SUBJECT: Environmental Compliance for Eagles

Purpose: To transmit information on the Bald and Golden Eagle Protection Act (BGEPA) and the National Bald Eagle Management Guidelines and procedures for documenting compliance with the BGEPA.

Effective Date: Begin using immediately.

Background: The US Fish and Wildlife Service (Service) posted the final rule “Removing the Bald Eagle in the Lower 48 States from the List of Endangered and Threatened Wildlife” in the Federal Register on July 9, 2007. This rule became effective August 8, 2007.

The Bald Eagle is no longer listed under the Endangered Species Act. However, protections provided by the Bald and Golden Eagle Protection Act (BGEPA) and the Migratory Bird Treaty Act (MBTA) continue to remain in place after the delisting.

Procedures: The attached information provides step-by-step instructions and guidance for documenting compliance with the BGEPA, and determining if an Eagle Permit from the Service is necessary. The step-by-step instructions will be added to the Migratory Bird Help Sheet in the UT-CPA-52 once revisions to this Help Sheet currently in draft are completed and approved by NHQ.
