Florida Health Information Exchange: Advertising and Sponsorship Criteria

The Florida HIE is now (June 1, 2013) accepting advertising for placement on the website. There is no charge for placement of an ad for a limited time (through October 1, 2013). Advertisements will be accepted on a first come basis consistent with the advertising and sponsorship criteria posted under Resources on this website (as below). After October 1, 2013, advertising will be accepted upon payment of a fee according to the advertising price list posted on this website. The availability of free advertising for public service announcements after October 1, 2013 will be determined by the Agency for Health Care Administration.

Advertising that may be allowed on the service, provided certain criteria are met:

· Corporate image advertising or corporate sponsorship

· Professional associations related to health care

· Florida HIE access services (limited to Florida HIE participants)

Advertising that is prohibited on the service includes:

· Health facilities regulated by the Agency for Health Care Administration

· Over-the-counter medications

· Prescription drugs

· Medical services, products or devices

· Fitness products or services

· Insurance policies

· Consumer products related to health

· On-line pharmacies

· Legal services (including malpractice)

· Alcohol, tobacco products, firearms and weapons, fireworks

· Pornography

· Gambling and lottery, sweepstakes

· Political ads, social cause ads, religious ads

· Competitors

· Comparative advertising or mention of competitive brand names within an ad banner

· The simulation of news or an emergency

· Fraudulent, deceptive, illicit or misleading material

· Illegal products or advertising for services in violation of applicable laws in any way

· Material that misrepresents, ridicules, discriminates (real or implied) or attacks an individual or group on the basis of age, national origin, race religion, gender, sexual orientation, marital status, disability or any other status deemed inappropriate by Harris Corporation or the Agency for Health Care Administration

Advertising formats that are prohibited on the service include:

· Pop-ups and floating ads or surveys

· Media messages or imagery that strobe or flash

· Ads that have forms within them to collect personally identifiable information while a visitor is on Florida HIE website.

· Advertisements that link the end user to sites other than the third-party advertiser’s site or to relevant sponsored content area on the Florida HIE website.

· Advertising units that mimic computer functions or deceptively indicate a computer or other function that would be reasonable to the average user to assume as a reason to click that unit

Advertising and sponsorship criteria that must be met to allow the company to advertise or sponsor include:

· No implication of endorsement by Harris Corporation or the Agency for Health Care Administration of product or advertiser may be made.

· Harris Corporation and the Agency for Health Care Administration retain final approval of all sponsor and product messages, banners and advertising copy as well as linked advertising on the third-party advertiser’s site. This includes verification of advertisement content and placement before it is produced on the site.

· The advertisement, advertising icons and company logos must be displayed in such a way that they clearly are not part of the Florida HIE website content.

· Advertiser represents and warrants that all advertisements they advertise are compliant with all applicable laws, rules, and regulations in the U.S.

· Advertisers and agencies must not collect any personally identifiable information from the Florida HIE website visitors or place any cookies, applets or other such files — if those files transmit any personally identifiable information to the advertisers or agencies — on computers of Florida HIE website visitors who do not visit advertisers' sites by clicking on their ad banners.

· Advertisers and sponsors have no influence over or input in our product development. They also have no influence over the listing of responses to search engine results. Neither advertisers nor sponsors can buy priority listings on our search engine.

These guidelines are intended to provide general guidance. They are not inclusive or exhaustive and are subject to change at the discretion of the Harris Corporation with approval of the Agency for Health Care Administration at any time. Harris Corporation and the Agency for Health Care Administration reserve the right to reject, cancel or remove at any time any advertisement from Florida HIE website. In such a case, Harris Corporation will provide prompt notice to the advertiser indicating that the advertisement is not consistent with Florida HIE advertising policies.
