RESOLUTIONS (SUBMITTED TO AICEGEO) TO BE TAKEN UP FOR DISCUSSION IN THE KOLKATA AEC MEETING

ON 24.1.2009 AND 25.1.2009

1. To oppose restructuring of the Department for which proposals are being sought currently by the three study groups for the reason that the whole exercise is only to address the stagnation problems of officers in the grade of Addl. Commissioner and to bring into main stream the posts of Commissioner (Appeals) (54 posts) created during the Cadre Restructure of 2002. It may be recalled that 180 posts of ADCs’ posts created during CR of 2002. were filled up from amongst the persons in DC cadre by keeping them as JC’s for few months. Any restructuring exercise conducted without increase in lower level posts will not be meaningful and more specifically in our case the exercise will be futile till our demand for entry into Group A atleast for persons who entered Group B pre October 96. The date that is made available is used one every occasion to create further career avenues for senior officers thereby incentivising aggressive promotions for those who already have faster career progression and punishing people who stagnate. Any further restructuring that involves surrender of posts at lower level to create progression at higher level will have to be opposed in view of non-change in the duties of Inspectors & Superintendents and the hierarchical system in which we operate.

2. LTU to be opposed in view of the threat it poses to the career of officers and the survival of the Department.

As at today the four LTU’s Chennai, Bangalore, Mumbai and Delhi are expected to generate a revenue of Rs.30,000 crores this fiscal. If four LTU’s with a fractional participation of Industries who are eligible to join LTU generate a revenue of Rs. 30,000 crore (out of a total revenue of Rs.1,00,000 crore accruing as Central Excise Duties ) the scenario could well be imagined when the other LTU’s proposed start functioning and more number of units join the four existing LTU’s. More than 80% of Revenue will be generated by LTU’s with a strength of 7.5% of the entire staff strength of the department. This will make the survival of a majority of Commissionerates redundant and render the staff surplus. If the trend continues in about two years time (when the other LTU’s proposed are created and National GST comes into force) a major section of the staff will have to be either redeployed or have to be sent out on VRS after keeping them in surplus pool for about an year.

3. GUEST HOUSES: The Administrator / Care taker of the Guest Houses are being prevented from accommodating non-IRS officers. The complete list of Guest Houses, availability of the accommodation, the contact person etc., should be published in the CBEC website and the allocation should be made more transparent as Guest Houses are constructed and funded by the governing body of Customs and Central Excise Welfare Fund common to all.

4. Abolition of Central Government Health Scheme (CGHS) contemplated every now and then by the Government has to be opposed by taking up the cause relentlessly and joining in the agitations of umbrella organization(s) of Central Government Employees.

5. Prescribed and Published Duty list for Range Officers / Sector Officers

No duty has been prescribed for Group A Officers and for Superintendents / Inspectors in Hqrs. Office as any such prescription will adversely effect the original work of JC’s / ADC’s / Commissioners (Adjudication / Review / Legal etc.,) currently done on their behalf by Superintendents and Inspectors and make them accountable. A detailed discussion may please be allowed on this.
