TO AMEND ACT 1377 OF 1968, AS AMENDED, RELATING TO THE ISSUANCE OF STATE CAPITAL IMPROVEMENT BONDS, SO AS TO AUTHORIZE ADDITIONAL PROJECTS AND CONFORM THE AGGREGATE PRINCIPAL INDEBTEDNESS AMOUNT TO THE ADDITIONAL AMOUNTS AUTHORIZED HEREBY,AND TO PROVIDE THAT THE PROVISIONS OF SECTION 27105, CODE OF LAWS OF SOUTH CAROLINA, 1976, DO NOT APPLY TO THE PROVISIONS OF THIS ACT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION2.Section 4 of Act 1377 of 1968, as last amended by Act 1 of 2001, is further amended to read:

“Section4.The aggregate principal indebtedness on account of bonds issued pursuant to this act may not exceed $2,583,904,475$3,082,129,475. The limitation imposed by the provisions of the section does not apply to bonds issued on behalf of the Mental Health Commission as provided in Acts 1276 and 1272 of 1970 or to bonds issued on behalf of the Commission on Mental Retardation as provided in Act 1087 of 1970 or to bonds issued on behalf of the South Carolina Fire Academy. The limitation imposed by the provisions of this section is not considered to be an obligation of the contract made between the State and holders of bonds issued pursuant to this act, and the limitation imposed by the provisions of this section may be enlarged by acts amending it or reduced by the application of the Capital Reserve Fund or by amendments of this act. Within these limitations state capital improvement bonds may be issued under the conditions prescribed by this act.”

SECTION3.Notwithstanding any other provision of law, the provisions contained in Section 27105 of the 1976 Code do not apply to the provisions contained in this act.

SECTION4.The funds authorized pursuant to SECTION 1 for the State Board for Technical and Comprehensive Education for Critical Maintenance and Capital Needs must be allocated by the South Carolina Technical College System for the purpose of funding critical maintenance and capital needs at the respective institutions. Eligible school projects shall include: (a) health and safety upgrades; (b) technology upgrades inside school facilities; (c) upgrades associated with career and technology education programs; and (d) deferred maintenance needs as described in the school’s capital improvement plan. For purposes of this section, school projects do not include new equipment or new construction unless deemed critical by the System.

The South Carolina Technical College System shall develop and maintain an application process for the technical schools to request funding for qualified school projects and establish policies, procedures, and priorities for the making of grants pursuant to this section. Upon receipt of applications pursuant to the application process adopted by the System, the System shall prioritize the eligible projects with the greatest need and shall submit a list of recommended grant awards to the South Carolina State Board for Technical and Comprehensive Education Board. Grants must be awarded upon an affirmative vote of the State.

The financial assistance provided to technical schools pursuant to this section must be used for the eligible school project. The System is responsible for establishing policies and procedures to ensure that funds are expended in a manner consistent with this section.

By August 1, 2018, the System shall submit a report detailing the policies, procedures, and priorities of the awards made for critical maintenance and capital need for each technical school to the Governor, the Chairman of the Senate Finance Committee, and the Chairman of the House Ways and Means Committee.

SECTION5.Funds for the projects authorized in SECTION 1 may not be released until January 1, 2018.

SECTION6.This act takes effect upon approval by the Governor.
