Minutes approved. Mark Novitski made the motion, __________ seconded.
4. Staff Reports
a. F inancial update
Lori Borman provided the financial statement (attached).
It was again stated by the Lee County attorney the CRSA ordinance stated funds are to be used for Capital Improvement of Corkscrew Rd
It was also discussed the CRSA is projected to end 30 Sep 2015. This may or may not be a mute point. Since the CRSA is within the city limits of the Village of Estero, the village, upon incorporation, would have the option of accepting or rejecting the transfer. All in attendance believedif the Village of Estero would not accept a known liability.

5. Discussion of Recommendation to Sunshine Sunset, Terminate the existence of the CRSA December 31, 2014

A lengthy discussion was held where each member present voiced their opinions and concerns. Lee Co legal reminded us the ordnance that established the CRSA had a termination date of 30 Sep 2015.
A motion was made by Jim Bosch to sunset the CRSA effective 31 Dec 2014 and amended by Mike Elgin
The Motion was seconded by Mark Novitski and discussion followed:
Board members also asked questions to staff and legal representative. It was noted that only small numbers of permits are being issued in the next 12 months with the preserve will be built out by Jan 2015 and a few lots remain in Wildcat Run. CRSA fees are collected when the permit is pulled.
Further discuss was held to understand who had ownership of Corkscrew Rd and who had ownership of CRSA funds.
Jim Bosch was concerned that no liability come from the county to the new Village of Estero (if the incorporation vote is approved).
Mike Elgin commented on the Lee County definition of a “fringe area” in the early 1990’s and Corkscrew Rd no longer meets that definition
More discussion centered on dissolution of the CRSA and collected any remaining funds due from developers. This discussion included should there be an interlocal agreement between Lee County and the new Village of Estero (if Estero becomes incorporated) to collect remaining funds due the CSRA.
Legal advised only funds can be collected if there is a CSRA, and an ordnance establishing the CRSA
Mark Novitski asked the question if the Lee Co BOCC could establish a new CRSA and incorporate Wild Blue and Corkscrew Shores. Lee co Staff stated yes, but the original Corkscrew Rd CRSA was voluntarily joined by the 8 developers, and there was no requirement to join, and this would be true for any new CRSA.
Mark Novitski restated the motion:
“Recommend to the Lee County Board of County Commissioners:
1. Direct staff to negotiate with Cypress Shadows and Fl Development (Stock) to pay down liability with current CRSA funds
2. Sunset the CRSA effective Sep 30, 2015 or earlier if funds collected equal debts owed
3. Direct staff to investigate inter local agreements to continue to collect monies due the CRSA from the period Jan 01, 2015 thru Sep 30, 2015 if necessary
4. Dismiss the CRSA board effective Dec 31, 2014
5. Encourage Lee County staff to continue to work with residents, organizations, and local officials to address the safety concerns on Corkscrew Rd from Alico west to Ben Hill Griffith”

Lou Frattarelli, Sal Dassaro, and Mark Novitski each spoke on the safety issues of Corkscrew Rd between Wildcat Run eastbound to Alico Rd.
Mark Novitski stated he spoke at Lee County Metropolitan Planning Organization (MPO), Lee County Technical ____ Committee (TAC) and Citizen Advisory Committee (CAC) meetings and will continue to do so in the coming months.
