Addict to Athlete & AKKA & Crossroads Turning Points & Haven Behavioral Military Heroes Program
PARTICIPANT AGREEMENT, RELEASE AND ACKNOWLEDGEMENT OF RISK
In consideration of the services of Addict to Athlete, AKKA, Crossroads Turning Points & Haven Behavioral Military Heroes Program, their agents, owners, officers, volunteers, participants, employees, students, instructors, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as Addict to Athlete, AKKA, Crossroads Turning Points & Haven Behavioral Military Heroes Program). I hereby agree to release and discharge Addict to Athlete, AKKA, Crossroads Turning Points, & Haven Behavioral Military Heroes Program on behalf of myself, my children, my parents, my heirs, assigns, personal representative, and estate as follows:
1. I acknowledge that exercise entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to me, or my child, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I am fully aware of the risks, including the potential for personal injuries, damages and losses associated with participation in any exercise program; and I assume all risks and accept full responsibility for any injuries, damages or losses which may incur in connection with my decision to exercise my permission to allow my child to participate in this program. I agree for my child, myself, my estate, my heirs, my child’s assigns and my assigns: (a) not to file any suit or initiate any claim procedure against Athlete to Addict, AKKA, Crossroads Turning Points, or Haven Behavioral Military Heroes Program in connection with injuries, damages or losses arising directly or indirectly out of my own or my child’s participation in this program and (b) to fully and forever release and discharge Addict to Athlete, AKKA, Crossroads Turning Points, and Haven Behavioral Military Heroes Program from any and all claims, demands, damages, rights to action, or causes of action in any connected with this program.
ASSUMPTION OF RISK: Participation in Addict to Athlete & AKKA activities involves running, sparring, falling, hitting and being hit, motion, rotation, and physical impact in a unique environment and as such carries with it a reasonable risk assumption.
WARNING: Catastrophic injury, paralysis, or even death can result from improper conduct of this activity. Further, Addict to Athlete, AKKA, Crossroads Turning Points, & Haven Behavioral Military Heroes Program, and its instructors, its employees, and volunteers have difficult jobs to perform. They seek safety, but they are not infallible. They might be ignorant or unaware of a participant’s fitness level or abilities. They may give inadequate warnings or instructions and the equipment being used might malfunction. Regardless, I am aware of these risks and assume responsibility for them.
2. On behalf of myself, and my child, I expressly agree and promise to accept and assume all of the risks existing in this activity. My child’s and my participation in this activity is purely voluntary, and, on behalf of myself and my child, I elect to participate in spite of the risks.
3. On behalf of myself and my child, I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Addict to Athlete, AKKA, Crossroads Turning Points, Haven Behavioral Military Heroes Program from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of Addict to Athlete’s, AKKA, Crossroads Turning Points, & Haven Behavioral Military Heroes Program equipment or facilities, including any such claims which allege negligent acts or omissions of Addict to Athlete or AKKA.
4. Should Addict to Athlete, AKKA, Crossroads Turning Points, & Haven Behavioral Military Heroes Program, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I hereby indemnify and hold them harmless for all such fees and costs.
5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participation, or else I agree to bear the costs of such injury or damage myself. I further certify that neither my child nor I have any medical or physical conditions that could interfere with our safety in this activity, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
By signing this document, I acknowledge that if anyone is hurt of property is damaged during my child’s or my participation in this activity, I may be found by a court of law to have waived my right and my child’s right to maintain a lawsuit against Addict to Athlete, AKKA, Crossroads Turning Points, or Haven Behavioral Military Heroes Program on the basis of any claim from which I have released them herein including negligence or failure to warn. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms. I understand that any pictures, promotions, or television showing and I waive compensation in regard thereof.

PARENT’S/GUARDIAN’S ADDITIONAL INDEMNIFICATION (must be completed for participants under the age of 18)
In consideration of (print minor’s name) (“minor”) being permitted by Addict to Athlete or AKKA to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless Addict to Athlete or AKKA from any and all claims which are brought by, or on behalf of minor, and which are in any way connected with such use or participation by minor.
