THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, that the two Bronze Star Medals he received be added to his DD Form 214, Certificate of Release or Discharge from Active Duty.

2. The applicant states, in effect, that his DD Form 214 was generated before the documentation was provided to him.

3. The applicant submitted a copy of an award certificate for the Bronze Star Medal, dated 11 January 2004; an award certificate for the Bronze Star Medal, dated 8 February 2004; and a copy of a 432nd Civil Affairs Memorandum for Record, Subject: Presidential Unit Citation, dated 31 March 2005, in support of his application. On 22 March, the applicant submitted a copy of the DD Form 214 he was issued on 17 May 2004 and other documents pertinent to other awards - the Combat Action Badge and overseas service bars – he wishes to have added to his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant’s military records show he enlisted in the Air Force Air National Guard on 27 August 1980. On 3 March 1981, he was ordered to active duty for the purpose of completing initial active duty training (IADT). He completed this training and was released from IADT on 19 June 1981. He continued to serve in the Air Force Air National Guard until 11 August 1988 when he was honorably discharged in the rank of Staff Sergeant, E-5, for the purpose of enlisting in another component.

2. The NGB Form 22 the applicant was provided on his discharge shows he wasawarded the Air Force Longevity Service Ribbon and the Air Reserve ForcesMeritorious Service Medal, with oak leaf cluster. On 15 August 1992, theapplicant's NGB Form 22 was corrected to add the Air Force Outstanding Unit Award, the Air Force Basic Military Training Honor Graduate Ribbon, and the Air Force Training Ribbon.

3. The applicant enlisted in the Wisconsin Army National Guard (ARNG) on 30March 1990. He continued to serve in this component, and as a Reserve of the Army, until 3 August 1990, when he was discharged to accept an appointment as a commissioned officer and assignment to the Adjutant General Corps.

4. The applicant was ordered to active duty for training (ADT) on 4 August 1991 and on 5 November 1991 he was honorably released from ADT at the completion

of his period of ADT. The DD Form 214 the applicant was issued on his release from ADT shows he was awarded the Army Service Ribbon. On 10 July 1991, the applicant was awarded the Armed Forces Reserve Medal in a Memorandum, Subject: Award of the Armed Forces Reserve Medal or Device; however, this award was not added to his DD Form 214 on his release from ADT.

5. On 19 April 1997, the applicant submitted his resignation from the Wisconsin ARNG and was honorably discharged in the rank and pay grade, Captain, O-3. Theapplicant was transferred to a Training Program Unit (TPU) of the US Army Reserve, the 432nd Civil Affairs Battalion (Direct Support), Green Bay, Wisconsin. The NGB Form 22 the applicant was issued on his discharge from the Wisconsin ARNG shows he was awarded the Armed Forces Reserve Medal; the National Defense Service Medal; the Wisconsin Service Ribbon (2nd Award); the Army Reserve Components Achievement Medal, (4thAward); theMeritorious Service Medal; and the Marksman Marksmanship Qualification Badge, with Automatic Rifle Bar [M-16 Rifle].

6. The evidence shows that the applicant was given a branch transfer from theAdjutant General Corps to the Civil Affairs Branch on 24 July 1998. The applicant's branch transfer was announced in a Memorandum, Subject: Branch Transfer, prepared by Headquarters, US Army Special Operations Command, Fort Bragg, North Carolina, dated 24 July 1998.

7. On 11 August 2000, the applicant was ordered to active duty in support of Operation Joint Guardian. The applicant served in Germany from 20 August 2000 through 22 August 2000 and in Kosovo from 23 August 2000 through 27February 2001. The applicant was released from active duty on 22 March 2001.

8. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), of the applicant's DD Form 214, with an effective date of 22 March 2001, shows he was awarded: the Meritorious Service Medal; Air Force Outstanding Unit Award; the Army Reserve Components Achievement Medal (4th Award); the National Defense Service Medal; the Armed Forces Reserve Medal; the Armed Forces Reserve Medal, with "M" Device; the Army Service Ribbon; the Army Reserve Components Overseas Training Ribbon (4th Award); the Air Force Basic Military Training Honor Graduate Ribbon; the Air Force Longevity Service Ribbon; the Air Force Training Ribbon; the Kosovo Campaign Medal; the North Atlantic Treaty Organization Medal; the Expert Marksmanship Qualification Badge, with Pistol Bar, and the Marksman Marksmanship Qualification Badge, with Rifle Bar.

9. The applicant was awarded the Army Reserve Components Overseas Training Ribbon in a Memorandum, Subject: Award of the Army Reserve Components Overseas Training Ribbon, prepared by the Sergeant Dennis JF Murphy Memorial US Army Reserve Center, Green Bay, Wisconsin, dated 8 January 2003.

10. The applicant was ordered to active duty in support of Operation Enduring Freedom for 365 days, but not to exceed 2 years, on 28 February 2003.

11. Item 18 (Remarks), of the applicant's DD Form 214, with an effective date 17May 2004, shows he served in Kuwait and in Iraq for the period from 14 April 2003 through 13 April 2004.

12. The applicant was awarded the Bronze Star Medal, for exceptionally meritorious performance of duty during Operation Iraqi Freedom, for the period 28February 2003 to 1 April 2004, by Permanent Orders Number 011-016, published by Headquarters and Headquarters Troop, 2nd Squadron, 3rd Armored Cavalry Regiment, on 11January 2004. This award is not shown on the applicant's DDForm 214.

13. The applicant was awarded the Bronze Star Medal, for exceptionally meritorious service during Operation Iraqi Freedom, for the period 19 March 2003 to 2 March 2004, by Permanent Orders Number 039-194, published by the 432 Civil Affairs Battalion, 304th Civil Affairs Brigade, on 8 February 2004. This award is not shownon the applicant's DD Form 214.

14. The applicant's unit, the 432nd Civil Affairs Battalion, was awarded the Presidential Unit Citation for its support of the I [Roman Numeral One] Marine Expeditionary Force (OIF) for the period 21March through 24 April 2003, by R010730 March 2005 Unclassified Message from CMC, Washington, DC. Thisunit award is not shown on the applicant's DDForm 214.

15. The applicant was honorably released from active duty, on 17 May 2004, under the provisions of Army Regulation (AR) 600-8-24, paragraph 2-27A, at the completion of required service. On the date he was released from active duty, the applicant had completed 1 year, 2 months, and 20 days net active service.

16. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized), of the DD Form 214 he was issued on his release from active duty on 17 May 2004, shows he was awarded: the Air Force Outstanding Unit Award; the Army Reserve Components Achievement Medal (5th Award); the National Defense Service Medal (2nd Award); the Kosovo Campaign

Medal; the Global War on Terrorism Expeditionary Medal; the Global War on Terrorism Service Medal; the Armed Forces Reserve Medal, with "M" Device (2nd Award); the Army Forces Reserve Medal (2nd Award); the Army Service Ribbon; theArmy Reserve Components Overseas Training Ribbon; the Air Force Basic Military Training Honor Graduate Ribbon; the Air Force Longevity Service Ribbon; theAir Force Training Ribbon; and the North Atlantic Treaty Organization Medal. The two Bronze Star Medals, in effect, the Bronze Star Medal, with oak leaf cluster, and the Presidential Unit Citation are not shown among the applicant's authorized awards. The Air Reserve Forces Meritorious Service Medal, with oak leaf cluster; theMeritorious Service Medal; and the Marksman Marksmanship Qualification Badge, with Rifle Bar, shown on the applicant's NGB Form 22, dated 19 April 1997, were not transposed to his last issued DD Form 214 because he was released fromactive duty on temporary records. The Army Reserve Components Overseas Training Ribbon as shown on his DD Form 214, dated 22 March 2001, is shown on the applicant's DD Form 214; however, the designation for the fourth award is not. The Expert Marksmanship Qualification Badge shown on the applicant's DD Form 214, with an effective date of 22 March 2001, was also not transposed to the DDForm 214 with an effective date of 17 May 2004.

17. The applicant was awarded the Combat Action Badge by Permanent Orders C348-123, Headquarters, US Army Civil Affairs and Psychological Operations Command (Airborne), Fort Bragg, North Carolina, dated 14 December 2005. This badge is not shown on the applicant's DD Form 214 with an effective date of17 May 2004.

18. The applicant was awarded two overseas service bars in a Memorandum forDistribution: Subject: Award of the Overseas Service Bars, prepared by the Sergeant Dennis J.F. Murphy MemorialUS Army Reserve Center, 432d Civil Affairs Battalion, dated 22 April 2004. These overseas service bars are not shown onthe applicant's DD Form 214 with an effective date of 167 May 2004.

19. The applicant was released from his assignment with the 432nd Civil Affairs Battalion and was transferred to the Retired Reserve in the rank and pay grade, Major, O-4, on 31 August 2004. On the date of his transfer to the Retired Reserve, the applicant had completed 24 qualifying years of service for retirement purposes.

20. AR 600-8-22 states, in pertinent part, that an oak leaf cluster is awarded to denote the second and succeeding award of certain decorations, among which is the Bronze Star Medal.

21. AR 670-1, chapter 29, prescribes policy and guidance for wear of U.S. and foreign unit awards. This regulation states that a Soldier may wear the unit award permanently if the individual was assigned to, and present for duty with the unit any time during the period cited; or was attached by competent orders to,and present for duty with the unit during the entire period, or for at least thirty consecutive days of the period cited.

DISCUSSION AND CONCLUSIONS:

1. The applicant was awarded two Bronze Star Medals for his service in support ofOperation Iraqi Freedom. These awards are not shown on the applicant's DDForm 214 with an effective date of 17 May 2004. It would be appropriate to add them to his DD Form 214 correctly as, the Bronze Star Medal, with oak leaf cluster.

2. The applicant served with a unit at the time it was cited for award of the Presidential Unit Citation. This unit award is not shown on the applicant's DDForm 214 with an effective date of 17 May 2004. He is therefore entitled to have this unit award added to his DD Form 214.

3. The Air Reserve Forces Meritorious Service Medal, with oak leaf cluster; the Meritorious Service Medal; and the Marksman Marksmanship Qualification Badge, with Rifle Bar, shown on the applicant's NGB Form 22, dated 19 April 1997, were not transposed to his last issued DD Form 214 because he was released from active duty, on 17 May 2004, on temporary records.

4. The Army Reserve Components Overseas Training Ribbon is shown on the applicant's DD Form 214 with an effective date of 14 May 2004; however, the designation for the fourth award is not shown. The applicant is entitled to a correction of his DD Form 214 to shown the correct number of Army Reserve Components Overseas Training Ribbons he has received.

5. The applicant was awarded the Combat Action Badge. This badge is not shown on the applicant's DD Form 214 with an effective date of 17 May 2004. He is entitled to a correction to add this badge to his DD Form 214.

6. The applicant was awarded two overseas service bars for his service in Iraq. These overseas service bars were not added to his DD Form 214 on his release from active duty. He is entitled to have them added to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant arecommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

a. adding the already-awarded Bronze Star Medal, with oak leaf cluster; the Meritorious Service Medal; the Air Reserve Forces Meritorious Service Medal, with oak leaf cluster; the Presidential Unit Citation; the Combat Action Badge; the Expert Marksmanship Qualification Badge, with Pistol Bar; the Marksman Marksmanship Qualification Badge, with Rifle Bar; and two overseas service bars to the applicant's DD Form 214 with an effective date of 17 May 2004; and

b. showing the applicant was awarded the Army Reserve Components Overseas Training Ribbon (4th Award) as opposed to only one Army Reserve Components Overseas Training Ribbon as currently shown on his DD Form 214 with an effective date of 17 May 2004.
