A signed RENTAL agreement must be returned with booking deposit within 7 days to secure unit. This rental agreement acknowledges that Renters understand and accept the terms and conditions of the Rental Agreement and Condo Rules.

Booking Deposit. A Booking Deposit of $200 is required to hold the reservation. Your deposit is placed in an account. This deposit does not apply to rent. The check for your deposit (less $25.00 processing fee) will be mailed within fourteen (14) days after checkout inspection, provided there are no damages or missing items, the unit is left reasonably clean, and trash is removed and placed in the proper outside container. Booking deposit may be paid in form of personal check, r or credit card (via PayPal). (Contact owners if you wish to pay with credit card.) Final Payment. Your full payment is due twenty-one (21) days before check in, (45) days for monthly rentals. Non-payment of rent by due date is considered a cancellation and subject to cancellation policy. This payment will include the full rental amount, plus lodging tax of 6.0%, plus a $100.00 cleaning fee.

Cancellation. If you cancel or change occupancy dates on a daily or weekly rental, a thirty (30) day notice prior to arrival must be given. If you cancel or change occupancy dates on a monthly rental, a ninety (90) day notice prior to arrival must be given. Failure to do so will result in forfeiture of the deposit or rent, unless the unit is re-booked for the same rental period.

Rental Period. Checkout time is 10:00 a.m. Check-in time is 4:00 p.m. If not out by checkout time, Renters will be charged for another day.

Confirmations. Anemail reservation confirmation showing full amount due will be sent to Renters upon receipt of Renters deposit.

Damage Deposit Refunds. Damage deposit refundswill be made as promptly as possible, but always within 14 days of condo inspection after rental. Housekeeping will complete a walk-through and note clearly if for any reason a deduction is required from Renters refund.

Age Requirements. No property will be turned over for rental to anyone under the age of 25. If the Renters signing this agreement abandon the premises any occupants will be evicted. No refund of rent will be made under these circumstances.

Maximum occupancy. Maximum occupancy shall not exceed the number of people advertised (4 persons). Renters will be asked to scale back your group. Failure to scale back Renters group will result in eviction with no return of rent or booking deposit. Small children are included in the total occupancy count. Only owners can approve modification of this number.

Hurricane Policy. The National Weather Service must name a hurricane and an evacuation for Fort Morgan/Gulf Shores issued, for any refund. If this should be the case, a pro-rated amount will be refunded.

No Smoking and no pets allowed. If Renters do not abide by these rules, Renters will be asked to leave immediately, and Renters will not receive a refund of your balance or damage deposit.

Termination of Rental Agreement. Rental agreement terminates if fire or other casualty, including natural disaster, destroys premises. If this should be the case, a pro-rated amount will be refunded.

Appliances, TV’s, Furniture and Heating / Air Conditioning Unit. If failure occurs, repairs will be made as soon as possible after the problem has been reported to us. No refund or adjustments upon failure. Furniture in the condo will not be altered from its current location, except for the mobile kitchen island.

Linens and Towels. We provide linens, pillows, and towels. Linens will not be exchanged during your occupancy.

Entry. Agent of owners or owners may enter premises to make repairs. We will be considerate of your privacy.

Refuse Admittance or Discontinue Occupancy. We reserve the right to refuse admittance and or discontinue occupancy if such action is in the best interest of protecting our investment. In the event of eviction, no refund of rent will be made.

Indemnification. Renters will indemnify and hold Owners harmless from any loss, cost, damage and/or expenses caused by injuries to persons or damage to property while in, on or about the house and community, not attributable to the willfully wrongful act of the Owners. Any property located in, or brought onto, the condo and grounds shall be at the sole risk of Renters.

Your signature certifies that you have read, agree to, and will abide by the Rental Agreement and Condo Rules. Any reservation made under false pretense will result in loss of deposit and rent.
