The Cypress-Fairbanks Independent School District Board of Trustees establishes special terms and conditions for fund raising events that are defined in its policy GKD (LOCAL) as Craft Shows/Third-Party Vendors, as follows:

TERMS AND CONDITIONS:

 The event must be organized and supervised by the organization officers and volunteers.

 Organizations must obtain the school principal's approval for the event. This application must be signed by the principal and returned to the Facilities Use and Records Manager for final approval.

 The organization will be charged for the following (All rates are subject to change):

1. Vendor Insurance$150 per event

2. Facility Fee (includes 2 custodians)$80/hr (4-Hour Minimum)

3. Security (if requested)$30/hr. per officer (4-Hour Minimum)

The organization will be responsible for any costs incurred resulting from requests for special accommodations, i.e. special electrical panels, extra staffing, etc.

 The organization will contact vendors and charge a fee for booth space for vendors to display and sell their products.

 The vendors will sell their products and retain the revenue. They are responsible for setting up displays prior to the craft show event and removing all displays and debris at the end of the event the same day. They are solely responsible for the products they sell.

 Food vendors must meet sanitation guidelines as required by the Harris County Health Department. It is the responsibility of the vendor to contact the County to obtain updated guidelines.

 The organization must comply with District guidelines pertaining to facilities use.

LIABILITY:

 In providing District facilities for third-party vendor craft shows, the District is taking the position of leasing these facilities to the parent-support organization. For this reason, the organization becomes the liable party just as any other organization in our community leasing our facilities. Therefore, the organization must pay for appropriate liability insurance which is held specifically for this purpose by the district.

 When the District holds a "school sponsored" activity, we enjoy immunity from liability. However, since this event is sponsored by a parent-support organization, the organization does not enjoy the same immunity. Since the District is not a party to this function, the organization sponsors and

volunteer students and parents are hereby informed that they may be found to be individually liable for any harm or injury that occurs during the event. (Further clarification on page 2.)

The Cypress-Fairbanks I.S.D. has requested our attorney to submit a legal opinion regarding the liability of District approved parent-support organizations when holding a third-party vendor craft show. In that regard, the following is our attorney's legal opinion:

"While the District may be granted immunity against negligence or other torts, it is important

to note that the individual students, parent sponsors, or organization as a whole would not enjoy

the same shield. In other words, the injured party could seek damages against the students,

group, and parents individually. Similarly, if a vendor chooses to sue based on his/her agree-

ment with the students, parents, or organization, the District should not be liable because it is not

a party to the agreement. However, the individual students (depending on their ages), parents,

or the organization might be liable for any such claims. Based on these possibilities, it may be

in the District's best interests to advise its students and parents of these risks."

As representative of the District Organization, I hereby acknowledge, by my signature, that organization sponsors, students and parent volunteers have been informed of said potential liability.
