The following communication, dated 13 April 2004, is circulated at the request of the delegation of Argentina.

I have the honour to enclose an authenticated copy of the resolution of the Secretariat of Industry, Trade and Small- and Medium-Sized Enterprises, Resolution No.65 of 25March2004, published in the Official Journal of 29 March 2004, which replaces Article1 of Resolution No. 826/99 of the former Ministry of the Economy and Public Works and Services, which was duly notified to the Committee on Anti-Dumping Practices and the Committee on Subsidies and Countervailing Measures (G/ADP/N/1/ARG/1/Suppl.4 – G/SCM/N/1/ARG/1/Suppl.4).

Please circulate Resolution No. 65/2004 of the Secretariat of Industry, Trade and Small- and Medium-Sized Enterprises, in accordance with Article 18.5 of the Anti-Dumping Agreement and Article25.12 of the Agreement on Subsidies and Countervailing Measures.

HAVING REGARD TO File No. S01:0013410/2004 of the Registry of the Ministry of Economy and Production and

WHEREAS:

Decree No. 1,326 of 10 November 1998 contains the rules and regulations for effective implementation of the agreements on anti-dumping and countervailing duty regimes contained in LawNo. 24,425, on International Trade Agreements (GATT).

Chapter 7 of the above-mentioned decree provides for the possibility of requesting a review of measures in force prior to expiry of the period of validity.

Consequently, the former Secretariat of Industry, Trade and Mining issued Resolution No.826 of 3November1999 regulating the requirements for submitting a request for a final review owing to expiry of the period of validity, and also the requisite time-frame.

Under the period established in Article1 of the Resolution mentioned in the foregoing paragraph it is appropriate to report, prior to that period, the date of expiry for submitting an application for final review owing to expiry of the period of validity.

Accordingly, it is appropriate to replace Article1 of Resolution No.826 of 3November1999 of the former Secretariat of Industry, Trade and Mining.

The Legal Department for Industry, Trade and Mining, of the Directorate-General of Legal Affairs of the Ministry of Economy and Production, has acted appropriately.

The present resolution is issued under the powers conferred by Article3 of Decree No.1,326 of 10November1998 and Decree No.1,283 of 24May2003.

Accordingly,

THE SECRETARY OF INDUSTRY, TRADE AND SMALL- AND MEDIUM-SIZED ENTERPRISES

RESOLVES

ARTICLE 1. Article 1 of Resolution No.826 of 3November1999 of the former Secretariat of Industry, Trade and Mining is hereby replaced as follows:

"ARTICLE 1. A request for final review of an anti-dumping or countervailing duty owing to the expiry of its period of validity may be submitted by or on behalf of the domestic industry to the Office of the Incoming Communications and Notifications Directorate of this Secretariat, located at Avenida JulioA Roca651, Ground Floor, Sectors11 and12, no later than nine (9) months prior to the end of the period of imposition of the anti-dumping or countervailing duty whose termination the applicant wishes to prevent.

The Implementing Authority shall report on the expiry of the period for submitting a request for final review owing to expiry of the period of validity no later than in the month preceding the nine (9) months before the end of the period for which the anti-dumping or countervailing duty was imposed.

The Sub-Secretariat of Trade Policy and Management, as part of this Secretariat, shall list every six months in the Official Journal the measures that are to expire, as indicated in Annex I, which forms an integral part of this resolution".

ARTICLE 2. This resolution shall enter into force on the day following publication in the Official Journal.

ARTICLE 3. For communication, publication and transmittal to the National Directorate of Official Records.
