Chairman Jernigan called the meeting to order at 5:30 P.M. The first agenda item was called.

Marlene Koschalk; Setback Variances for Decks; Front and Rear; Two to Three Feet Encroachment; 112 Moccasin Hollow Road

The applicant had been before the BZA on another issue in previous months. She was told that any decks would have to meet the setbacks. A front deck was currently in violation and she was told to shorten the deck to meet the requirements. Then she built a second deck on the back of her house, also in the setbacks. Her representative, Al Koonz, requested a variance for both decks. The BZA replied that she had been warned to comply and yet she made the situation worse. Cox made a motion to deny the variance requests and Estepp second. It was denied as there was no topographical reason, no unusual circumstances and the applicant was warned to comply and committed the violation anyway. The denial was approved.

Bernie and Kim Jones; Replacement of a Mobile Home; 1172 Cove Lane; Grandfathered Lot

The couple has an existing mobile home on a lot that does not conform to current requirements. They requested to replace the single-wide with a newer one. Cox made a motion to approve and Estepp second. It was approved.

Daniel and Melissa Sims; 135 Old Andersonville Pike; Non-conforming Property; Request to Place Mobile Home on an Easement

There was a question as to the legality of the original plat showing this property on an easement. Sufficient tracking could not be done to prove or disprove that this was an illegally platted lot. The illegal plat would not have been done by this couple. Cox made a motion to approve contingent on no further subdivision be allowed. White seconded the motion. It was approved.

Jack Ramsey; 123 Stone Point Lane; Request to Build Garage on Non-conforming Lot

The property already has a house. The proposed garage can meet all setbacks and will be used for personal possessions – vehicles, household goods. Cox made a motion to approve and Estepp seconded. It was approved.

Invenergy Inc.; Buffalo Mountain; Setback Variances to Fall Zone for Wind Mills

This item had been removed at the company’s request.

New Business

Ted Hercutt & Anita Bernier; 350 Bacon Springs Rd; Variance to use Easement as Right-of-Way.

Mike Cox made the motion to approve the variance. Estepp seconded the motion. The motion was approved.
