A BILL
TO AMEND ACT 472 OF 1976, AS AMENDED, RELATING TO THE BOARD OF TRUSTEES OF SCHOOL DISTRICT NO. 4 OF MCCORMICK COUNTY, SO AS TO CREATE ONE SINGLEMEMBER AND TWO MULTIMEMBER ELECTION DISTRICTS IN WHICH TRUSTEES SHALL RESIDE AND FROM WHICH MEMBERS MUST BE ELECTED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION1.Section 1 of Act 472 of 1976 Code, as last amended by Act 185 of 1997, is further amended to read:
“Section 1.(A)The County Board of Education of McCormick County is hereby constituted as the Board of Trustees of School District No. 4 of McCormick County, with all powers and duties prescribed by law for suchthis board of trustees. The board shall consist of seven members to be elected in the general election commencing with the general election of 1976 for terms of foursfour years and until their successors are elected and qualify, except that of those first elected three shall serve for terms of two years only. The four members receiving the greatest number of votes shall serve for four years and those receiving the least number of votes shall serve for two years. If the members receive the same number of votes, the length of terms shallmust be determined by lot.
(B)(1)All candidates shallmust be qualified electors of McCormick County and must be elected from one of three election districts, as delineated on a map designated as S650407 prepared and on file with the Office of Research and Statistics of the State Budget and Control Board, as follows: one member shall reside in District No. 1 whose term of office expires in 2010; three members shall reside in District No. 2 with one member’s term of office expiring in 2010, and two members’ terms expiring in 2008; and three members shall reside in District No. 3 with one member’s term expiring in 2010, and two members’ terms expiring in 2008. All incumbents shall serve the remainder of the terms for which they were elected.
(2)Candidates receiving the highest number of votes in each district are declared elected. They shall file and qualify as candidates, to be voted on at the time of the general election, by filing and/or registering a statement of candidacy, or both, with the Board of Election and Registration of McCormick County not later than twelve o’clock noon on September 1st firstor, if September 1stfirst falls on Sunday, not later than twelve o’clock noon on the following Monday of the year in which the general election is to be held.
(C)In the event that candidates doIf a candidate does not offer in the general election for anya fullterm vacanciesvacancy on the board as specified aboveas provided for in subsections (A) and (B), the Governor shall appoint thea trustee or trustees to fill any suchvacanciesa vacancy upon the recommendation of the McCormick County Council. Any vacancies shallA vacancy must be filled for the unexpired portion of a term by appointment by the Governor upon recommendation of the McCormick County Council. In making recommendations for appointmentsan appointment to fill a fullterm or an unexpiredterm vacanciesvacancy, the McCormick County Council may request and receive recommendations from the board of trustees.
(D)The board shall elect a chairman who shall serve for one year.”
SECTION2.This act takes effect upon approval by the Governor and applies to elections conducted at the general election of 2008.
