ARTICLE II ‑ PROPERTY-SPECIFIC PROVISIONS

#901 ‑ PROPERTY-SPECIFIC REGULATIONS

(See Appendix B for a list of properties without property-specific regulations, to which only restrictions in #900 apply)

A. On those properties requiring reservations, reservations may be made by calling 1-800-846-9453. Reservations are not accepted more than 14 days in advance of the hunt date, nor after 12:00 noon on the day before the hunt date, or Friday at 12:00 noon for Sundays and holidays falling on Monday. Hunters who wish to cancel a reservation must do so no later than 12:00 noon on the day before the hunt date. Failure to hunt a reserved area without prior cancellation, or follow check station procedures, may cause forfeiture of the privilege to make reservations for the remainder of the hunting season. Hunters are limited to a maximum of one reservation per hunt date and one reservation per phone call. Reservations are not transferable. The individual named on the reservation must be at the property on the day of the hunt and be a licensed hunter for the species to be hunted.

B. In addition to or in place of those restrictions listed in regulation #900, the following provisions or restrictions apply:

117. Jumbo Reservoir (Julesburg) State Wildlife Area ‑ Logan and Sedgwick Counties

a. Any person age 19 through 64 must possess an annual Jumbo Reservoir/Prewitt Reservoir access permit in order to access this property, except that any person who possesses a current and valid Colorado annual hunting or fishing license is exempt from this permit requirement. Permits shall cost $36, and are valid from April 1 - March 31 annually. Permits are available from any Total Licensing System vendor.

ab. Except as provided in subsection g below, boating is prohibited from October 1 through the last day of the regular goose season, except for craft propelled by hand may be used to set and pick up decoys and retrieve downed waterfowl.

bc. Fishing is restricted to the two south dams and the bank around the outlet tower from October 1 through the last day of the migratory waterfowl season. Ice fishing during this time period is restricted to within 50 yards of the two south dams, or within 50 yards of the outlet tower.

cd. Boats are prohibited within 50 feet of the outlet structure.

de. Hunting is prohibited from the frozen surface of the lake.

ef. The number of vehicles on the property is limited to 250.

fg. Waterskiing is prohibited before 10:00 a.m. and after 7:00 p.m. on Friday, Saturday, Sunday and Monday of the Memorial Day weekend.

gh. Hunting from floating devices is allowed from the opening day of the regular Eastern Plains duck season until the opening day of the dark goose season, as follows:

1. To hunt from a floating device, a reservation is required. Reservations may be made in accordance with #901.A of these regulations. Three reservations are available for waterfowl hunting from vessels on Jumbo Reservoir. Boat hunting is prohibited beginning the first day of the regular dark goose season. Hunters with boat hunting reservations are required to call the reservation line two days before the scheduled hunt to confirm ice conditions. Only boat hunters with a reservation are exempt from the November 1 boat closure.

2. Hunting from floating devices is allowed only on Saturdays, Sundays, Wednesdays, Columbus Day (observed), Veterans’ Day (observed), Thanksgiving Day, Christmas Day, New Year’s Day and Martin Luther King Jr. Day.

3. All persons hunting from floating devices must leave the surface of the reservoir by 2:00 p.m.

4. Boat hunters are prohibited from hunting within 150 yards of other vessels and hunters on shore.

173. Prewitt Reservoir State Wildlife Area ‑ Logan and Washington Counties

a. Any person age 19 through 64 must possess an annual Jumbo Reservoir/Prewitt Reservoir access permit in order to access this property, except that any person who possesses a current and valid Colorado annual hunting or fishing license is exempt from this permit requirement. Permits shall cost $36, and are valid from April 1 - March 31 annually. Permits are available from any Total Licensing System vendor.

ab. Boating is prohibited in a manner that creates a white water wake.

bc. Boating is prohibited from October 1 through the last day of the regular goose season, except for craft propelled by hand may be used to set and pick up decoys and retrieve downed waterfowl.

cd. Camping and fires are prohibited as posted to protect the property use and livestock of the lessor.

de. Fishing is restricted to the dam from October 1 through the last day of the migratory waterfowl season. During this time period, ice fishing is restricted to within 50 yards of the dam.

ef. The number of vehicles on the property is limited to 250.

fg. Waterskiing is prohibited.

gh. Sailing and windsurfing are prohibited, except during the months of July and August.

hi. Glass beverage containers are prohibited.

ij. Hunting is prohibited as posted, to protect resting waterfowl, depending on water levels.

jk. Hunting is prohibited from any floating device.

Chapter 9 - Division Properties

Basis and Purpose:

Non-wildlife recreation makes up the majority of the activities at Jumbo Reservoir and Prewitt Reservoir State Wildlife Areas (SWAs) from mid-May through the end of August each summer. Use at these reservoirs has increased dramatically since the requirement to possess a habitat stamp when entering or using a SWA was eliminated. Many of the law enforcement issues occur at night with large groups of people that are camping at the SWAs. During the late 1980s an experimental use fee permit system was incorporated on Jumbo and Prewitt State Wildlife Areas. These wildlife areas were and are currently still allowing many uses similar to the state parks, which are charging user fees in the form of daily use passes, annual use passes, and camping fees. The Division of Wildlife and its employees have been mandated with managing, protecting and preserving the state’s wildlife. To do this, budgets and priority work packages have been set to fulfill the mandate. The majority of the activities associated with these SWAs are now non-wildlife related activities. Most parks have designated staff with sole responsibility of patrolling that area along with a budget and equipment to support those activities. Nearby North Sterling State Park operates on an annual budget of roughly $250,000 and has a full time staff of three as well as an increased seasonal staff, whose sole responsibility is North Sterling State Park. In an effort to help mitigate the issues on these SWAs while still allowing for non-wildlife related recreation, these regulations establish an annual user permit. This measure is intended to help bring the non-wildlife related usage of these SWAs closer to compliance with the intent of the State Wildlife Area program.

The statutory authority for these regulations can be found in § 24-4-103, C.R.S., and the state Wildlife Act, §§ 33-1-101 to 33-6-209, C.R.S., specifically including, but not limited to: §§ 33-1-101, 102, 104, 105, 106-108, 115, and 121; §§ 33-2-104, 105, 106, and 107; § 33-3-104; §§ 33-4-101, 102, 102.5, 103, 116, 116.5, 117, and 119; § 33-5.5-102; and §§ 33-6-107, 109, 112, 113, 113.5, 114, 114.5, 117, 119, 120, 121, 124, 127, 128, 129, 131, 205, 206, 207, and 208.

EFFECTIVE DATE - THESE REGULATIONS SHALL BECOME EFFECTIVE MAY 1, 2011 AND SHALL REMAIN IN FULL FORCE AND EFFECT UNTIL REPEALED, AMENDED OR SUPERSEDED.
