TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61180 SO AS TO REQUIRE A COUNTY OR MUNICIPALITY THAT OWNS AN OFFSTREET PARKING FACILITY TO ASSESS A FIFTY CENT SURCHARGE ON EACH CUSTOMER USING THE FACILITY, AND TO CREDIT THE REVENUE TO THE STATE HIGHWAY FUND TO BE USED EXCLUSIVELY FOR ROAD AND BRIDGE REPAIR AND IMPROVEMENT, AND FOR MASS TRANSIT PROJECTS; AND BY ADDING SECTION 551110 SO AS TO REQUIRE AN AIRPORT DISTRICT OR AVIATION AUTHORITY IN THIS STATE THAT OWNS AN OFFSTREET PARKING FACILITY TO ASSESS A FIFTY CENT SURCHARGE ON ALL CUSTOMERS USING THE FACILITY, AND TO CREDIT THE REVENUE TO THE STATE HIGHWAY FUND TO BE USED EXCLUSIVELY FOR ROAD AND BRIDGE REPAIR AND IMPROVEMENT, AND FOR MASS TRANSIT PROJECTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION1.Article 1, Chapter 1, Title 6 of the 1976 Code is amended by adding:
“Section 61180.A county or municipality that owns an offstreet parking facility, and charges customers to park in the facility, must assess a fifty cent surcharge on each customer using the facility for each occurrence. The revenue generated pursuant to this section, must be remitted to the State Treasurer and credited to the State Highway Fund to be used exclusively for road and bridge repair and improvement, and for mass transit projects. For purposes of this section, ‘offstreet parking facility’ has the same meaning as provided in Section 52920.”
SECTION2.Chapter 1, Title 55 of the 1976 Code is amended by adding:
“Section 551110.An airport district or aviation authority in this State, that owns an offstreet parking facility for the benefit of the airport, and charges customers to park in the facility, must assess a fifty cent surcharge on all customers using the facility for each occurrence. The revenue generated pursuant to this section, must be remitted to the State Treasurer and credited to the State Highway Fund to be used exclusively for road and bridge repair and improvement, and for mass transit projects. For purposes of this section, ‘offstreet parking facility’ has the same meaning as provided in Section 52920.”
SECTION3.This act takes effect July 1, 2017.
