II. STATEMENT OF WORK

A.  INTENT

It is the intent of these specifications, terms and conditions to describe appropriate and compatible chemicals required by the Alameda County Flood Control and Water Conservation District (Zone 7) for use in the water purification process.

The County intends to award a three-year contract (with option to renew) to the bidder(s) selected as the lowest responsible bidder(s) whose response meets the County’s requirements.

B.  SCOPE

The Alameda County Flood Control and Water Conservation District (Zone 7) was created by area voters as one of ten (10) active water zones. It is a public agency established in 1949 to address water supply, drainage, and flood control matters in the County. A seven-member Board of Directors, elected at-large, governs Zone 7. The service area encompasses all of eastern Alameda County.

Although the area’s approximately 200,000 residents may not have direct contact with Zone 7, most of the water piped to their homes is treated and sold by Zone 7 to local retailers (the California Water Service Company, the cities of Livermore and Pleasanton and the Dublin San Ramon Services District). Zone 7 also distributes untreated water to local agriculture and golf courses who are active participants in the Water Quality Management Program.

C.  VENDOR QUALIFICATIONS

Vendor minimum qualification criteria include, but are not limited to, the following:

1.  Vendor will have been in the business of supplying water treatment chemicals to agencies similar to Zone 7 for the past three (3) years.

2.  Vendor will supply all means for the transportation of the requested chemicals to the locations designated by Zone 7.

3.  Vendor will have all required permits and licenses, if any, required for the handling, sales and transportation of the requested chemicals.

D.  SPECIFIC REQUIREMENTS – GENERAL

Vendor will supply all chemicals in accordance with applicable American Water Works Association (AWWA) Standards. In accordance with Title 22, Chapter 18 of the California Code of Regulations, each supplier shall submit written documentation that their product has been tested, certified, and meets the requirements of the American National Standards Institute/ National Sanitation Foundation International 60 (ANSI/NSF International 60).

1.  Acceptance/Rejection by Zone 7

a.  Persistent clogging or quality problems may void any purchase agreement that results from this RFQ.

b.  Zone 7 reserves the right to subject samples of the chemical collected during delivery (Section d. of the individual chemical) to analysis to ensure the chemical delivered meets Zone 7 specifications. If, in the opinion of Zone 7, there is a necessity to remove the chemical, it shall be the Vendor's responsibility to remove all rejected chemicals within 24 hours of being notified.

c.  The Vendor will remove and replace any and all chemical contaminated by a delivered load that fails to meet specifications without additional cost to Zone 7, or the chemical shall be removed by Zone 7 and the cost for removal and disposal shall be billed to the Vendor. Cost to clean the chemical storage tank and disposal of the material will be the responsibility of the Vendor. No charges will be made for delivered material that is rejected.

d.  Any lot, as tested by Zone 7, which fails to comply with Zone 7 specifications will constitute grounds for rejection of that lot. Multiple rejections will constitute grounds for termination of the contract.

2.  Delivery

Specific delivery requirements for individual chemicals are described under Section E. Specific Requirements – Chemicals. All deliveries must comply with the following:

a.  Weight Certificate: Prior to unloading, the Vendor will submit a weight certificate from a certified weigh station to the operator receiving and accepting delivery.

b.  Zone 7 does not supply pressurized air for chemical deliveries.

3.  Condition of Cargo Trailers

a.  All cargo trailers and appurtenant valves used for the delivery of chemicals under this agreement shall be in good mechanical order and shall be in full compliance with the applicable requirements of the Hazardous Materials Regulations of the Department of Transportation, Code of Federal Regulations, as currently issued.

b.  All appurtenant valves, pumps, and discharge hoses used for the delivery of chemicals shall be clean and free from contaminating material, including, but not limited to, defoaming agents. If off-loading equipment is not properly cleaned, this will constitute a reason for rejection of the load.

4.  Safety Requirements & Training

a.  Truck drivers will have received appropriate training and shall wear appropriate personal protective equipment as required by the California Occupational Safety and Health Act when unloading chemicals.

b.  The vendor will furnish a minimum of four copies to Zone 7 of the Material Safety Data Sheet (MSDS) for the product prior to initial delivery. An equal number of copies are required to be transmitted Zone 7, as soon as they are available if any changes, additions or deletions occur. Failure to comply may result in cancellation of this agreement.

c.  Truck drivers must check in with the Plant Operator at each site, receive site orientation from the operator, and acknowledge having received such orientation before beginning the unloading operation.

d.  Truck drivers shall have received appropriate training prior to making chemical deliveries to Zone 7. The Vendor shall provide an electronic record of training of its drivers to the County on an annual basis.

5.  Spillage: Zone 7 has a "zero leakage" policy for chemical transfer operations.

a.  Vendor will provide equipment and training of truck drivers in an effort to minimize the potential for spillage during connection and disconnection of hoses, and during the transfer of chemical.

b.  In the event of leakage or spillage, it will be the Vendor's responsibility to effect immediate containment, clean-up, disposal, and restoration activities in accordance with applicable laws and regulations and subject to Zone 7’s satisfaction. All material associated with such clean-up operations such as spent absorbent will be removed by the Vendor.

c.  Vendor will be notified promptly of any spillage which, in the opinion of Zone 7, is inadequately cleaned up by Vendor personnel. Any spillage inadequately cleaned up within four hours of notification or, at the discretion of Zone 7, any spillage that requires immediate clean up exceeding the abilities/equipment of the driver will be cleaned up by Zone 7. The Vendor will be responsible for reimbursing Zone 7 for the costs incurred, including fines or penalties which may be imposed by regulating authorities.

d.  Zone 7's chemical delivery sites do not have facilities for washing down Vendor equipment. Hoses, valves, and other equipment used by the truck driver in delivering the chemical will not be washed at Zone 7 facilities.
