TERMS AND CONDITIONS

1. Registration Procedure
The official registration form must be completed to order a booth for the Fehmarnbelt Days 2016 (FBD). The signed booking form confirms the exhibitor’s acceptance of these “Terms and Conditions”. The exhibitor must adhere to regulations in the industrial and trade law, particularly those regarding environmental protection, fire prevention, accident prevention and company trademarks. Changes and additions to these terms do not exist; they must be made in writing.

2. Admission
Offers of exclusive items are limited and will be sold according to the ‘first come first served’ principle. The FBD Organizers can refuse applications of individual exhibitors or suppliers, if there are legally justified reasons and, particularly, if there is not sufficient space available. The FBD Organizers may terminate the booking. This applies, in particular, when the exhibition cannot take place on grounds of force majeure or distress and / or when the exhibitor fails to comply with the agreed terms. In case of termination of the booking for reasons not under the responsibility of the FBD Organizers, theyare only obliged to return already received payments to the exhibitor, as far as these were not yet consumed for the preparation of the exhibition. Additional claims and compensation payments are excluded.
Exclusion of competition can neither be a requirement nor prohibited. The conclusion of the contract between the FBD Organizers and the exhibitor is effective once the exhibitor has received confirmation of admission and / or an invoice.
The payment has to be made within a maximum of two weeks after the date of the invoice. The FBD Organizers are entitled to seek an immediate termination of contract if this deadline is not met. In case of negligence or intent, an administration fee of 10% of the stand rental price is to be paid.

3. Withdrawal
If an exhibitor withdraws after the formal booking of exhibition space, 25% of the rental fee are to be paid. If withdrawal is indicated later than 19 July 2016, 50% of the rental fee will be charged, while 85% of the rental fee must be paid if withdrawal is indicated after 19 August 2016.
Withdrawal must be stated in writing. It is only legally effective after the FBDSecretariat has stated its written consent in the name of the FBD Organizers.

4. Terms of Payment
In order to ensure the claim of the booked exhibition space, the fee for the exhibition has to be paid within a maximum delay of two weeks after the date of the invoice. Exhibitors, who have not paid their rental fee before the beginning of the event, can be excluded from the participation. This does not imply the expiration of the received bill.

5. Booth
Booth allocation takes place with regard to the published exhibition plan. In case of multiple orders and special requests, the Fehmarnbelt Days Organizers allocate booths according to particular characteristics, such as e.g. booth size and technical requirements. A booth can only be moved if compelling reasons apply. It must be promptly stated in a written order.

6. Operation of the Booth
Booths need to be set up before the beginning of the official opening (20 September 2016) and they are not allowed to be dismantled before the official end of the exhibition (22 September 2016). Detailed information regarding the booths will be provided sufficiently in advance. The Fehmarnbelt Days Organizers will arrange for the cleaning of passages and public facilities. The cleaning of the booths and disposal of the resulting waste is in the responsibility of the exhibitors. Accordingly, waste should be avoided and refuse is to be disposed of in line with German regulations at the expense of the exhibitor.

7. Liability
The Fehmarnbelt Days Organizers cannot be held responsible for potential damages to exhibition objects and booth equipment or any consequential damages unless in cases of gross negligence and intent.

8. Severability Clause
If a provision of this Agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall affect neither validity or enforceability in that jurisdiction of any other provision of this Agreement northe validity or enforceability in other jurisdictions of that or any other provision of this Agreement. With respect to the provisions found to be invalid or ineffective, an appropriate provision shall be applied that comes closest to what the parties would have wanted if they had considered the matter at the conclusion of this contract.
