various means of containment options for the transport of explosives by rail.

It has been determined that after November 30, 2018, the use of highway tanks on railway flat cars to transport explosives will no longer be authorized. Users will have to consider replacing their highway tanks with means of containment specifications authorized by the Transportation of Dangerous Goods Regulations for the transport of explosives by rail.
This Equivalency Certificate will not be renewed for the transport of explosives by highway tanks on railway flat cars beyond November30,2018.
