1 Name
This instrument is the Variation to Licence Area – Toowoomba/Warwick(Radio) – 2016 (No.1).
2 Commencement
This instrument commences at the start of the day after it is registered.

3 Variation
The Licence Area Plan – Toowoomba/Warwick(Radio) – November 1998(F2005B00920), is varied as follows:
(a)rename the instrument as “Licence Area Plan – Toowoomba/WarwickRadio”;
(b)amend the heading on the title page so that it reads “Licence Area Plan – Toowoomba/Warwick Radio”;
(c)on the first page of the instrument:
(i)amend the heading so that it reads “Licence Area Plan – Toowoomba/Warwick Radio”; and
(ii)number the paragraphs as clauses (1)- (7);
(d)omit clauses (1)- (7) and substitute the following clauses:
“(1)This plan for broadcasting services in the Toowoomba/Warwick area of Western Australia is made under subsection 26(1) of the Broadcasting Services Act 1992.
(2) Five national radio broadcasting services are to be available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 – 1.6 to this plan.
(3) Four commercial radio broadcasting services are to be made available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments1.7 – 1.19 to this plan.
(4)Sixopen narrowcasting radio broadcasting servicesare to be made available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments1.20 – 1.25 to this plan.
(5)One community radio broadcasting service is to be made available in the area described at Attachment 2.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachment 2.2 to this plan.
(6)Two community radio broadcasting servicesare to be made available in the Toowoomba area described at Attachment 3.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachments3.2 – 3.3 to this plan.
(7)One community radio broadcasting service is to be made available in the Warwick area described at Attachment 4.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachment 4.2 to this plan.
(8)A reference in this plan to a schedule or an attachment includes reference to a schedule or attachment from time to time.”;
(e)immediately before Schedule One:
(i)omit the heading “SCHEDULES”;
(ii)omit the words “Each of the Schedules sets out:” and all eight paragraphs marked with dots points that follow;
(iii) omit the heading “Status Column” and the five lines of text directly following; and
(iv) omit the heading “Frequency Column” and the paragraph marked with a dot point that follows;
(f)omit all Schedules and substitute all Schedules to this instrument; and
(g)omit all Attachments and substitute all Attachments of this instrument.
