RESPONDENT (The person against whom claims are addressed, i.e. the other party)

PETITION

State here the judgment you seek from the court, e.g. that the respondent should pay a certain price for a purchase, deliver a certain product, pay a certain amount in outstanding wages, pay a certain amount in compensation for, for example, loss of income from employment or damaged clothing.

State here also whether you want the respondent to pay your legal expenses and if so the amount you claim.

BACKGROUND TO THE PETITION

Give an account here of the circumstances underlying the dispute and describe what the disagreement between you and the opposite party concerns and state also how you expect the respondent to respond to the petition.

HEARING SOUGHT ETC.

State here whether you consider that the case can be settled in writing or after court proceedings.

EVIDENCE

State here the evidence (e.g. witness evidence or written evidence) that you wish to present in the course of the proceedings and what you wish to show with each item of evidence.

If you have consulted the National Board for Consumer Complaints you should send a copy of any report issued by the Board.

Copies of written agreements, e.g. hire-purchase agreements, receipts and other documents should also be appended.

Concerning witnesses whom you wish the court to hear, state name, personal identity number and postal address and, where applicable, any other address where the witness may be found for service by a process server. If known you should also include details of the occupation and address and home and work telephone number of the witness.
