After Consideration the Following Was Agreed Upon

MARCH 25, 1959

Orem City Council met in Special Session Wednesday, March 25, 1959 at 1:00 P.M. in Orem City Hall. Present were Mayor V. Emil Hansen, Chairman; Councilmen Merlin Manning, Elwood Baxter, Winston Crawford, Earl Wengreen, and Alvin Rowley; City Manager O. V. Farnsworth, Engineer L. V. Beckman and Recorder, Anne Cooper.

The Special Meeting was called to consider an agreement, concerning improvementof the Curtis irrigation ditch, 1200 South Street from U. S. 91 westerly to 100 East Street, between the Curtis Ditch Owners and Orem City.

After consideration the following was agreed upon:

This agreement entered into this 30thday of March 1959 between Orem City Corporation hereinafter called the City and the owners of Curtis Ditch as follows:

Reservoir Water

Emma Chittock hereinafter called the Ditch owners.

NOW THEREFORE in consideration of the sum of $1.00 and the mutual promises of the parties hereto and other good and valuable consideration, it is mutually covenanted and agreed as follows:

WHEREAS: The Ditch Owners intend to cement the present ditch from U. S. Highway No. 91 westerly to approximately 100 East Street on 1200 South, Orem, Utah. The purpose of cementing the ditchis to conserve water and improve the present street in this proximity.

WHEREAS: The City being concerned with this project feels an obligation towards this improvement for the following reasons:

(1) The Conservation of water that escapes through cuts made in the road by Water and Sewer Connections.

(2) The Elimination of an unsightly condition as presented by the present ditch and the improvement of the street width.

WHEREAS: In order to rectify the above conditions the City agrees to cooperate with the Ditch Owners as follows:

(1) The City agrees to push over trees and remove stumps, only.

(2) The City agrees to provide approximately 300 cu yards of backfill Material and level off the same where required

WHEREAS: The Ditch Owners agree as follows:

(1) The Ditch Owners agree that the alignment of the cemented ditch be in accordance with City Planning.

(2) The Ditch Owners agree to obtain all rights of way and written permission from all adjacent property owners allowing the City to execute their part of the work.

(3) The Ditch Owners agree to assume all responsibilities incurred during construction including property damage, injuries or deaths, and that the City Shall not be involved in any litigations concerning the above situations, and the Ditch Owners will save the City harm from any liability thereon.

(4) The Ditch Owners will be responsible for rough and fine grading of the new construction.

(5) The Ditch Owners will be responsible for cutting up and disposing of trees and material excepting the stumps.

(6) The Ditch Owners will remove and dispose of driveways and headwall structures existing or interfering with the proposed ditch alignment.

(7) The Ditch Owners will furnish all labor and materials involved in the construction of the new cement lined ditch and appurtenances.

(8) The Ditch Owners will replace, restore, or construct new drive or walk way approaches over the ditch at no cost to the City.

(9) That the Ditch Owners agrees to provide temporary access to driveways and approaches during construction operation.
