(A) Strike out what is not Applicable.
1. I am a person resident of India, within the meaning of the Foreign Exchange Management Act 1999 (“the Act”).
2. I am a person not resident in India within the meaning of the Act and, therefore, whatever monies I acquire in India, out of the activity of owning and racing horses in India shall be received by me only in India and in Indian Rupees from the Club and I shall not remit such monies outside India without the prior written permission of the Reserve Bank of India.
(B)
1. I note that if this form is incomplete, it will be returned to me and may cause an inordinate delay. As such, I am advised to see that all the required information is clearly stated. If at a later date, the Stewards find that any of the above particulars furnished by me are incorrect, they will be at liberty to take any action against me that they may deem necessary under the Rules of Racing and to cancel the ownership of the horse/s forthwith.
2. I confirm that I am bound by the Rules of Racing, notifications, by-laws and all rules of RWITC Ltd., prescribed from time to time, and in particular Rule 41(n) relating to the payment of the basic training fees to trainers and dues of the Club and confirm to be bound by the decisions of the Stewards of the aforesaid Club.
3. My husband/Wife (as the case may be) is approved as owner, I agree that in the event of the Stewards taking action against him/her, it would be open for the Stewards to inquire into my ownership and, at their discretion, to either revoke my approval or prohibit the transfer of horses from such person to me.
4. I am fully aware as to the cost of maintaining and racing a horse and the abovementioned particulars as stated by me are correct in every respect and no other persons have any interest, financial or otherwise, in my share in the abovementioned horse/s.
5. I hereby consent and undertake to be bound by the Articles of Association, Rules of Racing, Notification, bye-laws, other rules and regulation etc. of the Club which are in force from time to time, including without limitation, the provisions relating to the exclusive jurisdiction of Mumbai Courts only.
