AGREEMENT AND ACKNOWLEDGEMENT OF RECEIPT OF EMPLOYEE HANDBOOK

For good and valuable consideration, the adequacy and receipt of which is hereby acknowledged, the undersigned hereby agrees as follows:

RELEASE: (INSERT DEALERSHIP NAME). hereinafter referred to as Company and its subsidiaries have my permission to use my name, picture or likeness for any advertising, publicity or other legitimate business purpose which it deems advisable now or later, regardless of whether I am employed by the Company at the time of use. I give my permission in consideration of my at will employment for an indefinite term. I agree that use of my name picture or likeness will not result in an invasion of my privacy or in a violation of any property right that I might have. I understand that I will receive no additional consideration if my name, picture or likeness is used. I also agree that any negatives, prints or other material for printing or reproduction in connection with the use of my name, picture or likeness will be the sole property of the Company.

EMPLOYEE HANDBOOK: One (INSERT DEALERSHIP NAME). Employee Handbook, serial Number ______, Rev. 2009 has been received by me, this day. I agree to read this Employee Handbook promptly, after which, I agree to immediately ask my manager to explain to me any part of this Employee Handbook which I do not fully understand.

I understand that this Employee Handbook remains the property of the Company and I agree that upon the termination of my employment with the Company, I will return the handbook or pay its replacement cost.

CASH REPORTING AND MONEY LAUNDERING: I agree to never discuss cash reporting laws with customers or prospective customers, but instead to refer persons with such questions to Company management. I agree to never structure payments so as to avoid cash reporting requirements. I agree to never accept from a customer any money I know was derived from an illegal source. I understand that it is the Company policy to never accept funds from illegal sources, to fully comply with cash reporting laws, to not permit structuring of payments to evade such laws and that the violation of this policy may result in a felony conviction and/or disciplinary action up to and including dismissal.

OTHER PROVISIONS: I have had the duties of the position which I have accepted explained to me and I understand the requirements of the position. I further certify that I am qualified and capable of performing these duties. I understand that violation of any of the policies as set forth in the Employee Handbook is reason for disciplinary action up to and including termination of my employment, and I acknowledge that I have been duly informed regarding infractions and subsequent action that may result from such infractions.

Furthermore, I understand that the Company reserves the right to change, interpret, withdraw or add the policies, benefits or terms and conditions of employment, at its sole discretion and without prior notice, consideration or approval by any employee or employee group or representative. It is my responsibility to review bulletin boards or attend meetings where such changes would be posted or announced.

I authorize deductions from my paychecks for uniforms, group insurance premiums, indebtedness to the Company and the value of any tools, equipment or other property assigned to me which I fail to return.

I understand an agree that neither the text in this Employee Handbook nor that of any other policy or procedure statement of the Company is intended to, nor should they be construed to create a covenant or a contract between myself and the Company, either express or implied; and that no agreement shall be binding on Company unless it is specific as to all material terms and signed by an officer of the Company. The Company does not guarantee anyone employment for any specific duration or for any specific hours per week. I understand that employment with the Company is at-will for an indefinite period unless terminated by myself or by the Company. I also understand that employees hired by this Company may voluntarily leave employment upon proper notice and may be terminated by the employer at any time and for any reason.

I agree not to Institute legal action against the Company until and unless I have exhausted all administrative remedies with the Company.

The understanding stated herein above cannot be changed except in writing as authorized by Company and acknowledged by me.
