FOLLOWING AMENDMENTS ARE MADE TO THE REFERRED USAID NEGOTIATED PROCUREMENT :

TENDER CLAUSE:

A) REF : CHAD EMOP FOR UP TO 33,700 MT PLUS EMPTY BAGS. FOR DISCHARGE:

LAS PALMAS – UP TO 18,700 MT – REF AC-12-0027

AND / OR

DOUALA – UP TO 18,700 MT – REF AC-12-0027

AND

PORT SUDAN – UP TO 15,000 MT – REF AC-12-0028

ABOVE IS THE CURRENT INTENDED BREAKDOWN, HOWEVER CHARTERER/RECEIVER RESERVES THE RIGHT TO MAKE CHANGES ON QUANTITIES TO EACH OF THE DISCHARGE PORTS.

B) CARGO: SORGHUM IN BULK PLUS EMPTY BAGS. .

- EMPTY BAGS TO BE TRANSPORTED FREIGHT FREE ON THE SAME VESSEL AS CARGO CARRIED.

- EMPTY BAGS DELIVERY: SEE PROFORMA CHARTER PARTY CLAUSE 51 FOR FULL DETAILS OF THE REQUIREMENT.

- CONTRACTED QUANTITIES WILL BE ON A MIN/MAX BASIS.

- ANY PART CARGO(ES) ARE SUBJECT TO CHARTERER'S APPROVAL AND A.I.D. PROFORMA

CLAUSE 1 (C)

-EVALUATION: DUE TO THE URGENCY OF THIS CARGO THE GOVERNMENT WILL EVALUATE AND AWARD CONTRACT(S) TO THE RESPONSIBLE OFFEROR(S) THAT WILL PROVIDE THE BEST VALUE TO THE GOVERNMENT. BEST VALUE SHALL BE DEFINED IN THIS PROCUREMENT

ON THE FOLLOWING CRITERIA:

- 50 PERCENT ON THE TOTAL PRICE OF COMMODITY AND FREIGHT DELIVERED TO DESTINATION.

- 50 PERCENT ON THE BEST DELIVERY SCHEDULE THAT MEETS THE GOVERNMENT’S REQUIREMENTS FOR EARLIEST DELIVERY TO THE FIRST PORT OF DISCHARGE OF LAS PALMAS OR DOUALA OR PORT SUDAN. DUE TO PROGRAMMATIC REQUIREMENTS USAID / RECEIVERS RETAIN THE RIGHT OF DISCHARGE PORT ROTATION.. THE EVALUATION SHALL BE BASED UPON THE OFFERED VESSEL’S CURRENT POSITION; ETA LOAD PORT AND READINESS TO LOAD; VESSEL SPEED AND TRANSIT TIME TO THE FIRST DISCHARGE PORT OF LAS PALMAS, CANARY ISLANDS OR DOUALA OR PORT SUDAN, SUDAN..

(A) 1 OR TWO SAFE BERTHS LAS PALMAS CANARY ISLANDS, BASIS

(I) FREE OUT. CARGO SHALL BE DISCHARGED BY RECEIVER FREE OF RISK AND EXPENSE TO OWNER DIRECTLY INTO THE DISCHARGE PORT SILO(S) UTILIZING SILO DISCHARGE EQUIPMENT ONLY.

OR CHARTERER OPTION

(II)BERTH TERMS DISCHARGE WITH OWNER TO HAVE CARGO BAGGED AND STACKED ON TO RECEIVERS’ CONVEYANCES AT END OF BAGGING LINE

OR CHARTERER OPTION

(III)BERTH TERMS DISCHARGE WITH OWNER TO HAVE CARGO BAGGED AND STACKED INTO PORT WAREHOUSE.

AND/OR CHARTERER’S OPTION

(B) 1 OR 2 SAFE BERTHS PORT SUDAN, SUDAN , BASIS

(I)FREE OUT OR CHARTERER OPTION

(II)BERTH TERMS DISCHARGE WITH OWNER TO HAVE CARGO BAGGED AND STACKED ON TO RECEIVERS’ CONVEYANCES AT END OF BAGGING LINE OR CHARTERER OPTION

(III) BERTH TERMS DISCHARGE WITH OWNER TO HAVE CARGO BAGGED AND STACKED INTO PORT WAREHOUSE.

(C) 1 OR 2 SAFE BERTHS DOUAL, CAMEROONS

(I)FREE OUT OR CHARTERER OPTION

(II)BERTH TERMS DISCHARGE WITH OWNER TO HAVE CARGO BAGGED AND STACKED ON TO RECEIVERS’ CONVEYANCES AT END OF BAGGING LINE OR CHARTERER OPTION

(III) BERTH TERMS DISCHARGE WITH OWNER TO HAVE CARGO BAGGED AND STACKED INTO PORT WAREHOUSE

DISCHARGE PORT ROTATION AT CHARTERER’S OPTION DECLARABLE UPON FIXING.

(I) AT LAS PALMAS , CANARY ISLANDS :

(a) FREE OUT DISCHARGE PER WFP CHARTER “WORLDFOOD99” PARTY TERMS (CLAUSES 8 AND 9 ON DISCHARGING) AT THE DISCHARGE RATE OF

- 8,500 MT PER WEATHER WORKING DAY OR CHARTERER OPTION

- 6,000 MT PER WEATHER WORKING DAY OR CHARTERER OPTION

- 4,000 MT PER WEATHER WORKING DAY

CARGO SHALL BE DISCHARGED BY RECEIVER FREE OF RISK AND EXPENSE TO OWNER DIRECTLY INTO THE DISCHARGE PORT SILO(S) UTILIZING SILO DISCHARGE EQUIPMENT ONLY.

(c) FULL BERTH TERMS. NO DEMURRAGE/NO DESPATCH/NO DETENTION. WITH OWNER TO BAG AND STACK THE CARGO ON TO THE RECEIVER’S CONVEYANCES AT END OF BAGGING LINE.

(II) AT PORT SUDAN , SUDAN :

(a) FREE OUT DISCHARGE PER WFP CHARTER “WORLDFOOD99” PARTY TERMS (CLAUSES 8 AND 9 ON DISCHARGING) AT THE DISCHARE RATE OF

- 8,500 MT PER WEATHER WORKING DAY OR CHARTERER OPTION

- 3,500 MT PER WEATHER WORKING DAY OR CHARTERER OPTION

- FOR TANKERS 4,000 MT PER WEATHER WORKING DAY PER MINIMUM HATCH OPENING DIAMETER OF 500 MM , OTHERWISE AS PER WFP CHARTER PARTY, INCLUDING BERTHING CLAUSE.

OR AT CHARTERER OPTION

(b) FULL BERTH TERMS. NO DEMURRAGE/NO DESPATCH/NO DETENTION. WITH OWNER TO BAG AND STACK THE CARGO INTO THE PORT WAREHOUSE

(c) FULL BERTH TERMS. NO DEMURRAGE/NO DESPATCH/NO DETENTION. WITH OWNER TO BAG AND STACK THE CARGO ON TO THE RECEIVER’S CONVEYANCES AT END OF BAGGING LINE.

(III) AT DOUALA, CAMEROON :

(a) FREE OUT DISCHARGE PER WFP CHARTER “WORLDFOOD99” PARTY TERMS (CLAUSES 8 AND 9 ON DISCHARGING) AT THE DISCHARGE RATE OF

- 1,500 MT PER WEATHER WORKING DAY OR CHARTERER OPTION

OR AT CHARTERER OPTION

(b) FULL BERTH TERMS. NO DEMURRAGE/NO DESPATCH/NO DETENTION. WITH OWNER TO BAG AND STACK THE CARGO INTO THE PORT WAREHOUSE

(c) FULL BERTH TERMS. NO DEMURRAGE/NO DESPATCH/NO DETENTION. WITH OWNER TO BAG AND STACK THE CARGO ON TO THE RECEIVER’S CONVEYANCES AT END OF BAGGING LINE.

NB: OTHERWISE FREE OUT DISCHARGE TERMS SHALL BE IN ACCORANCE WITH THE WFP CHARTER PARTY “WORLDFOOD99”

WITH CLAUSES 8 AND 9 APPLYING ON THE DISCHARGING TERMS FOR NOTICE OF READINESS ; TIME COUNTING AND EXCEPTED PERIODS. LAYTIME ACCOUNTS ARE TO BE SETTLED DIRECTLY BETWEEN OWNERS AND

RECEIVER , WFP , AT DISCHARGE PORT AND SHALL BE CALCULATED IN ACCORANCE WITH WFP “WORLDFOOD99” CHARTER PARTY.

(III) BAGGING SERVICES AT DISCHARGE PORT BASIS BAGGED AND STACKED INTO

RECEIVERS’ PORT WAREHOUSE.

(IV) FREE OUT DISCHARGE BASIS , DISCHARGE RATE OF (a) 8,500 MT PWWD ; (b) 6,000 MT PWWD AND ( c) 4,000 MT PWWD.

PORT SUDAN DISCHARGE BASIS: -

(I) OCEAN TRANSPORTATION INCLUDING BULK DISCHARGE (FULL BERTH TERMS)

(II) BAGGING SERVICES AT DISCHARGE PORT BASIS BAGGED AND STACKED ONTO

RECEIVERS’ CONVEYANCES AT END OF BAGGING LINE..

RECEIVERS’ PORT WAREHOUSE.

(II) BAGGING SERVICES AT DISCHARGE PORT BASIS BAGGED AND STACKED ONTO

RECEIVERS’ CONVEYANCES AT END OF BAGGING LINE..

(III) BAGGING SERVICES AT DISCHARGE PORT BASIS BAGGED AND STACKED INTO

RECEIVERS’ PORT WAREHOUSE.

(IV) FREE OUT DISCHARGE BASIS , DISCHARGE RATE OF 1,500 MT PWWD.

OFFERORS MAY SUBMIT FREIGHT RATES BASIS DISCHARGE PORT ROTATION OF LAS PALMAS OR DOUALA AND THEN PORT SUDAN OR PORT SUDAN FIRST DISCHARGE PORT AND THEN LAS PALMAS OR DOUALA.
