CLUBHOUSE RENTAL AGREEMENT

A Chesterfield Farms Homeowner must sign this contract and attend the function.

$75.00 rental fee
$150.00 security deposit

All fees must be paid one week prior to rental date. Please issue separate checks for deposit and rental fee as your deposit check is returned to you, providing none of the following clauses are violated. Make checks payable to Trustees of Chesterfield Farms. Thesecurity deposit in no way limits the amount of homeowner obligation if there is any need for reparation/repairs.

Cancellations must be made one week prior to scheduled rental date or rental fee will be forfeited.

HOURS

Party is only for the hours listed above. No party shall extend past 11 PM; pool parties after 9 PM are limited to Fridays and Saturdays. Failure to vacate on time may result in loss of deposit. Homeowner-renter must be present for the duration of the party.

RULES AND OBLIGATIONS

  1. Cleanup: The clubhouse and premises are to be cleaned and put back in order prior to the end of the party. Trash bags (kitchen size), vacuum cleaner and cleaning supplies are provided. All trash must be removed from the clubhouse and placed in trash bins located in the outdoor trash enclosure.
  2. Pool Season (Memorial Day through Labor Day). For parties held from Memorial Day through Labor Day, resident renter is required to have at least one lifeguard on duty if the pool deck will be used (even if the pool is not used). If resident renter’s party includes use of the pool area, a specified number of lifeguards will be required by the pool management company and are an additional cost above rental fee. Lifeguards must be reserved through pool management 2weeks in advance. To reserve lifeguards or for more information, call Pro Pool Management @ 314-PRO-POOL. Pool manager will advise the trustees that this item/fee has been taken care of in order for the Clubhouse Rental Agreement to be valid.

All regular pool and recreation complex rules apply and are posted in the clubhouse lobby. Pool Management requests that the homeowner-renter assist the lifeguard(s) with assuring safety.

  1. “Off Season” (Labor Day through Memorial Day). Pools are NOT to be used nor are pool covers to be disturbed. Homeowner-renter or guests may be expelled from the clubhouse or prohibited use of the facility in the future, at the discretion of the trustees, if this clause is violated.
  2. Homeowner-renter agrees to assume all responsibility and liability for the behavior and acts of his/her guests including those acts resulting in damages or injury to person or property. Any damaged or stolen articles will be repaired or replaced by the homeowner-renter. The trustees, the police, or Association insurance company shall make determination of theft/damage. In addition, the lifeguards will inspect the pool area for any damages at the end of a pool party.
  3. The Monarch Fire Protection District has limited the number of persons in the clubhouse as follows: 28 persons using tables and chairs; 61 persons using chairs only.
  4. Decoration must not be adhered to any painted or wallpapered area. Window frames and doorframes are the only places where tape may be used. Confetti is prohibited. Homeowner-renter agrees to remove all tape and decorations, return furniture to its original position if it is moved for or during the party, extinguish all interior lights, close all windows and lock up the clubhouse upon leaving.
  5. Noise, especially music, must be kept under control and cannot be disruptive to surrounding homes. Any complaints regarding noise will be the responsibility of the homeowner-renter.
  6. Youth (under age 18) parties require parent supervision (at least one adult chaperone for every 10 children).
  7. Homeowner and guests will not adjust the thermostat above 75 degrees and will return the thermostat to 60 degrees at the end of the party. (During warm weather, thermostat must be set at 78 degrees upon leaving.)
  8. Clubhouse office is locked. Homeowner/guests should not attempt to enter this area.
  9. Deposit is returned within one week of party, after a trustee assesses the condition of the clubhouse after the rental. The trustees shall arrange for and contract for any repairs or extra cleaning, including the selection of contractors, or any other service necessary to restore the premises.
  10. Homeowner-renter shall reimburse the Chesterfield Farms Homeowners Association for all repairs, replacement, and extra cleaning costs in excess of the deposit at the time the costs are estimated by the serviceman or contractor. Failure to reimburse the Association for such costswill result in the posting of a lien on the homeowner’s property and homeowner will pay for all legal fees associated with said lien. In addition, homeowner-renter will be charged a 10% annual rate of interest on the amount unpaid, beginning 30 days after the Association accepts an estimate for repairs or replacements.
  11. Homeowner-renter agrees to hold harmless and indemnify the Chesterfield Farms Homeowners Association for any expenses or claims arising from the activities of the renter or his/her guests. This includes damages and injury to persons/property (including surrounding property at the recreational complex or surrounding private properties), and the cost of a reasonable defense on behalf of the Chesterfield Farms Homeowners Association for any claim or litigation arising from this contract.
  12. If damage or misuse results from homeowner-renter’s party, future use of the clubhouse/recreation complex may be prohibited at the discretion of the trustees.
