- Approval of Minutes
The Commission deferred acting on the minutes of the July 20, 2015, Regular Meeting of the City Planning Commission as only two of the Commission members present for tonight’s meeting were present at the July 20th meeting.

Special Permit-Motor Vehicle Storage and Impoundment Yard

Mr. Todd O’Connor, of 65 Arthur St, LLC, at P.O. Box 8, Camillus, New York, spoke to the Commission about the proposal, which consists of establishing a motor vehicle storage and impound yard on property situated at 101 Rusin Avenue and 401 and 403 State Fair Boulevard.
No one spoke in favor of or in opposition to the proposal.
After further discussion and review, whereupon the Commission reviewed comments received from the Department of Public Works with the applicant, Ms. Christine Capella-Peters made a motion to approve the request with a negative SEQRA declaration and with the condition that the applicant install sidewalks as required by the Department of Public Works. Ms. Linda Henley seconded the motion. The motion passed unanimously.

Divide One Property into Two New Lots

Mr. Louis Fournier, President of the Bentham Foundation at 525 Plum Street, spoke on behalf of the owner to the Commission about the proposal, which consists of dividing one property situated at 101 Harbor Street into two new Lots in order to establish a parking lot to assist in facilitating the redevelopment and historic preservation of 710 Emerson Avenue.
No one spoke in favor of or in opposition to the proposal. One person commented on the proposal with respect to snow removal.
After further discussion and review, Ms. Linda Henley made a motion to approve the request with a negative SEQRA declaration. Ms. Christine Capella-Peters seconded the motion. The motion passed unanimously.

Combine Three Properties into One New Lot

Mr. Pete King, of King and King Architects at 358 West Jefferson Street, spoke to the Commission about the proposal, which consists of combining three properties situated at 347-351 West Jefferson Street and 401-411 and 413-419 South West Street into one new Lot to facilitate the construction of a solar panel array over an existing parking lot.
No one spoke in favor of or in opposition to the proposal.
After further discussion and review, Ms. Linda Henley made a motion to approve the request with a negative SEQRA declaration. Ms. Christine Capella-Peters seconded the motion. The motion passed unanimously.

Ms. Christine Capella-Peters seconded the motion. The motion passed unanimously.

Ms. Linda Henley seconded the motion. The motion passed unanimously.

After discussion and review, Ms. Linda Henley made a motion to approve the request with a negative SEQRA declaration and with the condition that the mounting brackets for the awnings shall be attached to the wall of the building through existing mortar joints so as not to damage the existing brick. Ms. Christine Capella-Peters seconded the motion. The motion passed unanimously.

Ms. Meghan McLees Craner, Assistant Corporation Counsel, spoke to the Commission about the results of a judgment pursuant to Article 78 of the Civil Practice Law and Rules of the State of New York, wherein the Honorable Anthony J. Paris found for the petitioner, annulled the Commission’s April 27, 2015 denial, and directed the Commission to grant the petitioner’s application with a waiver of required parking, with the condition of limiting the number of parking spaces for the petitioner’s residents to three.
Ms. Christine Capella-Peters made a motion to annul the Commission’s denial without prejudice of April 27, 2015. Ms. Linda Henley seconded the motion. The motion passed unanimously.
Ms. Christine Capella-Peters made a motion to approve the request as ordered by the Honorable Anthony J. Paris, with the condition of limiting the number of parking spaces for the residents to three. Ms. Linda Henley seconded the motion. The motion passed unanimously.

Ms. Linda Henley made a motion to authorize those cases listed for Public Hearings on Monday, August 31, 2015. Ms. Christine Capella-Peters seconded the motion. The motion passed unanimously.
