Listing checklists are intended to aid the listing agent and the seller in identifying common issues or problems that may effect the marketing or pricing of the property. Under Oregon law, a real estate licensee has no duty to investigate matters that are outside the scope of the real estate licensee’s expertise, including but not limited to investigation of the condition of property, the legal status of the title or the owner’s past conformance with law. Seller acknowledges this limitation on the agent’s duty to investigate and understands that the use of a checklist is not intended in any way to increase the duties of a real estate licensee beyond those established by law.

If prior a listing was terminated, cancelled or withdrawn prior to its expiration, the agent must obtain proof that the seller has terminated the prior listing in writing before listing the property. “Withdrawing” a listing form the MLS does not automatically terminate the listing agreement. Sellers should be aware that unilateral termination of a listing agreement within the term of the listing without cause may expose the seller to breach of contract claims or even claims for more than one commission. If a prior listing has not expired or been terminated by mutual agreement, these matter must be resolved prior to re- listing the property.
