In consideration for receiving the iPad from Octorara Area School District, each student and his or her parent or legal guardian agrees not to sue and hereby releases, waives, discharges, holds harmless, indemnifies and defends Octorara Area School District, as well as their respective employees, personnel, staff, volunteers, agents, directors, affiliates and representatives, from any and all liability, losses, damages, claims, actions, and causes of action of every nature for any and all known or unknown, foreseen, and unforeseen, bodily or personal injuries, property damage, or other loss, whether claimed by the student, parent, legal representative or any third party, relating in any way to the use of the iPad furnished by Octorara Area School District to the student.

Overview

Octorara Area School District (OASD) is committed to preparing students to be successful citizens in a global economy. Octorara Jr./Sr. High School has implemented an iPad program for one-to-one computing, immersing our students into a technology-rich instructional environment to help ensure that our graduates are prepared for the workplace and life. Students and parents must have an understanding of the procedures and policies for this program to be successful. Please read and sign the attached student and parent/legal guardian agreement. The signed agreements establish a contract for the rules and responsibilities agreed to by the parties involved in the iPad program.

Introduction

The iPad program at Octorara has many benefits. First and foremost, this initiative will promote learning by giving one-to-one iPad access to every student in the district. Some textbooks will be digital, and many classroom teachers will be able to employ various iPad applications for homework, class work, and assessments.

As most students already use hand-held devices for communicating, we feel this initiative will stimulate student engagement as well. Students will now have access to a greater variety of learning resources, which will be especially helpful for visual, tactile, and auditory learners.

In addition, tools that are more efficient will be available to teachers. Digital learning assessments will now provide teachers with the ability to generate immediate feedback on formative and summative assessments. Further, information will be available for access in iPad drop boxes, enabling greater student and parent accessibility to lessons, grades, and assignments.

Finally, the iPad initiative will allow district technology staff to devote less time to repairing outdated equipment and more time for developing and employing instructional applications. Overall, iPads offer teachers and students the opportunity to expand instructional practices with a device that promotes 21st Century learning.

OASD Learning Goals

· Promote student learning beyond the classroom.

· Prepare students to be safe, responsible, and innovative digital citizens.

· Engage students in solving real-world problems by collaborating, communicating, and creating within a global learning community.

· Enable students to be responsible for their own learning.

· Support faculty in the development of interdisciplinary, project-based learning environments.

Deployment

Parent/legal guardian(s) will be informed of location, date and time of mandatory orientation/meeting.[4] The program and Student/Parent iPad Agreements will be explained. The parent and student must sign the agreements in order for the student to be issued an iPad.

1. Prior to students being issued an iPad:

a. Parent/legal guardian and student must attend an orientation session (mandatory)

b. Parent/legal guardian and student must sign the applicable attached agreement and OASD Acceptable Use Policy

c. Payment of annual student iPad fee, payable by cash or check made out to the Octorara Area School District

Bring Your Own Device (BYOD) Restriction

As Octorara Area School District is providing an iPad for each student at Octorara Jr./Sr. High School in order to meet the educational needs of the students, personal iPads, Smart Phones, laptops and other Internet capable devices will not be permitted for use on the school network unless preapproved and setup by a member of the technology department. Listed below are some of the major reasons for this decision.

1. 3g/4g data connections cannot be monitored or restricted by the school district and therefore web filtering cannot occur.

2. This program is based on the use of an Apple iPad 2 with the most current ios. Students may own a Droid or Windows based tablet or an Apple product of a different generation that will not work with certain required applications and/or textbooks.

3. The condition of a student’s personal device may be ill suited for day long use. Battery life varies from device to device. Students may need to use their tablet for an entire school day and therefore must have a device capable of doing that.

4. The student device may have hardware or software issues that keep it from performing properly for the educational requirements of this program.

The Program Package

1. An iPad Mini with power adapter and USB cable.

2. A comprehensive package of licensed apps

Terms of iPad Loan

1. Octorara Jr./Sr. High school will issue an iPad to each student upon compliance with the following:

a. Student and Parent/Legal Guardian Orientation session

b. A signed Student Acceptable Use Policy

c. A signed Student iPad agreement

d. A signed Parent/Legal Guardian iPad Agreement

e. Payment of annual student iPad fee[5]

2. Legal title to the property (iPad) is with Octorara Area School District. A student’s right of possession and use is limited to and conditioned upon full and complete compliance with the Board Policy – Acceptable Use of the Internet Policy #815 and other guidelines as outlined in the Student/Parent iPad Handbook.

3. Students may be subject to loss of privilege, disciplinary action and/or legal action in the event of intentional damage and/or violation of policies and guidelines as outlined in the Student/Parent iPad Handbook and the OASD Acceptable Use Policy.

4. A student’s possession of the iPad terminates no later than the last day of the school year of the student’s senior year unless there is a reason for earlier termination by the District (e.g., drop-out, expulsion or transfer to another school).

5. The iPads will be covered by an Accidental Damage Policy as explained under the section titled Damage.

6. If an iPad is damaged, a loaner iPad may be issued. We will make every effort to repair damaged iPads as soon as deductible/damage payment has been made to Octorara Area School District by check or cash. The payment can be made in District Office from 7:30 am to 3:30 pm Monday through Friday.

Loss or Theft

Theft is determined by a police report documenting “forcible” entry to a secured place containing the iPad or “forcibly taking” the iPad in any way from a student’s possession. iPads stolen on district property (i.e. High School, Junior High School, locker, cafeteria etc.) should be reported to the building principal or assistant principal immediately, who will determine if the iPad was stolen.

The parent/guardian is responsible for filing a police report if the iPad is stolen regardless of location. Additionally, it is the responsibility of the parent/guardian to report the theft to their homeowner’s insurance provider for possible reimbursement of the iPad replacement fee.

Loss is defined as an iPad reported missing by a student while it was left unattended or in an unsecured/unsupervised location. The burden is on the student to truthfully report the iPad loss and articulate the details for the principal.

1. Lost iPad must be reported to a building principal or assistant principal immediately.

2. The student or parent/legal guardian will be responsible for the total cost of the iPad in the event the lost iPad is not found. Loss is not covered by insurance. The purchase price would be the maximum cost a parent/legal guardian would be responsible for.[6]

Damage

1. OASD will provide an Accidental Damage Policy for student iPads which will cover the iPad. Accidental Damage means damage to an iPad accidental in nature.

2. If a District iPad needs repair or service, students are to report to the building principal or assistant principal. Students should not attempt on their own to repair or service District iPads. Students must present school-issued picture identification when they bring a District iPad in or pickup from repair.

3. The Accidental Damage Policy will provide coverage to repair, rebuild or replace the damaged iPad with another of like kind and quality, whichever is less. There is a deductible in order to process a claim for this protection. (This is in addition to the student fee paid originally.)[7]

4. If there are multiple instances of damage, occurring at different times during the school year, there will be a deductible due for each insurance claim. When additional claims are made by the same student for damages deemed to be due to careless or reckless possession of the iPad, a higher deductible may be assessed.

5. The student and/or the student’s parent/legal guardian shall be responsible for compensating the school district for any losses, costs or damages which are not covered by the Accidental Damage Policy. The student and/or parent/legal guardian is liable for replacement(s) costs resulting from intentional damage and/or neglect as outlined in this document. The purchase price of the iPad would be the maximum cost a parent/legal guardian would be responsible for.[8]

Repossession

OASD reserves the right to repossess the iPad at any time if the student does not fully comply with all terms of this agreement. iPads left unattended will be turned in to the I.T. Department and held for 24 hours before a student may reclaim.

Appropriation

Failure to return the property at the designated times and/or the continued use of it for non-related school purposes may be considered unlawful appropriation of Octorara Area School District’s property resulting in appropriate Administrative, civil and/or criminal action.

Modification to the One to One Program

Octorara Area School District reserves the right to revoke or modify the program or its terms at any time.

Expectation of Privacy for Student iPads

1. The iPads are considered property of Octorara Area School District and are not subject to the same privacy expectations as private property.

2. The district will not have the right or ability to remotely access the iPad’s web camera at any time.

3. While connected to the OASD network, OASD has the right to monitor the iPads in the following ways:

a. Teachers and administrators may remotely view and control student iPads while in class. This is required for effective classroom management.

b. Administrators may search the iPad for inappropriate material if they have reasonable suspicion of its existence. “Reasonable suspicion” means reasonable grounds exist that the search will uncover evidence that the student violated the law or school rules or District policies. The scope of the search must be reasonably related to the violation that justified the search. Under no circumstances will a District employee access a District iPad remotely for the purpose of this subsection
