AN ACT relating to health and family services.
Be it enacted by the General Assembly of the Commonwealth of Kentucky:
SECTION 1. A NEW SECTION OF KRS CHAPTER 194A IS CREATED TO READ AS FOLLOWS:
(1)The Cabinet for Health and Family Services shall establish a data warehouse to facilitate the integration of data and information relating to the cabinet's functions. The data warehouse shall:
(a)Link together and consolidate data and information from Medicaid, public assistance, disability determination, child support enforcement, child protection, public health, mental health, and other cabinet agencies and divisions within the cabinet;
(b)Include data to conduct surveillance, utilization review, and cost analyses; and
(c)Minimize duplication and fragmentation within the data warehouse configuration.
(2)The data warehouse established in subsection (1) of this section shall be implemented no later than July 1, 2013. During the year prior to full implementation, the cabinet shall provide quarterly reports on the establishment of the data warehouse to the Governor and the Legislative Research Commission. Beginning September 1, 2013, the cabinet shall provide an annual report by September 1 of each year to the Governor and the Legislative Research Commission that includes:
(a)Information on the type of data included in the data warehouse;
(b)The representation of the different cabinet functions among the data in the data warehouse; and
(c)Analyses conducted using the information and data in the data warehouse.
SECTION 2. A NEW SECTION OF KRS CHAPTER 205 IS CREATED TO READ AS FOLLOWS:
(1)A face-to-face interview shall be required for a new applicant for Medicaid benefits.
(2)A face-to-face interview shall be required for a Medicaid recipient who seeks to renew eligibility for continued receipt of Medicaid benefits.
(3)A face-to-face interview shall not be required for incapacitated or institutionalized applicants or incapacitated or institutionalized Medicaid recipients who do not require an in-person update of current assets.
SECTION 3. A NEW SECTION OF KRS CHAPTER 205 IS CREATED TO READ AS FOLLOWS:
The Department for Medicaid Services shall develop and implement a method to detect and record all income and resources for determining eligibility for Medicaid benefits. Efforts shall be placed on strengthening the method for incorporating unreported income and resources in the final determination of eligibility for Medicaid benefits and providing methods for estimating such income and resources.
