This puppy has been examined by a licensed veterinarian and was found to be in good health at that time. Record of vaccination and worming is provided.
Purchaser agrees to take this puppy to his own veterinarian within 72 hours of purchase for a health check. If said veterinarian determines the puppy to be ill, or for any reason this puppy is unacceptable, purchaser may return the puppy for a full refund, provided the puppy is in the same condition as at the time of sale, and provided it is within one week of purchase. All expenses for returning said puppy are the responsibility of the purchaser.
If this puppy is returned due to illness, a letter from your veterinarian is required. This includes death or illness from any health condition deemed present prior to removal from our premises.
It is agreed my kennel name, SUNAPEE, will be used as the first word of the registered name of the puppy, and it is requested, but not required, the litter theme of “xxxx” also be used.
Seller disclaims any damages to persons or property once this puppy has left seller's possession, whether this puppy is solely owned or co-owned by purchaser.
This puppy has been represented as companion/pet quality, and/or sold as such. Purchaser agrees to neuter this dog by eight (8) months of age, and to never breed this dog. Purchaser acknowledges seller will place this puppy on an AKC Limited Registration, which restricts eligibility to enter AKC dog events and which renders any offspring of this puppy ineligible for registration.

Purchaser acknowledges that if this Limited Registration is ever changed, the seller will be named on the AKC registration as a co-owner of this dog. This non-breeding contract and Limited Registration will not be changed under any circumstances without express written approval of seller. Seller MAY consider lifting the Limited Registration under the following conditions only:
· Seller will examine the dog and if the dog is found to be of breeding quality, purchaser must present seller with evidence of a normal hip x-ray, eye exam and any other pre-breeding screening deemed necessary by seller.
· Purchaser is required to show sincere interest in the breed and the art of breeding, by joining local kennel clubs, breed clubs, the national parent club, and by attending purebred dog functions, specialized training, etc.
· Purchaser is required to complete the AKC breed championship or two (2) performance titles on this dog prior to any breeding.
Further requirements are as follows:
· If a female, ONE pick puppy from this bitch’s first litter, from a mutually acceptable stud, (OR the current show quality puppy market-price cash equivalent thereof, at the option of seller) will be due to seller.
· If a male, seller reserves the right to breed any bitch owned or co-owned by seller to this male at no charge.
· Seller must approve any potential breedings for this dog, whether male or female, and reserves the right to deny acceptance of stud service on any potential bitch deemed unsuitable in any way by seller.
Warrantees
Every reasonable precaution has been taken to prevent this puppy from acquiring hereditary faults such as hip dysplasia or breed disqualifications. However, due to unknown hereditary and environmental causes of these and other faults, no guarantee can be given against them. However, this puppy shall carry a limited warranty as outlined below only:
This puppy will be replaced with another dog of equal value if:
· The dog becomes so dysplastic or affected with luxating patellas as to be crippled and unable to lead a normal life and must either be euthanized or undergo orthopedic surgery. –OR-
· The dog becomes blind due to hereditary cataracts or PRA. –OR-
· The dog suffers from hereditary, uncontrollable epilepsy or heart defect or disease which is terminal.

The listed conditions are subject to verification by a mutually acceptable veterinary specialist. This warrantee expressly covers only replacement as listed, and does not cover costs of health checks, treatments, or surgeries which purchaser may elect to have done on the dog. If any problem does arise, purchaser must notify seller immediately, prior to undertaking any treatment. Breeder may require a second opinion by a qualified veterinarian/specialist.
Other Terms & Conditions
Purchaser is not acting as an agent in the purchase of said puppy. He will never sell or give this dog or its offspring to any agent, pet store, dog dealer, research laboratory or guard dog business.
Purchaser agrees to promptly notify seller of any change of address or phone number. Purchaser also agrees to maintain contact with seller regarding this puppy, and to reply as promptly as possible to inquiries to this regard from the seller.
Purchaser agrees this dog shall not be allowed to run loose at any time or place, nor shall he be kept chained or tied out, or mistreated or abused. Purchaser also agrees to provide this dog with quality food, housing and veterinary care as instructed by breeder, and training as approved by breeder. All warrantees set forth in this contract are null and void if it is determined the above has been violated in any way.
Seller has the right to investigate the care of this dog if circumstances warrant. Seller may have this dog examined by a licensed veterinarian and if it is found this dog is a victim of ill treatment, abuse or neglect, seller has the right to take full possession of the dog without court intervention and without compensation to the purchaser. Purchaser will be required to sign AKC registration papers over to the seller in this case.
Purchaser guarantees seller the right of first refusal if this dog is to be sold or disposed of in any way. (YOU MUST NOTIFY SELLER!) Seller will assist purchaser in placing the dog, or take him back. This does not imply that full purchase price will be refunded. If seller does agree to take this dog back for placement in another home, signed registration papers must accompany the dog. If purchaser places said dog directly with another party, purchaser will promptly notify seller of new owner's name, address and phone number.
Any violations of the above conditions shall void all warrantees in this contract. Any violations of the above may damage the good will and reputation of the breeder and of the breed in general. Therefore, purchaser shall be liable to pay to seller, upon demand, $1000 in damages per term violated.

Further Conditions of Warrantee
· All warrantees are void if the dog is ever bred, or sold, or subjected to trauma which could have a marked effect on the claimed condition.
· All warrantees are void if any part of this contract has been violated.
· This contract is formed and shall be governed by the laws of the State of Michigan and jurisdiction to resolve disputes rests solely in a court of competent jurisdiction in the home county of the seller. In the event this contract does not provide a remedy to any dispute, and a judicial proceeding is necessary, both purchaser and seller agree to have the matter resolved through arbitration.
· No guarantees or warrantees, express or implied, are given by the seller, and all dogs are sold and delivered in an "as is" condition, except as expressly and specifically set forth herein. Seller will be liable to the extent stated in this contract only, and will not be responsible for any expenses incurred for any reason following the sale, unless specifically and expressly excepted by written agreement.
Purchaser has read and understands the foregoing and agrees that all parts and portions thereof constitute a binding agreement. This contract constitutes the entire agreement of both parties with respect to the sale mentioned above. No part of this contractual agreement is transferable. Purchaser acknowledges receipt of a copy of this contract.
