Re: (Invoice/ Contract Number / Make and Name of Carpet. Lounge, Bedroom etc. Carpet) - "Shading".

I write further to your letter to me (dated) regarding the above matter. On the (date) I contracted with your firm to fit and supply the above carpet at a cost of £ .... .

The carpet was fitted on (date). On inspection (or when faults developed) I noticed the following fault(s) (describe fault(s)). I reported this to you on (date). (describe what the firm did or said they would do.)

You have informed me that the "shading" or "pile reversal" which I have complained about is in no way detrimental to the quality or durability of the carpet and is not a manufacturing fault. I was not told about this phenomenon when I purchased the carpet.

Implied into our contract under the Supply of Goods and Services Act 1982 (as amended) are certain statutory rights. The relevant ones in our case being that the carpet you supplied should be of a satisfactory quality and / or fit for its particular purpose.

The main issue in this case is whether or not the carpet in question is of a satisfactory quality. To be of a satisfactory quality, goods must be of a standard a reasonable person would regard as satisfactory, taking into account of any description of the goods, the price and all other circumstances.

When considering whether goods are of a satisfactory quality certain other factors can be considered. The most relevant factors, here being the carpets "appearance and finish" and "freedom from minor defects".

The appearance of my carpet is seriously affected by the " shading" so I believe you are in breach of contract. While it may be both the manufacturers and your opinion that "shading" is not a manufacturing faults I believe this could be challenged, if necessary, in a court of law. I would therefore ask you to reconsider this matter with a view to arranging for (a refund plus my fitting costs, replacement carpet, re-selection or compensation).
