Village President Richard Ensslin called the Board Meeting to order at 7:30 PM at the Village Hall Building.

ROLL CALL

Present: Richard Ensslin, Teri Stegemeyer, Robert Ward, William Benjamin, Walter Woloszyk, Tim Nelson, Carol Zuba, Village Administrator Rhode and Police Chief Cosgrove.

PERSONS DESIRING TO BE HEARD

Richard Mathaus, 13001 West Stark Street, issues with the taxes in the Village of Butler and how the Village is going to be able to afford a new Library moving forward. Question about the Library.

Tim Wilson,13110 West Hampton Ave., issues with the TIF amendment and the CDA.

CONSIDERATION OF MINUTES:

Motion by W. Woloszyk; second by R. Ward to approve the minutes of the October 2, 2007 Board Meeting with corrections. Motion carried 7-0.

COMMITTEE REPORT

(A) Building Board – Trustee Woloszyk

Present: Ward, Nelson and Woloszyk, also present Administrator Rhode, President Ensslin, Chief Worgull and Lt. Schlenner.

Excused:

Building Permits

Motion by T. Nelson; second by R. Ward to approve 12624 W. Cameron Ave. fence permit. Motion carried 3-0.

Motion by T. Nelson; second by R. Ward to approve 12523 W. Hampton Ave. sign permits. Motion carried 3-0.

Motion by R. Ward; second by T. Nelson to approve small deck at 12714 W. Hampton Ave. Motion carried 3-0.

Motion by Ward; second by T. Nelson to approve an Occupancy Permit for 5401 N. Park Drive, for Clean Harbors Environmental Services, Inc. The Occupancy is permitting office area. A conditional use permit will be needed for both outside storage and the use of Chemicals for storage. The conditional use permit hearing will be held November 6, 2007.

(B) Finance Committee – Trustee Stegemeyer

Present: Stegemeyer, Zuba and Benjamin

Excused:

Motion by T. Stegemeyer to approve the bills as presented for $191,857.28; second by C. Zuba. Motion carried 7-0.

Motion by T. Stegemeyer to approve the Statement of Revenues for September 2007; second by W. Benjamin. Motion carried 7-0.

(C) Library Board – Trustee Zuba

Book mobile is back in operation. All is going well at the Library.

(D) Butler Community Foundation – Trustee Stegemeyer

Met on October 8, 2007, the Foundation has made the last of their voluntary repayment of all monies spent by the Village to acquire the Clark House. The total reimbursement of the Village was $24,387.00.

The Golf outing raised $7,000. Christmas parade will be on November 30, 2007.

REPORT OF THE ADMINISTRATOR

Update on Zoning Board of Appeals met and was able to work out an alternative solution not requiring a variance.

Update on Joint Review Board, which met, and approved the TIF amendment with a 5-0 vote.

Attended workshop entitled, “Using TIF in Today’s Market”, with Trustee Nelson. Over 280 community development representatives and developers met downtown to discuss current trends and methods for working together.

Budget should be in your trustee mail boxes Friday. The First Budget Meeting will be

October 23, 2007.

(A) Motion by W. Benjamin to sell the 12808 W. Hampton property to the Friends of the Butler Library, Inc. for $98,505; seconded by W. Woloszyk. Motion failed 2-5.

Motion by C. Zuba to sell the 12808 W. Hampton Ave. property to the Friends of the Butler Library, Inc. for $43,583 with the counter offer provision recommended by the Village Attorney; second by T. Nelson. Motion carried 4-3 with Benjamin, Stegemeyer and Woloszyk in opposition.

Discussion lasted about 20 minutes relevant to the history of the property and a cost breakdown from the Village Administrator.

(B) Motion by R. Ward to approve Resolution 07-22, Amendment to the Waukesha County Street and Highway Width Map; second by C. Zuba. Motion carried 7-0.

(C) Motion by W. Woloszyk to approve Virchow Krause auditing proposal for 2008; second by T. Nelson. Motion carried 7-0.

(D) Continued discussion on the Village of Butler Sexual Offender Residency Restrictions and Child Safety. Discussion lasted about 20 minutes on various topics which included distances within the Village, legal exposure, property rights and timeframe. The Village Board will be reviewing the final draft and possibly approving Ordinance at the November 6, 2007 meeting.

(E) Motion by C. Zuba to take staff’s recommendation to increase the Parking Citation Fees from $15 to $20 starting January 1, 2008; second by T. Stegemeyer. Motion passed 7-0.

Motion by R. Ward to adjourn; second by T. Nelson. Motion carried 7-0. The meeting was adjourned at 9:15 pm.
