Please complete a booking form for each person you would like to register onto the course. There are a limited number of places available for each course, please book early to avoid disappointment.

Course Fees must be paid for in advance of the training date, failure to pay may result in the delegate being unable to attend. Notification of cancellation or postponement must be made in writing a minimum of 28 days before the course date; failure to do so will result in the course fee remaining payable in full.

Please be aware that written examination for the P901 is independently assessed by BOHS. Examination results will be sent directly from BOHS to the address provided by the candidate on the examination papers. RPS cannot issue pass/fail information or course certification.

STANDARD TERMS AND CONDITIONS FOR HSED TRAINING

The following standard conditions of contract apply to all training carried out by The Environmental Consultancy Limited (Registered number 01470149), a wholly-owned subsidiary of RPS Group PLC, trading as RPS, RPS Health, Safety and Environment and RPS Consultants,
1. Unless specifically agreed in writing to the contrary, the Client is the person, company, authority or other body to whom our proposal /fee quotation is addressed. The parties to the contract are you the Client and us, The Environmental Consultancy Limited.

2. These terms shall not be varied or waived unless expressly agreed in writing by the parties. Subject to any such agreement, these terms have precedence over any others contained in other documents or correspondence exchanged between us.

3. By booking onto any one of our training courses you agree to accept and abide by these terms and conditions.

4. Subject to any contrary arrangement set out in our proposal/fee quotation, we reserve the right to cancel or alter a course, or the fee for a course, at any time up to a booking being taken.

5. VAT will be applied to qualifying services and items at the standard rate on all invoices rendered.

6. Where the course is to be provided on your premises you agree to provide an adequate training room for the number of delegates to be trained. Where the course requires an examination, you must ensure the room is suitably sized to accommodate an exam room layout. In the event of you failing to provide the foregoing the exam may be cancelled and any related costs that you have incurred will be for your account. We will provide all audio and visual equipment; you must provide a screen or wall to project on to, along with suitable power points for the tutor’s use, unless otherwise agreed. Where the booked course requires practical assessment, you must supply all tools and equipment as instructed by us to ensure the practical assessment can be carried out in accordance with the current guidance for that assessment. Any failure on your part to provide anything, as referred to in this clause, may lead us to give you notice cancelling the course as a default cancellation (see next clause).

7. Where these terms refer to a “default cancellation”there will be no refund and if not paid the full course fees remain payable by the applicable time they would otherwise have been due and in any case no later than 14 days after notice of cancellation is given.

8. Course fees include tuition by our nominated tutor, course notes, and all incidental expenses incurred by us such as overnight expenses, travel expenses and subsistence.

9. Invoices will be rendered in advance of the course, unless stated otherwise in the proposal/fee quotation. Payment in full is due on the earlier of (1)14 days from the date of receipt of the invoice and (2) the date of the course. Any failure to pay prior to the start of the course shall allow us to cancel the course as a default cancellation.

10. We reserve the right at any time prior to the start of the course to cancel it where:

a.in relation to a course not being held at your premises, there are in our view insufficient numbers attending to make it viable; or

b.we are not able to hold the course due to force majeure as referred to below;

and in such circumstances we will offer you either (at our option) a place on a matching future course or provide a full refund of any course fees paid to us. We will not be liable for any costs or loss you incur as a result of any such cancellation (including, but not limited to, travel and accommodation costs).

11. In the event that you wish to cancel a booking other than a booking through a website, then the following will apply;-
a) If you notify us in writing more than 14 days before the scheduled course date you will receive a full refund of the course fee paid
b) If you notify us in writing less than 14 days before the scheduled course date it will be treated as a default cancellation.

12. In the event that you wish to cancel a booking made through a website then, whatever the period between the time of booking and the course date, it will be treated as a default cancellation.

13. The copyright in course notes and reference materials belongs to us. Course notes and reference materials are provided for the personal use of the delegate. The sharing of course materials by print, press, photography, email, blogs, internet or any digital transfer medium is strictly prohibited.

14. In repeating any course we reserve the right to make amendments to the course materials or content, from those previously used, without notice.

15. We reserve the right to substitute tutors without prior notification.

16. We reserve the right to remove any delegate from our courses at our own discretion for reasons of anti-social behaviour, health and safety, where the delegate clearly fails to meet the standard reasonably to be expected of delegates undertaking the particular course, or for any other activity or behaviour deemed as inappropriate or unsafe. In such cases the delegate’s place will be cancelled without notice and treated as a default cancellation.

17. Courses are in their nature of general content for improving skills, knowledge and awareness are not intended to analyse or investigate or address actual specific workplace issues or problems. No information given or discussion during a course, and no follow on communication after a course (unless under a separate specific consultancy contract), shall be treated as giving advice for application in relation to specific circumstances or a specific project. We are not responsible for:

a. updating you or any delegate in respect of any changes of law or practice after the course;

b. your, or any delegate’s, application of what they have learnt;

c. reporting to you any concern we have with regard to any delegate or of any failing of any delegate during the course.

18. For six months after the course, neither you nor any of your associated companies shall offer employment to any of our staff concerned in this commission without our prior agreement.

19. We will exercise reasonable skill and care in carrying out our services. Save in respect of any claim under this contract for breach of this Clause 19, we shall not be liable in connection with the carrying out of our services. Unless expressly agreed in writing, we shall not be liable for the performance of any other person not engaged by us, nor responsible for checking or reporting on their performance.

20. Our total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with a course and our services relating to the course shall be limited to three times the fees paid by you for the course.

21. We shall not be liable for any indirect costs or consequential losses incurred by you howsoever arising.

22. We shall be under no liability if we are unable to carry out any of our services as a result of force majeure. “Force majeure” means any reason beyond our control including (without limiting the foregoing): act of God, acts of terrorism, legislation, war, fire, flood, drought or other adverse weather conditions, failure of power supply, lock-out, strike or any other action taken by employees in contemplation or furtherance of dispute or unexpected illness of the tutor.

23. This contract does not confer any rights on anyone other than the parties to it.

24. This agreement shall be governed by and construed in accordance with English Law.
