ACCEPT THE FLAGLER COUNTY LOCAL MITIGATION STRATEGY

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM COAST, FLAGLER COUNTY, FLORIDA, ACCEPTING THE FLAGLER COUNTY LOCAL MITIGATION STRATEGY PLAN PROPOSED BY THE FLAGLER COUNTY LOCAL MITIGATION STRATEGY (LMS) WORKGROUP; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the Flagler County Local Mitigation Strategy (LMS) Workgroup, was created in 1999, and was assigned the responsibility of developing a Local Mitigation Strategy Plan; and

WHEREAS, Flagler County initiated the Local Mitigation Strategy Plan development process by entering into a contract with the Florida State Department of Community Affairs (DCA) Division of Emergency Management; and

WHEREAS, the Flagler County LMS Workgroup has completed the 2011 review and updated the previously adopted LMS Plan; and

WHEREAS, the proposed LMS Plan is intended to provide a strategy to mitigate dangers and costs associated with weather and man-made hazards and to provide a priority for recovery in the event of a hazardous event occurring in Flagler County; and

WHEREAS, the proposed LMS Plan has been considered acceptable by DCA and the Federal Emergency Management Agency; and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM COAST, FLORIDA:

Section 1. APPROVAL OF LOCAL MITIGATION STRATEGY PLAN. The City Council of the City of Palm Coast hereby adopts the Local Mitigation Plan as attached hereto and incorporated herein by reference as Exhibit “A.”

Section 2. SEVERABILITY. If any section or portion of a section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or part of this Resolution.

Section 3. CONFLICTS. All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are hereby repealed.

Section 4. IMPLEMENTING ACTIONS. The City Manager, or designee, is hereby authorized to take any actions necessary to implement the action taken in this Resolution.

Section 5. EFFECTIVE DATE. This Resolution shall take effect immediately upon adoption by the City Council.
