70:03:01:01. Definitions. The following terms used in this chapter mean:

(1) "Axle," is a structure or portion of a structure consisting of one or more shafts, spindles, bearings, or any other means of attachment in the same vertical transverse plane extending across the full width of the vehicle, by means of which, in conjunction with one or more wheels mounted on said shafts, spindles, bearings, or other means of attachments, with a portion of the weight of a vehicle and its load, if any, is continuously transmitted to the roadway when the vehicle is in motion;

(2) "Black Hills area," the area south and west of Interstate Highway 90 from the Wyoming state line to Rapid City, west of State Trunk Highway 79 from Rapid City to the junction of State Trunk Highway 79 and U.S. Highway 18, west of U.S. Highway 18 from the junction of State Trunk Highway 79 and U.S. Highway 18 to Oelrichs, and west of U.S. Highway 385 from Oelrichs to the Nebraska state line;

(3) "Commercial farm machinery operator," an individual or company that is actively engaged in operating farm machinery for hire;

(4) "Convoy," the movement of vehicle units as a group with continuity of distance and time;

(5) "Custom harvester," an individual or a company engaged in the business of providing harvesting services for another individual or company for a fee or other compensation;

(6) "Daylight hours," the period of a day from a half hour before sunrise to a half hour after sunset;

(7) "Draw bar length," the longitudinal distance measured from the center of the hitching mechanism to the turn center of the trailer dolly's axle group;

(8) "Dual tires," a wheel that consists of two rims, and two equally sized and inflated tires;

(9) "Effective trailer overhang," the longitudinal distance measured from the turn center of the semitrailer's or trailer's rear axle group to the rearmost point on the semitrailer, trailer, or load;

(10) "Extended period permit," an annual permit or other multiple trip permit;

(11) "Farm implement dealer," an individual or company who actively engaged in the sale of farm implements or farm implement parts;

(12) "Hitch offset," the longitudinal distance measured from the turn center of the semitrailer's or trailer's rear axle group to the center of the hitching mechanism;

(13) "Interstate highway system," all highways on the national system of interstate highways;

(14) "LCV," a longer combination vehicle;

(15) "Manufactured home," a manufactured home or mobile home as defined in SDCL 32-3-1;

(16) "Nighttime hours," the period of a day from a half hour after sunset to a half hour before sunrise;

(17) "Offtracking," the difference in the path of the first inside front wheel and of the last inside rear wheel as a vehicle negotiates a curve;

(18) "Oversize," a vehicle or vehicle combination that exceeds the width, height, or length limitations set forth in SDCL chapter 32-22;

(19) "Permit-issuing authority," any highway patrol trooper, highway patrol supervisor, motor carrier inspector, or highway patrol district office personnel;

(20) "Permit center," the Sisseton Port of Entry;

(21) "Permit vehicle," an oversize, overweight, or oversize and overweight motor vehicle consisting of one or more units with or without load and operating under the authority of an oversize, overweight, or oversize and overweight permit;

(22) "Side by side axles," two single axle segments with two wheels on each segment mounted in the same transverse plane or two trunnion axles mounted in the same transverse plane;

(23) "Stack mover," a self-loading unit built primarily to haul loose-stacked or baled livestock feed;

(24) "Standard width," eight-foot or eight-foot-six inches

(25) "State highway system," all highways, as defined by SDCL 31-1-5(1), administered and maintained by the Department of Transportation except for the highways on the interstate highway system;

(26) "State trunk highway system," all highways, as defined by SDCL 31-1-5(1), administered and maintained by the Department of Transportation, including all the highways on the state highway system and the interstate highway system;

(27) "Steering axle," any axle on the front of a motor vehicle that is activated by the operator to directly accomplish guidance or steerage of the motor vehicle or combination of vehicles;

(28) "Tire width," the tire section width designated by the tire manufacturer on the sidewall of the tire;

(29) "Trailer," as used in the sections dealing with longer combination vehicles, a semitrailer converted to a trailer by the use of a converter dolly;

(30) "Trip," a single directional movement of a permit vehicle from origin to destination;

(31) "Trunnion axle," two individual axles mounted in the same transverse plane, with two wheels on each axle, connected at a pivot point which allows each individual axle to oscillate in a vertical plane to provide constant and equal weight distribution on each individual axle and on each wheel;

(32) "Trunnion axle group," two or more consecutive trunnion axles that are attached to the vehicle by a weight equalizing suspension system and whose consecutive centers are more than 40 inches, but not more than 96 inches apart;

(33) "Unit," a single vehicle, with or without load, designed to operate under its own power or coupled together with another vehicle; and

(34) "Wheel," an assembly that transmits a portion of the vehicle's load to the roadway and consists of one or more tires and rims, whether power-driven or freely rotating, which are connected to an axle by means of a common hub and bearing assembly.

70:03:01:01.01. Booster axle defined. A booster axle is a unit consisting of its own frame assembly, suspension system, and one or more axles, which is attached to the rear of a vehicle through a coupling device which is capable of transmitting load to the unit's axle group. The coupling device may pivot about its vertical axis, allowing the unit to trail behind the vehicle through a turning maneuver. If the coupling device is fixed about its vertical axis, the unit's one or more axles must be self-steering.

70:03:01:02. Single-trip permit -- Procedures -- Fees. A permit-issuing authority may issue an individual single-trip permit or a book of 10 self-issuing single-trip permits that allow movement on state trunk highways of a vehicle that consists of one or more units and exceeds the size, weight, or size and weight limits in SDCL chapter 32-22.

The permit fee for an individual single-trip permit is $25. The fee for a book of 10 self-issuing single-trip permits is $250. An overweight vehicle shall be charged an additional fee of two cents for each ton or fraction of a ton that its gross weight exceeds the following weight limits, for each mile traveled on state trunk highways. This additional fee may not be less than one dollar.

The weight limits are as follows:

(1) Two axles - 40,000 pounds;

(2) Three axles - 60,000 pounds;

(3) Four axles - 80,000 pounds;

(4) Five axles - 85,000 pounds;

(5) Six axles - 90,000 pounds;

(6) Seven axles or more - 95,000 pounds.

A self-issuing single-trip permit must be validated by a permit-issuing authority before it can be used. In order to get validation, the permit holder shall contact the permit center and provide the information necessary for permit validation. If approved, the permit-issuing authority shall provide the permit holder with information to be copied on the permit by the permit holder regarding routing, permit restrictions, effective period of the permit, and validation number. The permit holder shall complete the permit and send the copy of the validated permit to the Division of Highway Patrol. The original validated permit is the permit for movement of the permit vehicle and must be carried in the permit vehicle during movement.

A single-trip permit may be issued in place of any extended period permit, LCV permit, or over 80,000 on interstate permit that is authorized in another section of this chapter. A single-trip over-dimension or overweight permit authorizes the movement of a permit vehicle for only one trip. A permit-issuing authority may grant a time extension for a single-trip permit to allow more travel time to complete a trip, if the trip as authorized by the permit is delayed due to equipment breakdown, weather conditions, highway conditions, or other moving delays. Special operating restrictions may be stated on the permit. All single-trip permits are issued subject to the provisions of this chapter.

State agencies, local subdivisions of this state or of a foreign state, and federal agencies, departments, or divisions are exempt from permit fees and additional overweight ton-mile fees.
