2008-09 LEA Performances on Annual Measurable Achievement Objectives (AMAOs 1, 2, and 3) under NCLB Title III and Notice of Final Interpretations

The State Board of Education has adopted a policy (HSP-A-012, amended in September 2009) stating that subgrantees receiving Title III funds (including LEAs and public charter schools, with consortia as defined in No Child Left Behind legislation) must meet a series of Annual Measurable Achievement Objectives (AMAOs).

Based on the Notice of Final Interpretations (NOFI), published in the Federal Register by staff at the US Department of Education (October 2008), AMAO calculations have been altered compared to last year. Changes include:

·  For AMAO 1 (Progress):

No substantive changes have been made by the federal government. Determinations are still based only on LEP students in Title III entities that have had two annual ELP assessments.

o  The criterion for progress on the North Carolina assessments is determined for each LEP student by an increase in English language proficiency in at least one of the four assessed language domains. A series of correspondence tables linking IPT proficiency levels to ACCESS for ELLs proficiency levels was made in a bridge study conducted by researchers at the Center for Applied Linguistics (Summer, 2009).

·  For AMAO 2 (Proficiency):

o  As per the NOFI, all LEP students (K-12) are being included in calculation of AMAO 2. This is a change from last year’s determinations, when only LEP students in a Title III LEP program for 5 or more years were included in the cohort analyzed for this AMAO. In addition, no credit is being awarded this year to Title III subgrantees when LEP students attain English language proficiency shortly after entry into an LEP instructional program.

o  In this AMAO, a performance criterion for the attainment of English language proficiency was established. The criterion is a composite proficiency level of 4.8 on the ACCESS for ELLs, as well as obtaining a proficiency level of 4.0 on the reading and writing domains. The highest possible proficiency level on the ACCESS for ELLs, for both the composite score and scores in language domains, is 6.0

o  A target percentage of LEP students reaching this criterion was also set for Title III subgrantees to meet. If subgrantees meet or exceed that target percentage, AMAO 2 was “Met.” In consultation with ESL and Accountability Services staff, performance criteria and the target percentage (14.7%) were established by researchers at WestEd and the Wisconsin Center for Education Research (Summer, 2009). The final criteria and target were approved by DPI’s LEP Testing Advisory Group and by the SBE.

·  For AMAO 3 (AYP for the LEP Subgroup):

o  Per federal regulations, AYP for the LEP subgroup was determined for Title III exactly as done under Title I. Programming changes for the incorporation of monitored former LEP students in these calculations was performed; this has been verified. A Title III subgrantee’s status on AMAO 3 is based on the performance of the LEP subgroup on four sub-targets (two subject areas at two grade spans). Performance on each subtarget is shown by functioning on two goals: Proficiency and 95% Participation.

The following report documents the status of all Title III entities (individual LEAs as well as LEAs grouped into the NE consortium) on AMAOs 1 and 2 (Progress and Proficiency) achieved during the ACCESS for ELLs annual assessment in Spring 2009. Each LEA’s status on AMAO 3 is also reported.

AMAO 1: Progress

Statewide targets for progress toward English language proficiency are first shown for several academic years (Table 1):

Statewide in 2009, progress toward English language proficiency was met by all Title III entities. The percent of LEP students making progress toward English language proficiency, as well as AMAO 1 status, is shown in Table 2 for each Title III subgrantee.

1 LEP students used in AMAO 1 determinations include those with annual ELP assessments from the 2007-08 academic year (IPT proficiency levels) and from 2008-09 academic year (ACCESS for ELLs proficiency levels). Linkages between IDEA IPT and ACCESS for ELLs proficiency levels were determined with a bridge study conducted at the Center for Applied Linguistics (Summer, 2009).

AMAO2 (Proficiency), 2008-09

AMAO2 results, based on the percent of LEP students attaining English language proficiency (ELP), are shown below. The criterion for attaining ELP was defined as obtaining, on the ACCESS for ELLs, a composite proficiency level of 4.8, with proficiency levels of at least 4.0 on both the Reading and Writing domains. This criterion and a target percentage (14.7%) were established with the assistance from external consultants. Targets for several academic years are shown in Table 3. The AMAO 2 numerator, denominator, the AMAO 2 ratio expressed as a percentage, and status on this AMAO are shown in Table 4. This table shows that the NE consortium did not meet the AMAO 2 target, and that approximately 28% of the Title III entities (25/88) met the AMAO 2 target of 14.7%.
