Acting Commissioner Kerry Delaney-
Article 16 – satellite clinic implementation pushed back to 4/1/16. DOH is working on IPSS rates.
Transformation Panel- Report to legislature due in mid-February. Revisions to initial recommendations sent to Panel members. Around 1/1/16- recommendations will be made public and there will be a public comment period. It will be a very tight timeframe for input. Final draft will be posted in February. Analysis of public listening sessions and feedback from OPWDD is being worked on right now.
Other legislative reports due from OPWDD- include Front Door, Residential Registry and Integrated Employment. All should be ready by mid- February.
Dixie Yonkers/Maryellen Moeser-
ICF Conversions- State goals were met, but not those from voluntaries. The vast majority were mostly just straight conversions from ICR to IRA- few were downsizings or moves to other types of settings. OPWDD has been slow to come out with fiscal policy surrounding conversions. Many agencies are waiting for rate rationalization that will increase their ICF rates and then they will convert. Currently revising conversion document. They will provide a sample work plan. Still looking at possibility of capital costs for downsizing proposals.
Roger Bearden/Susan Prendergast-
Safe Patient Handling- Roger still working with DOH on applicability of law. They believe it will only apply to Developmental Centers. The original intent was to NOT include small group homes.
AbibaKindo-
MSC agency selection- For non- capable individuals living in ICF’s converting to IRA’s without guardians, advocates or actively involved family- clinical team or residential provider can chose MSC. Initial thoughts that the MSC should not be same agency as residential provider. If the same agency is chosen, need to get approval from DDRO. Helene DeSanto suggested that you need to concentrate on who is making the decision and focus on how they know the individual best. Need to review the 2014 Federal Regs that define Conflict Free Case Management.
Donna Cater-
7/1/15 IRA rates were loaded into the system last week. Should be ready to go by Cycle 2000 or 2001. Should be getting a letter from OPA. You have 90 days to review to see if there was a mathematical error in calculations (such as you had OPTS homes that weren’t included). 7/1/15 – 6/30/16- retroactive property will be paid in 12 equal installments over the year. The reconciliation of therapeutic leave days and retainer days will be in a lump sum (I think this is accurate- there was so much discussion- it was hard to understand the final outcome).
Discussion of leaving beds open for people who are hospitalized or in rehab beds in nursing homes. A small group will be formed to discuss further.
IRA clinical services- all info collected from Survey D. Whatever you reported will be taken out of your rate.
Respite rates are not set in stone. DOH is committed to the rates being right before sending out final versions. Looking at transportation outside of the rates. Donna will be sending out information she has gathered from CFR’s on transportations costs and number of people who use respite from 0 – 4 hours, 4 – 8 hours, 8 – 12 hours, etc. by individual in one billing time frame.
Independent Practitioner Rates- looking to use Medicare rates.
ICF rates- new rates should be in system for cycle 2001. Info forthcoming on how to pay back monies owed.
Don Hughes/Megan O’Connor-
Electronic Fire Drill Reporting- in follow up to 2012 ADM. Have been piloting in state homes in Central Region. Lots of good feedback- centralized record, can do trending, ensures proper completion of form, e-mails next reviewer that a form is waiting for signature. Similar to IRMA- can be sorted by agency, address, date, etc.
Safety & Security Director- Richard Abdu- OPWDD has met with State Police and Homeland Security to get guidance on Active Shooter situation. FEMA has good information. (Just got info today, which I will pass on to membership).
Tammie Devine-
Incident Reporting- must have dedicated electronic mailboxes. Expectation of full electronic submission of all investigation records not under JC, including death. Letters to be sent to ED’s on open cases. OPWDD has largest % of these under the JC. Training on CAP and IAC beginning in February. For all abuse and neglect cases under JC, agency must submit a CAP and it must be timely.
OPWDD Registered providers (transportation, supplemental staffing, etc) must do all required background checks. It is the individual agency’s responsibility to make sure they are done.
FetchnerSteckner-
Aging Out- He oversees the Special Populations Unit. OPWDD and SED are talking to discuss system difficulties with transition planning.
Ellie Smith/Roger Bearden/Megan O’Connor-
Nurse Practice Act- Agencies must do certification of Comm Hab, Respite (not including free standing), Day Hab w/o Walls, SEMP, Pre-Voc and Pathways. However, you don’t have to do the nursing services delegation. SED is still saying that delegated nursing services onlyapplies to people who live in private homes.
Training is set for January 12th. Convert provider agreement to an Operating Certificate through a CON. Only need to do one CON (like Article 16 satellite clinics), which will be submitted to the DDRO. If you chose to provide nursing services, you will need to do a policy/procedure. DQI protocol will be on OPWDD website.
Question on how to pay for nursing services – through CFR re-basing. Also, will be an additional module to the medication course.
There will be NO JC jurisdiction in these services.
Ceylane Meyers-Ruff-
SEMP & Workshop issues- Final draft on Workshop Guidance is available. January 15th there will be a VC on Guidance document and on February 1st- Technical Assistance on Integrated Businesses VC. Proposals will be due by 1/6/2017 (they will be accepted anytime prior to that also). All will be responded to no later than 7/1/2017, although likely much earlier.
