ISTANBUL METROPOLITAN MUNICIPALITY DEPARTMENT OF RAIL SYSTEMS, DIRECTORATE OF ASIAN SIDE RAIL SYSTEMS

Procurement and commissioning of 120 metro vehicles for Dudullu - Bostancı and Mahmutbey - Esenyurt Metro Lines and Railed Public Transportation Systems will be put out to open tender with tender procedure according to Public Tender Act numbered 4734 and article numbered 19.

2- Goods within the scope of the tender:

a) Quality, type and quantity : 30 sets of (4-car) metro train. In total 120 Metro Vehicles Distribution of the cars in accordance with the lines is shown below:

b) Place of Delivery : Istanbul

c) Date of Delivery : Delivery of the sets: Complete delivery of 120 vehicles shall be realized in 20 (twenty) months. Delivery of sets shall start as of the 10h month after the work order date and shall be completed by the end of the 20th month. After the delivery of final set; 30 (thirty) days for field tests, 60 (sixty) days for trial and 90 days in total shall be allowed. The program of this delivery shall be designated by contractor so as to deliver 2 sets (8 vehicles) in the 10th month and following this period, in form of packages of 3 sets (12 vehicles) for each month and 1 set packages for the 20th month. It is compulsory for contractors to meet these conditions. Trial run will be made separately for each one of the lines the vehicles subject to this work will operate at. As the vehicle delivery proceeds, in case a line that vehicles subject to the work is installed and amount of the vehicles to be used in that line is sufficient, and if Administration demands so, trial run will be started in the related line. In this case, duration of the trial run of the related line will take place in vehicle delivery period, however, it will not make any changes on the duration of above-mentioned 60 (sixty) days of trial run period that will be used following the delivery of the last set and finalizing of field tests. Following the work order date, the contractor will submit the detailed work program on vehicle test (factory and field tests) and trial runs to the approval of the Administration within 30 (thirty) calendar days. Following the signing of the agreement, the contractor shall submit a work plan detailing the descriptions of the design, procurement planning, make-ready process, all tests and activities regarding the production and installation to the approval of the Administration. The duration of the trial operation of Mahmutbey - Esenyurt Metro Line is 120 days, and the duration of the trial operation of Dudullu - Bostancı Metro Line is 60 days. The first 80 metro vehicles to be procured are planned for Mahmutbey - Esenyurt Metro Line and the remaining 40 metro vehicles are planned for Dudullu - Bostancı Metro Line.

4. The criteria for the adequacy assessment, the provisions of submission to tender and the documents required:

4.1. Conditions for participating in the tender and documents required:

4.1.2. Signature Statement or Signature Circular showing the authority to bid.

4.1.2.1. If the tenderer is a natural person, then notarized signature Statement is needed.

4.1.2.2. If the tenderer is a legal person, a Trade Registry Gazette showing the partners, members or founders of legal person and defining the current status of personnel working under the authority of legal person or, if this information is not present in a single Trade Registry Gazette, all Trade Registry Gazettes to include this information or documents confirming these points and notarized Signature Circular of this legal person,

4.1.3. Letter of Proposal structure and content of which is defined in the Administrative Specifications.

4.1.4. The bid bond structure and content of which is defined in the Administrative Specifications.

4.1.5 Bidders are to provide information on the part of the purchase for tender that are planned to be completed by subcontractors in an additional document attached to their proposal.

4.1.6 If the document submitted by the legal entity to prove the professional experience belongs to the partner of the legal entity who owns more than 50 percent of the legal entity, document to be obtained from Turkish Union of Chambers and Commodity Exchanges or chartered accountant or certified public accountant or notary public to verify that this requirement has been met for the past year until the issuance of the said document after the first announcement of the tender.

4.2. Documents concerning economic and financial capacity and the criteria applying to those documents:

4.2.1. Documents to be obtained from banks:

Banker’s reference letter, indicating unused cash credit, unused letter of guarantee or unrestricted deposited account in the amount offered by the tenderer on condition that it is no less than 10% of the proposed sum.

This criteria may be fulfilled by adding the deposit and credit amounts or presenting more than one banker’s reference letter.

4.2.2. Year-end balance sheet that corresponds to the year before the year the tender was conducted or equivalent documents:

a) In accordance with the respective regulations, for bidders who have the legal obligation to publish their balance sheets, year-end balance sheets or parts of sheets showing necessary criteria have been met,

b) In accordance with the respective regulations, for bidders who do not have the legal obligation to publish their balance sheets, year-end balance sheets or parts of sheets showing necessary criteria have been met or document in standard form regulated by certified public accountant or independent accountant and financial advisor showing that the criteria have been met.

In the balance sheets or equivalent documents submitted;

a) The current ratio (current assets / short term liabilities) must be minimum 0.75,

b) The shareholders’ equity ratio (shareholders’ equity/ total assets) must be minimum 0.15,

c) Short terms bank loans' ratio to the shareholders' equity must be lower than 0.50 and all three criteria must be met.

Bidders that do not meet the aforementioned criteria in the previous year could submit documents on the last two years. In that case, it will be taken into account whether the criteria are met by the average monetary amount of the last two years.

4.2.3. Documents stating the volume of the business:

a) The income statement indicating the total turnover of the last year before the tender,

b) ) Invoices issued during the year before the tender documenting completed sales and completed parts of the sales going on under commitment,

Submitting one of these documents is sufficient.

The amount of the total turnover shall be no less than 25% of the price to be offered by bidder or the amount of sales for the finished works shall be no less than 15% of the price to be offered by bidder. The bidder that fulfills either of these criteria and who submits document proving this shall be considered sufficient.

Bidders that cannot fulfill those criteria one year before the tender takes place can also present the documents of the past two years. In this case whether the average of those two years is able to fulfill the criteria shall be taken into account.

4.3. Documents regarding the Professional and Technical, and the criteria that these documents should bear:

4.3.1. Documents showing the work experience

Documents or technological product experience document evidencing that the experience of the bidder regarding the work subject to that tender or similar work completed within the last five years under a contract not less than 20% of the bid price.

4.4. Works to be accepted as similar work in this tender:

4.4.1.

Procurement of GoA4 type metro vehicles as defined by IEC 62290-1 Standards under one contract shall be considered as similar work.

In the work experience document, the bidder must specify that metro vehicles corresponding to the amount in the work experience document have been delivered, put into commercial use and the Administration has finalized its acceptance transactions.

5. The most economically advantageous bid shall be determined on the basis of the bid price only.

6. While the tender is open to all domestic and foreign bidders, bidders who offer domestic product will be given a %1 (one) price advantage over the total tender.

7. Viewing and purchasing Tender Document:

7.1. Tender Document can be viewed at the premises of the Administration and it can be purchased at the Asian Side Rail Systems Directorate of Istanbul Metropolitan Municipality’s Department of Rail Systems located in Seyrantepe Metro Facilities Huzur Mahallesi Istasyon Yolu Sarıyer / Istanbul on payment of 2.500 TRY (Turkish Liras) .

7.2.It is obligatory to purchase the tender document of those who will bid on the tender or to download it using e-signature via EKAP.

8. Tenders can be either submitted to the Directorate of Tender Affairs of Istanbul Metropolitan Municipality located in M. Nezihi Özmen Mahallesi Kasım Sk. No.62 34010 Merter, Güngören- Istanbul by tender date and time or sent to this address by registered and replied-paid post.

9. The bidders shall submit their bids for items of products as unit prices. At the end of the tender, a unit price contract will be signed with the willing bidder on the basis of the total amount determined by multiplying the unit price and work items.

The proposal shall be submitted for the whole work in this tender.

10. On condition that it is not less than %3 of the price they have offered, the Bidders shall give a provisional bond in the amount they have set.

11. The validity period of submitted proposals is 240 (two hundred forty) calendar days starting from the date of the tender.

12. Consortiums cannot submit offer to the bid.

13. Other Matters:

A statement shall be required from bidders whose bids are below the limit value according to Article 38 of the relevant law.

14. Bidders shall submit Annex-4 of the Technical Specifications in order to determine how they will meet %50 qualification ratio using percentages in Metro Vehicle Percentage Table and Annex-6 of the Technical Specifications by filling out Qualification Ratio – Equipment and/or Service Procurement List alongside their bids. The bids of the bidders that failed to present a document showing mandatory minimum sufficiency rate conditions are met or presenting incomplete documents shall not be evaluated.
