Theprocedurebelowcan beusedfortheprocessing ofbothstudentandemployeecomplaintsofdiscriminationonthebasisofsexorhandicap. This procedureprovidesfortheprocessing ofagrievanceatthreelevelsofprogressivedecisionmaking. AtLevelI,agrievanceisheardbyanauthorityatthelevel mostimmediatetomanygrievanceoccurrences. LevelIIdecisionmakingisatthecentraladministrativeleveloftheagencyofinstitution. LevelIIIiswiththeSuperintendent oftheIndiahoma SchoolDistrictandLevelIVcallsforfinalgrievanceresolutionbythegoverningbodyoftheagency/institution,suchas the IndiahomaSchool BoardofEducation.

I.Filingof Grievances

A.EligibilityforFiling: Anystudent oremployee,or anyindividualorgroupactingonbehalfofastudentoremployee(maleorfemale)mayfile anygrievanceofsexdiscriminationor sexualharassmentwiththeTitleIXcoordinator. Anystudentoremployee,or anyindividualorgroupactinginbehalfofahandicappedstudent orhandicappedemployeemayfile anygrievanceofdiscriminationonthebasisofaphysicalormentalhandicapwiththeSection504coordinator.

B.LevelI: Prior tothesubmissionofawrittengrievanceattheDirector’s

level,thegrievant(s)mayrequestaninformalmeetingwiththeinvolved parties forthepurposeofresolvingthematter promptly andinformally. IfthecomplaintorissueisnotresolvedatLevel1,thegrievantmay fileawrittengrievance,onaComplianceViolationForm,withtheTitleIX Coordinator, Mr. Greg Ellis and/orSection504Coordinator, Nicole Hannabass. Thecomplaintshallstatethenatureofthegrievanceandtheremedyrequested.Thefilingoftheformal,writtencomplaintmustbewithinfifteen(15)workingdaysfromthe dayoftheeventgivingrisetothegrievanceorfromthe datethegrievantcouldreasonablybecomeawareofsuchanoccurrence.ThegrievantmayrequestthatameetingconcerningthecomplaintbeheldwiththeTitleIX Coordinator, Mr. Ellisand/or504Coordinator, Ms. Hannabass. Aminorstudentmay beaccompaniedatthatmeetingbyaparentorguardian.TheTitleIXand/or504Coordinatorshall investigatethecomplaintandattempttosolveit.

C.Level2: Ifthecomplainantisnotsatisfied with thedisposition of his/hergrievanceat Level1,orif nodecisionhasbeenrendered withinfive (5) daysafter presentationofthegrievanceinwriting,thecomplainantmayfileawrittenappeal for ahearingbytheTitleIXand/or 504 Coordinatorwithin five (5) days. TheCoordinatorshallrepresenttheadministrationatLevel2ofthegrievanceprocedure.Withinfive (5) daysafterreceiptofthewritten appeal forahearingbytheCoordinator,theCoordinatorshall meet withthe

complainant forthe purposeofresolvingthegrievance.Afullrecordofsuch hearing shallbekept bythe Coordinator.TheCoordinatorshallwithinfive (5) daysofthehearing render thedecision andthereasonsthereforeinwritingtothecomplainant.

D.Level3: IfthecomplaintisnotresolvedatLevel2,thegrievantmayproceedtoLevel3bypresentingawrittenappealtotheSuperintendentwithinten(10)workingdaysafterthegrievantreceives thereportfromtheTitleIXCoordinator. ThegrievantmayrequestameetingwiththeSuperintendentorhis/herdesignee.TheSuperintendent orhis/herdesigneehas theoptionof meetingwiththegrievanttodiscuss theappeal.AdecisionwillberenderedbytheSuperintendent orhis/herdesigneewithinten(10)workingdays afterreceivingthewrittenappeal.

E.Level4: IfthecomplaintisnotresolvedatLevel3,thegrievantmayproceedtoLevel4bypresentingawrittenappealtothePresident oftheBoardofEducationwithinten(10)workingdaysafter thegrievantreceives thereportfromtheSuperintendent. ThegrievantmayrequestameetingwiththeBoardofEducation.TheBoardofEducationhas theoptionofmeetingwiththegrievanttodiscuss theappeal.Adecisionwill berenderedbytheBoardofEducationattheirnextregularlyscheduledmeeting.Thegrievantwill benotifiedin writing ofthedecisionwithinten(10)workingdaysafter theBoardofEducationaction. Theprocedureinnowaydenies theright ofthegrievanttofileaformalcomplaintwiththeOfficeforCivil Rights, orotheragenciesavailableformediationor rectificationofrights grievances,ortoseekprivatecounselforcomplaintsallegingdiscrimination.

TheseformsmaybeobtainedfromtheTitleIX Coordinator, Mr. Greg Ellisand/or 504Coordinator, Ms. Nicole Hannabass,uponrequest.ThegrievantshallhavetherighttorequestassistancefromtheTitleIXorSection504coordinator oranyotherindividual,group,or organizationtoassistin thepreparationoftheformorin thefiling ofthegrievance.
