RESOLUTION NO. 2058

A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR THE ALAMEDA-CONTRA COSTA DISTRICT’S SERVICE DEPLOYMENT PLAN, AUTHORIZING THE FILING OF THE NOTICE OF DETERMINATION AND APPROVING THE CENTRAL ALAMEDA COUNTY PORTION OF THE PLAN

WHEREAS, the District has undertaken the development of a Service Deployment Plan which proposes changes to the local transit network in District One in four phases: Phase One: San Pablo Corridor; Phase Two: Central Alameda County; Phase three: Berkeley, North Oakland; and Phase Four: Oakland; and

WHEREAS, in addition to the aforementioned service improvements, AC Transit proposes a number of additional improvements for local night and weekend transit service restoration within northern Alameda County; and

WHEREAS, in accordance with the California Environmental Quality Act (CEQA) and its implementing guidelines, as well as Board Policy No. 512, an initial study determined that the proposed project would not have any significant environmental impacts and determined that a Negative Declaration was the appropriate environmental document for the project; and

WHEREAS, the Board of Directors, on May 24, 2002 set a public hearing at the District’s General Offices, located at 1600 Franklin Street, Oakland, California for June 20, 2002 to consider public comments on the proposed environmental document and the proposed project; and

WHEREAS, appropriate notices were provided of the public review period and public hearing, as required by law; and

WHEREAS, copies of the environmental document were available at the main public libraries and public buildings of the cities and unincorporated areas of the county in the project area, as well as at the District Secretary’s Office; and

WHEREAS, after conducting an approximately eighteen month study with representatives from the cities and unincorporated area in Central Alameda County, the District is prepared to proceed with the implementation of the SDP for this area, even though it has been identified as the second phase of the project; and

WHEREAS, the public notices regarding the environmental document included notice of the intention of the Board of Directors to consider the approval of the Central Alameda County portion of the SDP; and

WHEREAS, the public hearing was held on June 20, 2002, at the District’s General Office, and the Board received and considered all written and oral comments regarding the appropriateness of the proposed Negative Declaration, the Project and the approval of Phase Two of the Project.

NOW, THEREFORE, the Board of Directors of the Alameda-Contra Costa Transit District does resolve as follows:

Section 1.The Board of Directors finds and determines that:

a.No public comment was received during the 20-day review period or at the public hearing indicating that the draft Initial Study/Negative Declaration was not the appropriate environmental document for the Alameda-Contra Costa Transit District Service Deployment Plan;

b.The draft and final Initial Study/Negative Declaration for the project were prepared in accordance with the requirements of CEQA and its implementing guidelines and District Board Policy No. 512;

c.The draft and final Initial Study/Negative Declaration were reviewed and considered by the Board of Directors at a legal, duly noticed meeting of the Board of Directors;

d.All notices required to be given regarding the draft and final Initial Study/Negative Declaration have been provided as required by law;

e.A public comment period in excess of the 20 day period required by law was provided for the review of the draft Initial Study/Negative Declaration and copies of this document were available for public review at various locations within the Project area, as well as at the District=s General Office;

f.A legally noticed public hearing on the draft Initial Study/Negative Declaration occurred on June 20, 2002; and

g.Based on the content of the final Initial Study/Negative Declaration there is no substantial evidence that the proposed Alameda-Contra Costa Transit District Service Deployment Plan will have a significant effect on the environment.

Section 2.The Board of Directors approves the final Initial Study/ Negative Declaration for the Alameda-Contra Costa Transit District Service Deployment Plan and authorizes the filing of a Notice of Determination.

Section 3.The Board of Directors approves the Central Alameda County portion of the Service Deployment Plan (Phase Two), and authorizes the staff to proceed with the implementation of this portion of the Service Deployment Plan subject to the availability of necessary funding.

Section 4.This resolution shall become effective immediately upon its adoption by four affirmative votes of the Board of Directors.
