LAND EXCHANGE PROCESS

(385:25-1-41. Procedure for Exchanging Land)

------- Exchange Applicant (Exchangee) meets with CLO to determine locations, discuss procedures and

preliminary discussion on possible private exchange properties.

------- Written Request for Exchange Reviewed and Acknowledged

1-2 weeks

------- Choose exchange property(s) and assemble information need for appraisals

4-12 weeks

------- Appraisal Packet to Appraisers from CLO (385:30-1-4. Appraisal)

3-8 weeks Three (3) independent appraisers

One (1) appointed by CLO

One (1) appointed by exchange applicant

One (1) chosen by the 2 appointed appraisers.

Appraisers will submit a consensus appraisal report with one value for each property appraised.

------- Appraisal reviewed by CLO and Exchangee

1-2 weeks Recommendation for exchange and other requirements determined

------- Acquire title information for private land to be exchanged.

1-8 weeks Applicant to provide an abstract of title for examination by CLO

Obtain good and sufficient title insurance

Conduct environmental reviews

Verify survey, if required

CLO will provide applicant an official certificate of record for property

(CLO does not warrant title)

------- Notice of Exchange Approval to Exchangee

1-2 weeks Letter sent to exchange

Letter of acceptance received at CLO

------- Agreement letter to Applicant

1-2 weeks Letter sent to applicant

------- Prepare Exchange documents

------- Commissioners Agenda to Approve Exchange

1-4 weeks Issue Patent, patent is signed by Commissioners

------- Closing
