JOINT PETITION FOR DISSOLUTION OF MARRIAGE

Petitioners, ______, and ______, bring the following Joint Petition for Dissolution of Marriage pursuant to IMDMA §403(b):

1. ______is ______years of age, resides at ______, ______, Illinois 60__ , and has been a resident of the State of Illinois for ______years.

2. ______is ______years of age, resides at ______, ______, Illinois 60_____ , and has been a resident of the State of Illinois for ______years.

3. ______and ______were married on ______, ____ , in ______, ______, and the marriage was registered in ______County, ______. ______and ______lived together as husband and wife from the time of the marriage until on or about ______, ____ . They have been separated since that time, except for a period of attempted reconciliation, as is more fully set forth in paragraph 6 below.

4.1 No petition for dissolution of the parties' marriage is pending in any other county or state.

5. ______and ______are now residents of the State of Illinois, were residents of the State of Illinois at the time this action was commenced, and the residence has been maintained for more than ninety (90) days next preceding the commencement of this action. ______and ______reside in ______County, Illinois. The jurisdictional requirements of the Illinois Marriage and Dissolution of Marriage Act therefore exist, and there exist grounds for the dissolution of the marriage of the parties.

6. ______and ______separated on or about ______, 20__ . Since the parties separated on or about ______, 20__ , they have not cohabited, except during the period from on or about ______, 20__ until on or about ______, 20__ during which time they attempted in good faith to reconcile pursuant to a written agreement, and during which time they participated in marital counseling with their minister. The period of cohabitation from on or about ______, 20__ until on or about ______, 20__ is therefore included in the period of separation beginning on or about ______, 20__ , pursuant to IMDMA §401(a)(2).

7. The spouses have lived separate and apart for a continuous period in excess of six months, and irreconcilable differences have caused an irretrievable breakdown of the marriage. Efforts at reconciliation have failed, and future efforts at reconciliation would be impracticable and not in the best interests of the family. The parties have waived in writing the requirement that they live separate and apart for more than two years, and each has stated under oath that they have lived separate and apart for longer than six months.

8. ______and ______have entered into a signed Settlement Agreement, which Agreement settles all of the issues in dispute between the parties.

WHEREFORE, ______and ______pray as follows:

A. A Judgment for the dissolution of the marriage of the parties be entered in accordance with the statute.

B. The Court approve the Settlement Agreement of the parties and incorporate the Settlement Agreement into a Judgment of Dissolution of Marriage.

C. ______and ______be granted such other and further relief as may be appropriate under the evidence and circumstances.
